ARIA_2020_055 European tender with open procedure pursuant to Legislative Decree no. 50/2016 and subsequent amendments, for the assignment of the management and maintenance of the cryopreservation rooms

The contract concerns the stipulation of an agreement pursuant to art. 1, paragraph 4 of the L.R. n. 33 of 28.12. 2007 for the assignment of the management and maintenance of the cryopreservation roomsion as better described in the tender documents, in favor of the entities of the regional health service pursuant to art. 1 of the L.R. n. 30 of 27.12.2006 including the ASPs and entities of the health service of the regions affiliated with ARIA S.p.A.

Main Site: At the offices and premises of the entities of the regional health service referred to in art. 1 of the L.R. n. 30/2006 or of the partner regions che will join or will benefit from the convention

Service for the management and maintenance of the cryopreservation rooms in favor of the regional health service bodies as per art. 1 of the L.R. n. 30 of 27.12.2006 including the ASPs and bodies of the health service of the regions affiliated with ARIA S.p.A.

Pena the exclusion from the procedure as essential elements of the offer, the conCurrent must meet the following conditions:

a) registration for activities related to the subject of this contract, both with reference to the supply and service activities referred to in the contract, in the Chamber of Commerce or in the register of provincial commissions for crafts in compliance with the provisions of paragraph 3 of art. 83 of Legislative Decree 50/2016;

b) non-existence of the reasons for exclusionreferred to in art. 80 of Legislative Decree no. 50 / 2016.

1) the procedure is managed with the electronic system called Sintel, accessible from the website: www.ariaspa.it, whose description and method of use is specified in the specification as well as in the manuals available on the website: www.ariaspa. it

2) the specific requirements regarding the supply and related services, the methods of presentation and the elementsevaluation of the bids, the unit auction bases which cannot be overcome during the bidding under penalty of exclusion from the tender, subcontracting, further causes of exclusion and other tender information are contained in the specification. The duration of the individual supply contracts is 36 months, provided that the same is issued within the period of validity and effectiveness of the agreement itself;

3) the modalparticipation in the event of a temporary grouping of companies, in the case of aggregations between companies participating in the network contract, and in the case of a consortium are governed by the specification;

4) the participation of competitors who are among them in one of the control situations referred to in art. 2359 of the civil code or in any relationship, even de facto, if thecontrol situation or relationship:

i) implies that the offers are attributable to a single decision-making center;

ii) has influenced the formulation of the offer. Competitors for whom it is ascertained that the relative offers are attributable to a single decision-making center, on the basis of unique elements, will be excluded from the tender;

5) partial and / or conditional offers as pre are not allowedalso mentioned in the specification;

6) the competitors, with the presentation of the offers, allow the processing of their data, including personal data, pursuant to Legislative Decree no. 196/2003 as amended, and EU Regulation 2016/679 for insolvency and contractual needs;

7) information and clarifications on the tender documents can be requested according to the methods indicated in the tender specification, within and not oltre the deadline of 2.3.2020, now 10:00. The clarifications to the tender documents will be communicated / published in the manner specified in the specification;

8) the tenderers are required to indicate, when submitting the offer, the domicile elected for sending the communications, acknowledging that they will be sent by ARIA in the manner indicated in the attachment above;

9) and designored as sole responsible for the procedure for this procedure, Dr. Carmen Schweigl;

10) in the agreement scheme will be indicated the methods of ordering, invoicing and electronic payments;

11) and interest of the contracting station that the services are rendered in prevalently by the successful tenderer whose skills have been proven and, for this reason, the subappalto is admitted to an extent not exceeding 40%. Considering that the tender procedure in question is a centralized procedure characterized by large volumes, the same is more exposed to a need for control over the contract awarded also through the use of the institution of subcontracting. The assignment is characterized by type of service by essentiality that governsthe service itself is in vain. Furthermore, due to the same characteristics previously explained, the presence of the indicated percentage, considering the aggregation of volumes, the typology of the economic sector and the business fabric of reference, does not hinder the access of small and medium enterprises to the contract;

12) the possibility of increasing or decreasing performance is allowedcontractual ions up to one fifth of the maximum contractual amount under the same agreements, prices and conditions of the same. 20% change equal to the entire procedure at 146 400.00 EUR, excl. VAT; possibility of renewal for 12 months. Contract extension in case of non-erosion in the validity period of the agreement;

13) and participation in this procedure is allowed egr one or more lots of the same
