The present procedure has the purpose of concluding a framework agreementu for the provision of preventive maintenance services (technical revision and ITP) and car repairs, for the car park, owned by INCDS Marin Dracea, S.C.D.E.P. Brasov. The indicative list of vehicles, services and quantities required can be found in the specifications and its annexes. The duration of the framework agreement is 12 months from its signature or until-coverage of the quantities and / or maximum values provided in the documentation and will be concluded with only one economic operator. The evaluation period for tenders is 3 months (90 days) from the deadline for submitting bids. This period may be extended in duly justified cases, by informing the economic operators involved in the procedure within two days from the aprthe decision to extend. Main Site: The economic operator must have a registered office or RAR authorized place of business in the city of Brasov or within a radius of not more than 10 km from the headquarters of the contracting authority.

The estimated amounts for the framework agreement are those foreseenplease refer to the specifications in Annexes 2 4. Thus, it is estimated that:

- minimum 6 revisions 20 ITPs 12 hours repairs 252 spare parts,

maximum 39 revisions 20 ITPs 273 hours repairs 982 spare parts

related to a subsequent contract / firm order is estimated to be:

- minimum 1 hour repairs,

- maximum 2 revisions 1 ITP 8 hours repairs 49 spare parts

DUAE (Unique Documentof the European Procurement Agreement).

- According to the provisions of art. 193 of Law 98/2016, the contracting authority will accept in the tenders, DUAE, in place of the documents required for the demonstration of qualification requirements, as preliminary evidence. DUAE can be downloaded for submission and submission at https://ec.europa.eu/tools/espd (instructions for completing DUAE are availablewww.e-licitatie.ro).

If the economic operator demonstrates that the economic and financial situation or the technical and professional capacity criteria have been met by invoking the support of a third party, the DUAE shall include the information referred to in paragraph (1) with respect to the supporting third party. If the economic operator intends to subcontract part / pcontract documents, the DUAE also includes the required information on subcontractors. Supporters / third parties and subcontractors should not find themselves in the situations provided for in art. 164, 165, 167 of Law 98/2016. The way by which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in art. 193, paragraph 1 of Law 98/2016 with information related to their situationthe contracting entity may require tenderers to submit all or some of the supporting documents as evidence of the information contained in the DUAE at any time during the conduct of a procurement procedure if this is necessary to ensure the proper conduct of the procedure. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, are to be submitted, at the request of the contracting authority, only by the first ranked bidder and, as the case may be, by the third party or its subcontractors.

The supporting documents will be:

1 ) Finding certificates on the absence of overdue debts regarding the payment of taxes, taxes or contributions to the budget(2) the criminal record of the economic operator and the members of the management or supervisory body of that economic operator or of those having decision-making power; or in its case, as it results from the certifying certificate issued by the ONRC or the constitutive document;) documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 (if applicable)

The information contained in the supporting documents must be valid / valid at the date of their presentation. For foreign legal / physical persons, docequivalents issued in the country of residence. The bidders, the supporting third parties and the subcontractors must not find themselves in the situations provided by art. 58 60 of Law 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE will be completed according to art.-193 par. (1) of the Law 98/2016 with the information related to their situation, and upon finalizing the evaluation of the tenders, the contracting authority will ask the first ranked bidder to submit Form 5 "Statement regarding non-compliance with the provisions of art. 59 and 60 of Law no. 98/2016 on Public Procurement.
