CPV Description: Procurement of the multi-material sack selection service (mixed plastic packaging in steel and aluminum cans and non-CONAI plastic boxes) CER 15.01.06, of the Municipality of Monza and the Municipality of Barlassina. Period 1.12.2018-31.12.2019 with an extension option of a further 12 months. CIG: 759220341D.

Refuse recycling services.

The offer of concurrents must be accompanied, under penalty of exclusion, by provisional deposit pursuant to art. 93 of Legislative Decree no. 50/2016, established in accordance with the procedures laid down in the Tender Guidelines.

The service is financed with municipal budget allocations.

General requirements required under penalty of exclusion:

A) registration to the Chamber of Commerce, Industry, Crafts and Agriculture by activity consistent with those ogof the present tender procedure, with indication:

- of the registration number,

- date of registration,

- legal form of the enterprise,

- name and personal data:

- of the legal representatives and holders of offices,

- members of the board of directors and the board of auditors,

- of the president,

- of the vice-president,

- of the technical directors,

- of the prosecutors and instigators (ovand envisaged),

- of the sole shareholder,

- of the majority shareholder, natural or legal person, in the case of joint-stock companies with less than 4 shareholders (if 2 shareholders hold shares or shares of equal share capital entit, indicate both of them). Declaration of similar content must, under penalty of exclusion, be rendered in the same forms, even in the case of a body not required to obbligo of registration with the C.C.I.A.A. with reference to the data certifiable in any case producing, at the same time, a copy of the deed of incorporation and of the articles of association (In the case of residence in a Member State - paragraph 3, article 83 of Legislative Decree No. 50/2016 and subsequent amendments) in one of the professional or commercial registers referred to in Annex XVI of Legislative Decree No. 50/2016 and subsequent amendments indicating that the business object of the workeconomic code is consistent with the subject matter of the present tender);

B) (if the hypothesis applies) for the cooperative companies, the inscription to the register kept by the Ministry of Production Activities pursuant to the D.M. of 23.6.2004 and for the social cooperatives the regional registration in accordance with the law 381/1991, which shows that the economic object of the economic operator is consistent-with the object of the present competition, specifying the details of the inscription, the social object and the generalities of the persons legally representing the cooperative;

C) (if the hypothesis occurs) for the ONLUS the extremes of the inscription registry of ONLUS ex art. 11 of Legislative Decree no. 460/97 and a copy of the deed of incorporation and of the articles of association indicating that the business object of the economic operator-is consistent with the subject of the present call for tenders, and the names of the legal representatives of the company;

D) the absence of the grounds for exclusion indicated in art. 80, of Legislative Decree no. 50/2016 and s.m.i.;

E) the absence of the cause of exclusion pursuant to art. 53, paragraph 16-ter, of Legislative Decree no. 165/2001;

F) compliance with the provisions of art. 80, paragraph 1 and paragraph 2 of Legislative Decree no. 50/2016 and s.m.i. with regard to the termination of office and the position of technical director in the year prior to the date of publication of the announcement;

G) the non-existence of any prohibition to contract with the public administration;

H) the commitment, in case of award, to observe and to point out to their employees and collaborators the code of conduct (published on the website comunale www.comune.monza.it - personal transparent administration personal disciplinary code), under penalty of termination of the contract;

I) the commitment to recognize, in case of award and if the plant is located more than 60 km from the point of departure (conventionally established in the Municipality of Monza in Piazza Trento and Trieste) and the point of arrival (site of the plant), how much stabilito from the art. 4.5 of the special contract documents (the declaration must be made only if the platform is located more than 60 km from the Municipality of Monza in Piazza Trento and Trieste);

L) compliance with the obligations related to the provisions in concerning the safety and protection of workers, pursuant to Legislative Decree no. 81/2008, as well as the conditions of work in the place of pres

M) the acceptance, without reservation, of the rules and conditions contained in the tender documents and in the special tender specifications,

N) the declaration that they have given full knowledge of the nature of the tendered tender and of all the general and particular circumstances that may affect the performance of the contractual services and the determination of the offer(O) the declaration of having examined the content of the specifications in all its articles and to accept fully and unconditionally, without any reservation, all the administrative, regulatory, technical, organizational and management provisions contained in the aforementioned documentation,

P) the declaration concerning the form referred to in art. 45, c. 2, of Legislative Decree no. 50/2016 with the-which one intends to participate in the contract (only for consortia).

For economic operators having their head office, residence or domicile in the countries included in the c.d. :

- declaration of being in possession of the validity authorization issued pursuant to the D.M. 14.12.2010 of the Ministry of Economy and Finance pursuant to Article 37 of Legislative Decree 78/2010, pursuant to Law 122/2010) or declaresr submitted an application for authorization pursuant to art. 1, paragraph 3 of the D.M. 14.12.2010 and attaches a certified copy of the request for authorization sent to the ministry.

For non-resident economic operators without a permanent establishment in ITALY:

- declaration to undertake to comply, in case of award, with the discipline referred to in the articles 17, paragraph 2, and 53, paragraph 3 of the Presidential Decree-633/1972 and to inform the administration of the appointment of its tax representative, in the form of law.
