The subject of the order is maintenance services of installations, systems and devices on the premises of the multimodal Ł-dz Fabryczna station located in the area Multi-station Bus Stopego and underground car parks.

1.The subject of the order are maintenance services of installations, systems and equipment at the multimodal Ł-dz Fabryczna station located in the area of the Multistation Bus Stop and underground car parks.

The subject of the contract is a substitute for the obligations arising from Agreement No. 90/131/0004 / 11I / I ofAugust 18, 2011.

The contractor, within 7 days of signing the contract, is required to provide a written statement that he has the required in accordance with the DTR, Instructions for Use and warranty conditions, authorizations, consents or other documents allowing the provision of services in a way that does not violate the conditions warranty and guaranteeing the retention of rights arising from it.

2. The Purchaser reserves that everywhere thism where in the content of the Description of the subject of the order (hereinafter referred to as OPZ) and the Contract Act Form constituting the description of the subject of the order, the description of this subject indicates the trademarks, patents or origin, sources or detailed processes that characterize the products or services provided by a specific contractor, European standards, technical assessments, tec specification approvalstechnical reference systems referred to in art. 30 paragraph 1 point 2 and par. 3 of the Act, the Employer allows methods, materials, devices, systems, technologies etc. equivalent to those described in the description of the subject of the contract. Equivalent to the order object described in the description is understood to be made by any manufacturers while maintaining identical or better parametersin technical and functional qualities as well as fully compatible with the rest of the devices, provided that they meet the same technical properties and that at the stage of the contract they are approved by the Employer. The Employer`s decisions in this respect will be based on the requirements formulated in the contract documents, as well as standards and guidelines.

The parameters of the indicated standard specify the minimume technical, operational, use, quality and functional conditions to be met by the subject of the contract. Indicated trademarks, patents, brands or names of the manufacturer

Do the sources or specific processes indicating the origin only specify the class and are used to determine the desired standard of performance and determine the properties, technical requirements of the product, methods, materials, devices, systemsemow, technologies, etc. The offer may include methods, materials, devices, systems, technologies, etc. of other brands and manufacturers, but with technical, quality and functional and functional parameters corresponding to the methods, materials, devices, systems, technologies etc. described in Terms of Reference. In addition, the Employer emphasizes that equivalent methods, materials, devices, systems, technologies etc. cannot constitute substitutes for methods, materials, devices, systems, technologies etc. described in the description of the subject of the order by means of trademarks, patents, origin, source or a detailed process

3.Ordering, pursuant to art. 29 paragraph 3a of the Act, requires that activities related to the performance of the contract involving the provision of review servicesin maintenance installations, systems and equipment were carried out by at least 1 person employed by the Contractor or subcontractor under an employment contract.

4.Requirements for employment by the Contractor or subcontractor under an employment contract referred to in Article 29 paragraph 3a of the Act, persons performing activities within the scope of the contract are specified in item 3 above and in Tom III of the ToR. Form of the contract act. based on Article. 24 paragraph 1 (mandatory grounds for exclusion) and art. 24 paragraph 5 of the Act (optional grounds for exclusion)zenia) and

b) compliance with the conditions for participation in the proceedings referred to in art. 22 paragraph 1Ustawy.

2. Due to the limited number of characters in the announcement form, a description of the subject of the contract, statements and documents that the contractors are required to provide, confirming compliance with the conditions for participation in the procedure and the lack of grounds for exclusion have been specified in the order documents, Volume I of the ToRZ Instructions for Contractors, posted on the contracting authority`s website. Detailed information on the conditions for participation and the grounds for exclusion and a list of statements or documents confirming the fulfillment of the conditions for participation in the proceedings and the absence of grounds for exclusion can be found in points 6 and 7 of Volume I of the ToR.

3. A statement constituting a preliminary confirmation of compliance with the conditions for participation in the progressand no grounds for excluding the contractor from the procedure, the Contractor should submit in the form of a single order document (EAT). The Ordering Party provides the EAT file in .xml format, which after importing should be supplemented, saved, provided with a qualified electronic signature, and then, together with the files constituting the offer, compressed into one archive file (ZIP). Detailsand the instructions in point 7.1.1, point 11 of Volume I of the ToR. Contractors jointly applying for the contract shall submit a EAT declaration separately for each of them. The Contractor, which refers to the resources of other entities, makes a separate EAT statement about this entity.

4. The contractor, within 3 days of posting on the website information from the opening of offers, provides the contracting authority with a statementa claim of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 item 23 of the Act. Together with the submission of the declaration, the contractor may provide evidence that the links with another contractor do not lead to a distortion of competition in the procurement procedure. Model declaration on belonging or not belonging to the same capital group zoscheap, placed on the website of the contracting authority together with information from the opening of tenders. In the case of joint application for the Contract by the Contractors, a declaration of belonging or not belonging to the same capital group shall be made by each of the Contractors.

5. The Awarding Entity provides for the possibility of using the provisions of Art. 24aa section 1 of the Act stating that: "The Purchaser may, inProceedings conducted in an open tender, first evaluate the offers and then examine whether the contractor whose tender has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure "in accordance with the reservation in point 7 of Volume I of the ToR.

6. Contractor will be required to provide a quality guarantee for the replacement parts in accordance with contentThe contract template (Volume III of the SETC) for a period of 12 months from the date of each monthly acceptance.)

The period of quality guarantee may be extended if the Contractor offers a longer period of quality guarantee in accordance with the provisions of point 17 of the SETC.

The contractor will be obliged to provide a warranty for the subject of the contract for a period of 24 months from the date of signingaround the final acceptance.

7. The contractor is obliged to perform the subject of the contract in the period from the date of conclusion of the contract (however not earlier than from 01/01/2020) to 31/05/2021

8. At the request of the Employer to confirm the absence of grounds for exclusion from the participation in the post. The Contractor is obliged to submit information, certificates, transcripts and declarations referred to in - 5 of the Regulationon the types of documents that the Employer may request from the contractor in the procurement procedure.
