The subject of the order is a service for removing failures and technical support for devices and technological installations, as well as the provision of a qualified staffat the request of the Employer. The Contractor will be obliged to ensure full technical efficiency and to comply with the normative technical parameters of the technological installation allowing for efficient and safe conduct of processes taking place at the Department of Thermal Waste Transformation in Krakow.

Order subjectThere is a service for removing breakdowns and technical support for devices and technological installations, installed and working on the premises of the Thermal Waste Processing Plant in Krakow, as well as providing a qualified staff at the request of the Employer. The Contractor will be obliged to ensure full technical efficiency and comply with the normative technical parametersof technological installations allowing for efficient and safe conduct of processes taking place at the Department of Thermal Waste Transformation in Krakow.

6.2. The ordering person reminds about the obligation resulting from art. 24 sec. 11 Pzp, ie the obligation to submit by the contractor within 3days from posting information on the website referred to in art. 86 par. 5 of the PPL, statements on belonging to or lack of belonging to the same capital group, referred to in art. 24 sec. 1 point 23 Pzp. With the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure.In the case of a joint bid, the said statement must be submitted by each of the Contractors jointly applying for the order. These documents should be submitted in electronic form, signed with a qualified electronic signature.

6.3. At the same time, exercising the right under Art. 26 par. 2f of the Public Procurement Law, the Employer requires that each Contractor additionally provideshe edited as of the date of their submission, statements and documents confirming the circumstances referred to in points 5.2 and 5.3 of the ToR, as well as statements and documents confirming that the services offered meet the requirements specified by the Employer, ie:

6.3.1. Declarations and documents confirming no grounds for excluding the contractor:

6.3.1.1. Information from the National Criminal Record in the field ospecified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of offers; If the contractor has a registered office or place of residence outside the territory of the Republic of Poland, instead of this document, he shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial authorityadministrative office of the country in which the contractor has its seat or place of residence or place of residence has a person who concerns information or a document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 of the Public Procurement Law. If in the country in which the contractor has its registered office or place of residence or place of residence has the person the document refers to, the documents referred to in para.above, it is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document concerned, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authority or the place of residence of the contractor orplace of residence of this person. The requirements as to the date of issue of the document apply accordingly.

5.1. The Contractors may apply for awarding the contract, who: - are not subject to exclusion - in accordance with item 5.2.

- they meet the conditions for participation in the proceedings in accordance with point. 5.3.5.2. Conditions for exclusion of contractors:

5.2.1. The contractor is precluded from the contractor for whom there are premises to precludefrom the proceedings referred to in art. 24 sec. 1 Pzp.

5.2.2. Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13, 14, 16-20 Pzp, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, on the terms set out in Article. 24 sec. 8 and 9 Pzp.

5.2.3. The contracting authority may exclude the contractor at any stage of the procurement procedureof property.

6.1.1. Documents from which the authorization for making declarations of will appears on behalf of the contractor (at least to submit an offer), eg an extract from the National Court Register or CEIDG (if applicable). If the contractor acts through a proxy, additionally attach the appropriate power of attorney for the given person.

6.1.2. A completed offer form - constituting Annex 2 to the ToR.

Note: fromagi on the nature of these documents as declarations of will of the Contractor, they are not subject to supplementation.

6.1.3. Current on the day of submitting bids statement in the confirming scope:

6.1.3.1. there are no grounds to exclude a contractor to the extent specified in point 5.2. SIWZ;

6.1.3.2. Fulfillment of the conditions for participation in the proceedings by the contractor in the scope specified in point 5.3. Terms of Reference.

6.1.4. A statement aboutm referred to in 6.1.3. The contractor submits in the form of a single document (EAT) information on how to fulfill the EED can be found under the link: https://www.uzp.gov.pl/baza-wiedzy/jednolity-europejski-dokument-zamowienia.

6.1.5. In case of using the resources of another entity on the principles specified in item 5.3.2 .:

6.1.5.1. evidence that the Contractor will have the necessary resourcesthe subject of this entity. The proofs are to specify in particular: the scope of the contractor's resources available from the third party, the manner of their use, scope and period of participation of the entity providing resources in the implementation of the order.

6.1.5.2. The Contractor is additionally obliged to submit a declaration in the form of an EAT regarding these entities, signed by the entity to whom the EMS relates.

6.1.6. In case ofjointly applying for contracting by contractors, JINS are submitted by each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

6.1.7. Applies to EAT: Contractor's own declarationsubmitted in the form of a single European order document (EAT) according to the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 laying down a standard form for a single European order document (Official Journal of the EU L 3/16) as preliminary evidence submitted in to confirm compliance with the conditions of participation in the proceedings and the lack of attitudes to exclusion. - Note: Orderingallows Contractors to complete only a general statement regarding all the eligibility criteria referred to in Part IV Section α EAT, without the need to complete further sections of part IV of the form regarding the eligibility criteria, and appropriate (evidence-based) verification of compliance with specific conditions of participation specified by the customer in the proceedings of the orderin principle, at the end of the proceedings, based on relevant documents submitted by the contractor, whose offer will be evaluated at the most.
