Replacement of monoblock wheels in EZT series 45WE Impuls

Reference Number: MWZ3-26-4-2020

The subject of the order is replacement of 288 monoblock wheels (including 96 monoblock drive wheels) and 192 monoblock roller wheels) including replacement of brake discs, axial bearings and mounting material in wheeled setsch dismantled from twelve 45WE Impuls electric multiple units.

Main Site: Location indicated by the Contractor.

1. The subject of the order is the replacement of 288 monoblock wheels (including 96 monoblock driving wheels and 192 monoblock rolling wheels) together with the replacement of brake discs, axial bearings and mounting material in wheel sets dismantled from twelve electrich train units type 45WE Impuls.

2. Technical specifications of the 45WE Impuls type electric multiple units are presented in Annex 1 to the contract.

3. The Employer shall provide disassembled wheel sets to the place of replacement of 288 monoblock wheels and collect them after the replacement of monoblock wheels.

4. The Employer requires that the Contractor provide the factory with the contractnew:

1) monoblock wheels (driving and rolling),

2) brake discs,

3) axial bearings (ointment bearings),

4) other mounting materials (screws, nuts, washers, etc.).

5. The detailed description, scope and manner of implementation of the subject of the contract are set out in the Material provisions of the contract constituting Annex 9 to the ToR.

6. In all the provisions of the ToR and its annexes, in which the Employer refersto standards, European technical assessments, approvals, technical specifications and technical reference systems in accordance with Art. 30 paragraph 4 of the PPL, allows for the use of equivalent solutions, standards, European technical assessments, approvals, technical specifications and technical reference systems, indicated in the ToR and annexes. In the event of application of equivalent solutions, the Contractoris obliged to demonstrate in writing the equivalence of the technical parameters offered in relation to the subject of the order.

7. The Employer requires that the Contractor grant:

1) quality guarantee for the assembly work carried out for a period of at least 12 months, counting from the date of signing the acceptance report of the complete set of wheel sets from each vehicle, without comments,

2) set mileage guaranteeo wheeled on not less than 450 thousand km in the range of replaced wheels, brake discs, axial bearings and the mounting material used.

8. The Purchaser requires the contract to be completed by December 31, 2020.

9. The Employer requires that the replacement of monoblock wheels in each of the complete wheel sets disassembled from individual EZT 45WE Impuls type be completed withinlonger than 14 days from the day of handing over the wheel sets to the Contractor.

1. Contractors who meet the conditions for participation in the procedure regarding the competence or authorization to conduct specific professional activities may apply for the award of the contract, provided that it results from separate provisions - Activities carried out for the purposes of performing the contract do not require having specialpetitions or powers.

2. Contractors who are not subject to exclusion may apply for the contract - Conditions for excluding Contractors:

1) the Contractor shall be excluded from the contract award procedure in relation to which any of the circumstances referred to in art. 24 paragraph 1 point 12, point 13 lit. a-c, point 14 (excluding the case of a final conviction for crimeso referred to in item 13 lit. d), points 15-23 of the Public Procurement Law and art. 24 paragraph 5 point 1 of the Public Procurement Law,

2) the Contractor is excluded in the cases provided for in the ToR, taking into account the relevant provisions of Art. 24 paragraph 7 of the Public Procurement Law,

3) Contractor who is subject to exclusion pursuant to art. 24 paragraph 1 point 13 lit. a-c, point 14 (excluding the case of a final conviction for an offense specified in point13 lit. d), item 16 20 or art. 24 paragraph 5 point 1 of the Public Procurement Law, may provide evidence that the measures taken by him are sufficient to prove its reliability, in particular to prove the reparation of damage caused by a crime or tax offense, monetary compensation for the harm suffered or repair, comprehensive explanation of the facts and cooperation zolaw enforcement agencies and taking specific technical, organizational and personnel measures that are appropriate to prevent further offenses or fiscal offenses or incorrect conduct of the Contractor. The first sentence shall not apply if the Contractor, being a collective entity, has been ordered by a final and binding court ruling to not apply for the contractand the period of validity of the prohibition specified in this judgment has not expired,

4) the Contractor shall not be excluded if the Employer, taking into account the weight and specific circumstances of the Contractor`s act, deems sufficient evidence presented pursuant to item 3,

5) the Employer may exclude the Contractor for at each stage of the procurement procedure.

