Part I Orders for performing scheduled (unplanned) and emergency service work on pumps from the company Duechting Pumpen at PGE Energia Ciepła S.A. Coast Branch in Gdańsk (Gdańsk and Gdynia) within 48 months from the date of concluding the contract or until exhaustion of fundsow provided for its implementation.

1. Contractors who are not subject to exclusion and meet the conditions for participation in the procedure can apply for the award of the contract. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 sec. 1 item 12-23 of the PPL and art. 24 sec. 5 points 1, 2, 4, 8 Pzp with the exception of art.24 section 1 point 13 letter d. Of the PPL, and in the case referred to in art. 24 sec. 1 point 14 of the PPL, if the person referred to in this provision has been convicted of an offense listed in art. 24 section 1 point 13 letter d. Pp.

3. The Contractor is obliged to attach to the offer a statement valid as of the day of submitting bids constituting preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions of thighsin the proceedings.

4. The statement referred to in point 3 The Contractor is obliged to submit in the form of a document drawn up in accordance with the specimen of a standard form defined in the European Commission's executive regulation issued on the basis of Article 59 (2) of Directive 2014/24 / EU, hereinafter referred to as "EAT". call the contractor whose offer has been assessedat the most, to submit in a designated period, not shorter than 10 days, valid as at the date of submission of declarations or documents confirming, among others there are no grounds for excluding the contractor from participation in the proceedings, including:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submission byfert;

2) certificate of the competent head of the tax office confirming that the contractor is not in default of paying taxes, issued no earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding the repayment of these receivables with any interest or fines, in particular it will getlegally provided for by law, postponing or spreading overdue payments in installments or suspending in full the decision of the competent authority; - 3) certification of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying contributions social insurance or-health, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular obtained the legally required exemption, postponement or distribution of overdue installments payment or suspension in full executiondecision of the competent authority,

4) copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to demonstrate the absence of grounds for exclusion under Art. 24 sec. 5 point 1 Pzp;

5) the contractor's statement that he has not been the subject of a final court judgment or final administrative decision against himlegally binding with taxes, fees or social security or health insurance premiums, or - in the event of such a verdict or decision - documents confirming the payment of such claims together with any interest or fines or a binding agreement regarding repayment of such receivables (in connection with art. 24 paragraph 1 item 15 Pzp);

6) declaration of the contractor about the lack of resolutionto him as a preventive measure for the prohibition of applying for public orders in connection with art. 24 sec. 1 item 22 Pzp);

7) the contractor's statement on not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716) . Contractors who meet the conditions d may apply for the orderboring economic or financial situation, including:

1) for Part I Orders have civil liability insurance in the scope of activities related to the subject of the order for the sum insured not less than PLN 1, 000, 000.00 (in words: one million zlotys);

2) for Part II Orders have civil liability insurance in the scope of their activitythe amount related to the subject of the order for the sum insured, not less than PLN 1, 000, 000.00 (in words: one million zlotys);

3) for Part III Orders have civil liability insurance in the scope of business related to the subject of the order for the sum insured not less than PLN 500, 000.00 (in words: five hundred thousand zlotys);

4) for Part IV. Orders psettle liability insurance in the scope of conducted activities related to the subject of the order for the sum insured not less than PLN 1, 000, 000.00 (in words: one million zlotys).

- in the case of submitting bids for more than 1 Part of the Order, requirements specified in point p. 1-4 above add up.

1. The proceedings are conducted in an unlimited tender procedure onart pond 39 in conjunction from art. 134ust. 1 of the Act of 29.1.2004. Public Procurement Law (ie Journal of Laws of 2017, item 1579 with amendments), hereinafter referred to as the "Pzp." - 2. PGE Energia Ciepła SA. No. 2 CUW in Krakow, is an entity authorized to prepare and carry out proceedings for the award of the Contract on behalf and for the Purchasers.

3 The Employer provides for the use, in accordance with Article 24aa Pzp, so-called reverse-facing procedure (ie it will first evaluate the bids and then examine whether the Contractor whose offer has been evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in the Procedure).

5. order thecy allows for the possibility to amend the Agreement on public procurement on the terms specified in the model contract constituting Volume III of the ToR.

6. The Contracting Authority informs that in a situation where the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in: - 1) Section III.1.1 point 5.1. submit information from the relevant register or, in the case of brato such a register, another equivalent document issued by a competent judicial or administrative body of the country in which the contractor has its registered office or place of residence has a person who is concerned with information or a document, to the extent specified in art. 24 sec. 1 items 13, 14 and 21 PPL, 2) section III.1.1 items 5.2.-5.4. submits a document or documents issued in the country in which the contractor-has its registered office or place of residence, confirming that: a) it is not in arrears with taxes, fees, social security or health insurance contributions or that it has entered into an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular legally required exemption, postponement or installment payment of overdue paymentsor suspension in full of the implementation of the decision of the competent authority,

b) its liquidation has not been opened or bankruptcy has been announced;

7. Documents referred to in points 6 (1) and 6 (2) (c) b), should be issued not earlier than 6 months before the deadline for submission of tenders. The document referred to in point 6 (2) (c) a), should be issued not earlier than 3 months before the expiry of this-period.

8. In the scope not specified in points 6-7 above and in the scope of documents (and their forms) confirming the fulfillment of conditions for participation in the proceedings, the provisions of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor the procedure for awarding the contract (Journal of Laws item 1126).

8. For the values indicated in the przz Contractor in a currency other than Polish zloty (PLN), the Employer will accept a conversion rate according to the average exchange rate of the National Bank of Poland (NBP) on the day of publication of the Contract Notice in the Official Journal of the European Union.

9.
