The subject of the Order is performance by the Contractor for the Employer of works covering its scope, capitalized refurbishment of cooling, technological and bus water systems in the Heat and Power Plant Siekierki, under-which will be carried out works including the renovation of the Facilities including the supply of necessary materials, spare parts, apparatus and devices, components and installations, and preparation documentation and technical documentation as well as as-built. The subject of the Order is performance by the Contractor for the Employer's work includingh its scope covers the refurbishment of the cooling, technological and bus water systems in the Siekierki Heat and Power Plant, under which work will be carried out covering the renovation of the Facilities with the supply of necessary materials, spare parts, equipment and devices, components and installations, and preparation documentation will be prepared. these documentationChief executive and as-built. - The Contractor shall submit to the Ordering Party at his request a copy from the relevant register or from the Central Register and Information on Business, if separate provisions require entry in the register or records, to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Act

1. Contractors excluded from the proceedings are: - not listedali fulfilling the conditions for participation in the proceedings, or did not demonstrate the absence of grounds for exclusion, - a natural person who has been convicted of a criminal offense: -a) referred to in art. 165a, art. 181-188, art. 189a, art. 218-221, art. 228-230a, art. 250a, art. 258 or art. 270-309 of the Act of 6.6.1997 Penal Code (Journal of Laws item 553, as amended) or - art. 46 or art. 48 of the Act of 25.6.2010 on Sporanduse (Journal of Laws of 2016, item 176),

b) of a terrorist character, referred to in art. 115 - 20 of the Act of 6.6.1997 Penal Code, - c) treasury, - if a member of its management or supervisory body, a partner of the company in a registered partnership or partnership or a general partner in a limited partnership or limited joint-stock partnership or proxy, convicted for a criminal offense, about which I am talking aboutin art 24 sec. 1 point 13 (excluding the conviction of this person for the offense listed in Article 24 paragraph 1 point 13 letter d of the Act Article 133 paragraph 4 of the Act), - for which a final court judgment or final administrative decision was issued on the outstanding payment taxes, fees or social security or health contributions, unless the contractor has made payment of taxes due, fees or chargessocial security or health insurance with interest or fines, or made a binding agreement on the repayment of these debts, - as a result of deliberate action or gross negligence, the customer misleading on the information that he is not subject to exclusion, meets the conditions for participation in the proceedings or objective and non-discriminatory criteria, hereinafter referred to as'selection criteria ", or who concealed this information or is unable to produce the required documents, - as a result of recklessness or negligence presented misleading information ordering, which may have a significant impact on decisions taken by the ordering party in the procurement procedure,

- which unlawfully influenced or attempted to influence the activities of the ordering partyor obtain confidential information that may give it an advantage in the procurement procedure,

-ktory has been involved in the preparation of the procurement procedure or employee, as well as a person who performs work on the basis of a contract of mandate, agency, or other contract for the provision of services, he participated in the preparation of such proceedings, unless the competition caused by this disturbancencja can be eliminated in other ways than by excluding the contractor from participation in the proceedings,

-ktory with other contractors concluded an agreement to distort competition among contractors in the procedure for awarding the contract, which the contracting authority is able to demonstrate by means of appropriate evidence, - being a collective entity, against which the court has ruled that it is forbidden to apply for-public orders pursuant to the Act of 28.10.2002 on the liability of collective entities for criminal acts,

-with the preventive measure, the prohibition of applying for public orders,

-contractors who belong to the same capital group within the meaning of the Act within the meaning of the Act of 16.2.2007 on competition and consumer protection, submitted separateoffers, partial offers or requests to participate in the proceedings, unless they prove that the interlinking between them does not lead to distortion of competition in the procurement procedure - the liquidation of which has been opened. • Contractors may apply for the contract, who will show an average annual income of at least PLN 4, 000, 000.00 for the period othree years, and if the period of activity is shorter, this average annual income for this period determined on the basis of the "Profit and Loss Account" of part of the financial statements (item "Net income from the sale of products, goods and materials" or "Net revenue from sales and be matched with them ") or in the case of Contractors not obliged to prepare the aforementioned documentntow, other documents defining turnover and liabilities. The average annual revenue is the total of revenues from the last 3 financial years divided by 3, and if the period of activity is shorter, the average annual revenue is the total revenue from this period divided by the number of years corresponding to this period. If the income is given in foreign currencies, then the Employer will make a paymentto remit them according to the average NBP rate of Table A announced on the day the invitation to publish was sent for publication in the Official Journal of the European Union. If the exchange rate of this currency is not published by the National Bank of Poland on the day referred to above, the Ordering Party will apply the average exchange rate of the currency recently announced by the National Bank of Poland before the abovementioned date.and based on art. 24aa paragraph 1 of the Public Procurement Law, may first evaluate the offers and then examine whether the contractor, whose tender was rated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure. Offer must be made in writing under pain of nullity. All documents prepared in a foreign language must be submitted together with the translations-Polish language.

Offer and attachments must be signed by the person / s authorized to represent the Contractor. Authorization (power of attorney) to sign the offer should be attached to the offer in the original, unless it results from other documents attached by the Contractor.

By submitting your tender, the Contractor accepts in full and without reservations the terms of the orderincluded in the Terms of Reference (hereinafter referred to as "SIWZ") with all attachments being its integral part.

In order to pre-confirm that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings, the Contractor encloses to the offer valid as of the day of submitting the offers in the form of a single document available in an editable form and an es filepd-request.xml posted on the website https://termika.eb2b.com.pl/ in the "Annexes" tab. Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent that they refer to their resources, the condition of participation in the proceedings, also submits in the original, uniform documents concerning these entities, written by the entity whose documents relate.

In the case of joint application for contractors, the single document is submitted by the original to each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates fulfillment of the conditions for participation in the progressiveand the lack of grounds for exclusion.

The single document shall be prepared and submitted in electronic form on the internet platform from the address https://termika.eb2b.com.pl/, in accordance with the specimen standard form specified in the European Commission executive regulation issued on the basis of art. 59 par. 2 of Directive 20 14/24 / EU and art. 80 ust. 3 of Directive 2014/25 / EU.9.5.

Local inspection

1. Zamawhe will convene a meeting of Contractors (a local vision of the place of future work), which will take place on November 6, 2019 at the EC Siekierki in Warsaw at ul. Augustowka 30. Meeting at 10:00 at the port reception.

2. Participation in a local vision is not compulsory.

3. The Employer will answer all questions (provided in writing to the local visitor) related to the subject matter of the order placedby the Contractor. Questions and answers will be posted on the Employer's website (https://termika.eb2b.com.pl/).

4. The ordering party will provide the Contractor's representatives with access to the premises of his / her plant. The Contractors undertake to comply with the health and safety regulations in force at the Employer's premises (health and safety at work) and fire protection. (przfire-fighting) in accordance with the regulations in force at the premises of the Ordering Party.

5. The Employer does not insure the Contractor's representatives from any accidents, losses and damages suffered by the Contractor following such local vision. The contractor himself should insure his representatives in accordance with the applicable rules and regulations.

6. Contractor by 5.11.2019to hours 12:00 will send the Employer to the fax number (48 22) 587 87 87 list of persons who will take part in a local vision with the names and surnames and identity cards or passports (for foreign citizens). For organizational reasons, the Employer asks each Contractor to delegate up to 3 people
