Modernization of the air fan system at PGEHeat Energy S.A. Branch in Rybnik. Modernization consists in delivery and replacement of three axial blast fans with a mechanical method of adjusting the opening of the rotor blades to hydraulic control. Contractors who are not subject to exclusion and meet the conditions for participation in the procedure can apply for the award of the contract. The contract award procedure excludes sContractor, in relation to which any of the circumstances referred to in Article 24 sec. 1 item 12-23 of the PPL and art. 24 sec. 5 points 1, 2, 4, 8 Pzp with the exception of art. 24 sec. 1 point 13 lit. d PPL, and in the case referred to in art. 24 sec. 1 point 14 of the PPL, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 point 13 lit. d Pzp.

3. Do ofeThe Contractor is obliged to attach a statement valid as of the day of submitting bids constituting a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. The statement referred to in point 3 The Contractor is obliged to submit in the form of a document drawn up in accordance with the specimen of the standard form set out in the Commission Implementing Regulation-European Union issued on the basis of art. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as "FOOD".

5 The contracting party, before awarding the contract, will call the contractor whose offer has been assessed at the most, to submit within the deadline, not shorter than 10 days, valid as at the date of submitting declarations or documents confirming, among others, no grounds for excluding the contractor from participation in the proceedings-including:

1) information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submitting bids;

2) certificate of the competent head of the tax office confirming that the contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline for submission of offers or other docthe contract confirming that the contractor concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or payment of overdue payments or suspension of the execution of the decision of the competent authority in full;

3) certificate the appropriate local organizational unit. ZaSocial Insurance Fund or Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with the competent authority in on the repayment of these receivables togetherwith possible interest or fines, in particular he obtained the legally required exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority; - 4) excerpt from the relevant register or from central records and business information, if separate regulations require entry in the register or records, in order to demonstrate the lackunder exclusion based on art. 24 sec. 5 point 1 Pzp;

5) the contractor's statement on the lack of issuing a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums or - in the event of such a verdict or decision - documents confirming the payment these receivables inonce with possible interest or fines or conclusion of a binding agreement regarding repayment of such receivables (in connection with Article 24 paragraph 1 item 15 of the PPL); - 6) declaration of the contractor about the lack of a ruling against him as a preventive measure to prohibit applying for public procurement in connection with art. 24 sec. 1 point 22 Pzp);

7) the contractor's statement on not paying taxes and fees to the premisesreferred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716).

Contractors who meet the conditions regarding the economic or financial situation may apply for the award of the contract. of which:

1) have third-party liability insurance in the scope of their activity for the sum insured not less than PLN 1, 000, 000.00 (in words:one million zlotys).

1. The proceedings are conducted in an unlimited tender on the basis of art. 39 in conjunction from art. 134 sec. 1 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2017, item 1579 as amended), hereinafter referred to as "Pzp." - 2 PGE Energia Ciepła SA Branch No. 2 CUW in Krakow, is the entity authorized to prepare and carry out the proceedings for granting the Orderon behalf of and for the benefit of the Employer.

3. The contracting authority provides for the use, in accordance with art. 24aa Pzp, so-called reverse-facing procedure (ie it will first evaluate the bids and then examine whether the Contractor whose offer has been evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in the Procedure).

5. The Employer allows for the possibility of amending the Agreement on public procurement on the terms specified in the model contract constituting Volume III of the ToR.

6. The Contracting Party informs that in a situation where the Contractor is established or resides outside the territory of the Republic of Poland, instead of documents about whichew in:

1) section III.1.1 item 5.1. submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned by the information or document, to the extent specified in Article . 24 sec. 1 points 13, 14 and 21 Pzp,

2)-section III.1.1 point 5.2.-5.4. submits a document or documents issued in the country in which the contractor has his registered office or place of residence, confirming that: a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of these receivables with possible interest or fines, in particular(b) its liquidation has not been opened or bankruptcy has been announced, 7) it has obtained the exemption, postponement or spreading into installments of overdue payments, or suspension in full, of the decision of the competent authority; Documents referred to in points 6 (1) and 6 (2) (c) b), should be issued not earlier than 6 months before the deadline for submission of tenders. The document about whichand in point 6 (2) (c) a), should be issued not earlier than 3 months before the expiry of this period.

8. In the scope not specified in points 6-7 above and in the scope of documents (and their form) confirming the fulfillment of conditions for participation in the proceedings, the provisions of the Minister of Development Ordinance of 26.7.2016 on the types of documents that the contracting authority may requestd contractors in the contract award procedure (Journal of Laws item 1126).

8. For the values indicated by the Contractor in a currency other than the Polish zloty (PLN), the Employer will accept the conversion rate according to the average exchange rate of the National Bank of Poland on the day of publication of the Contract Notice in the Official Journal of the European Union. The ordering party in accordance with art. 13 para. 1 and 2 and art. 14 para. 1 and 2 of the RegulationEuropean Parliament and Council (EU) 2016/679 of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (General Data Protection Regulation) (Official Journal L 119 of 04.05.2016, page 1), hereinafter "RODO", informs that specific provisions in this regard are included in the modelfrom the TOM III Agreement SIWZ and on the website https://pgeenergiaciepla.pl/Ochrona-Danych-Osobowych/Informacja-w-sprawie-przbudwarzania-danych-osobowych-dla-naszych-partnerow2.
