The subject of the order is: Repair and replacement of flue gas duct after drying furnaces to the surroundings (chimneys) of mill circulation systems No. 1, 3, 4 at EC Czechnica.

The scope of work includes all the work necessary to comprehensively perform the task of replacing a damaged brickwork together with the steel structure of the flue gas ducts behind the drying ovens to the surroundings installed in the system of mill installations No. 1, 3, 4 at EC Czechnica. As part of this work are envisaged:

- preparatory work,

- design work,

- facility work- 1 - execution of as-built documentation.

1 Contractors, who are:

1.1, can participate in the proceedings. They are not subject to exclusion, in accordance with item 15.2 of the TOR.

1.2. They meet the conditions for participation in the proceedings, in accordance with item 15.6 of the ToR. Contractors may participate, for whom there are no grounds for exclusion from the proceedings under Art. 24 sec. 1 point 12 23 of the Public Procurement Law, with reservationby virtue of art. 133 ust. 4 of the Public Procurement Law and are not subject to exclusion pursuant to art. 24 sec. 5 points 1 2, 4 and 8 of the Public Procurement Law. The exclusion takes place in the cases specified in art. 24 sec. 7 of the Public Procurement Law Act

3 Contractor who is subject to exclusion pursuant to art. 24 sec. 1 point 13 and 14 and 16 20 or par. 5 point 1 2 and 8 of the Public Procurement Law, may present with the offer evidence that the measures taken by him aresufficient to demonstrate its reliability, in accordance with art. 24 sec. 8 of Public Procurement Act

4, the Contractor is not subject to exclusion, if the Awarding Entity, considering the weight and special circumstances of the Contractor`s action, considers sufficient evidence provided by the Contractor under item 3 above.

5 In cases referred to in art. 24 sec. 1 point 19 of the Public Procurement Law, before exclusion of the Contractor, the Ordering Party fromthis Contractor may prove that his participation in the preparation of the contract award procedure does not distort competition.

6 Contractors who meet the conditions for participation in the procedure, specified in art. 22 par. 1 of the Public Procurement Law, regarding:

6.1 Competence or entitlements to conduct a specific professional activity, if it results from separate onesthe ordering party, ie: the Ordering Party does not set specific requirements to meet this condition.

The Contracting Authority will consider that the Contractor meets the condition of participating in the economic or financial situation proceedings, if the Contractor shows that he has a paid insurance policy against the sum insured less than PLN 5, 000, 000.00 (in words: five million zlotys)).