3. The Contractor shall add the current dday of submitting offers, a statement constituting a preliminary confirmation that the Contractor:

1) is not subject to exclusion from the procedure in the scope indicated in item 2,

2) meets the conditions for participation in the procedure in the scope indicated in Section III.1.2 point 1 and Section III.1.3 point 1

4. The Contractor is required to submit the declaration referred to in item 3 in the form of a Single European Order Document (EAT), prepared in accordance with the template of the standard form set out in the European Commission implementing regulation issued on the basis of art. 80 clause 3 of Directive 2014/25 / EU. EAT The Contractor is obliged to submit in accordance with the template constituting Annex 3 to the ToR.

5. In the event of joint application by the Contractors, JEDZ shall be submitted by each of the Contractors jointly applying foramowienie. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates compliance with the conditions for participation in the procedure and no grounds for exclusion.

6. If the Contractor refers to the resources of other entities, on the principles set out in art. 22a of the PPL, in order to prove that there are no grounds for them, excludeand to the extent to which their resources are referred to, the terms of participation in the proceedings are also submitted by JEDZ regarding these entities.

1. Contractors who meet the conditions for participation in the proceedings regarding economic or financial situation may apply for the contract - the Employer will consider the condition fulfilled if the Contractor demonstrates that he has the financial resources or the ability tocredit amount of not less than PLN 800, 000.00

2. The contractor may, in order to confirm compliance with the conditions for participation in the procedure, rely on the technical capacity or financial standing of other entities, as appropriate, regardless of the legal nature of the legal relations between them.

3. The Employer may at any stage of the procedure consider that the Contractor does not haveand the required capacities if the Contractor`s involvement of technical resources in other economic activities of the Contractor may have a negative impact on the performance of the contract.

4. If the Contractor demonstrating compliance with the conditions referred to in point 1, in Section III.1.3 point 1, relies on the abilities or situation of other entities, he must prove to the Employer that in carrying out the contract he will haveThe necessary resources of these entities, in particular, presenting the commitment of these entities to make available to him the necessary resources for the purposes of the contract, using the template of Annex 5 to the ToR.

5. The contractor, which relies on the financial situation of other entities, is jointly and severally liable with the entity that has undertaken to make the resources available, for damage suffered byfrom the Employer arising from the failure to make these resources available, unless he is not responsible for the failure to make the resources available.

6. If the technical capacity or financial situation of the entity referred to in point 2 does not confirm the fulfillment by the Contractor of the conditions for participation in the procedure or there are grounds for exclusion for these entities, the Employer shall request that the Contractor within the period specified by Zof the ordering party:

1) replaced this entity with another entity or entities, or

2) undertook to personally perform the relevant part of the contract, if it demonstrates the technical capacity or financial situation referred to in item 2.

7. The Contractor shall attach to the offer the document referred to in Section III.1.1 item 4 and, respectively, the documents referred to in item 4, Section III.1.1 items 5-6, as well as:

1) youcompleted and signed Bid Form, using the template of Annex 1 to the ToR,

2) completed and signed the Price Form, using the template of Annex 2 to the Terms of Reference,

3) documents giving the right to sign the offer or to sign other documents submitted with the offer, unless the Employer can obtain them in particular by means of free and generally availabledatabases, in particular public registers within the meaning of the Act of 17.2.2005. on the computerization of the activities of entities performing public tasks, and the Contractor indicated this when submitting the offer, provided that the right to sign them does not result from the documents submitted with the offer,

4) power of attorney for persons signing the offer on behalf of the Contractor, if the offer is signed bynomocnik,

5) power of attorney referred to in Section III.1.8 (if applicable).

8. The Contractor, within 3 days of placing information on the Purchasing Platform, as referred to in art. 86 section 5 of the Public Procurement Law (information from the opening of bids), provides the Employer with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the PPL Act fromusing the template of the declaration constituting Annex 6 to the ToR. Along with submitting the declaration, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure.

9. The Awarding Entity, before awarding the order, will call the Contractor whose tender has been rated the highest to be submitted within the prescribed period, not shorterthan 10 days, valid as at the date of submitting statements or documents confirming the circumstances referred to in art. 25 paragraph 1 of the Public Procurement Law
