The subject of the order is: Collection, transport and managementie municipal waste from property owners from the area of Kotla commune from 1/7/2019 to 30/06/2021.

The subject of the order is: Collection, transport and management of communal wastefrom the owners of the property from the Kotla Municipality in the period from 1/7/2019 to 30/06/2021.

The scope of the task includes:

a) collection, transport and management of municipal waste from owners of inhabited and uninhabited real estate from the area of Kotla Commune,

b ) collection and management of waste from publicly available points for selective collection of waste from metals and plastics with(c) establishment, operation and operation of the selective collection point for municipal waste for owners of inhabited and uninhabited real estates from the Kotla commune,

d) equipping the inhabited and uninhabited real estate with containers and containers for mixed waste as well as sacks and containers for selective waste collection municipalities in the quantities and locations describedin the description of the subject of the order, constituting Annex No. 1 to the Terms of Reference, - e) organizing and carrying out once a year waste collection of large-size and used tires in the commune,

f) washing, disinfection and disinfestation of containers and waste containers twice a year . Pickup and disposal of waste should be carried out in a manner that ensures the achievement of appropriate levels of recyclesngu, preparation for reuse and recovery by other methods and limitation of the mass of biodegradable municipal waste sent for storage in particular, in accordance with the Act of 13.9.1996 on maintaining cleanliness and order in communes (Journal of Laws of 2018 item 1454 with amendments.), With the provisions of the Resolution No. XLIII / 1450/17 of the Lower Silesia Voivodship Council of 21/12/2017 on uchwalenia Wojewodzkiego Waste Management Plan for the Lower Silesian Voivodship 2016-2022, provisions of the Act of 14.12.2012 on waste (ie OJ of 2018, item 992 as amended) and the provisions of the Regulations for maintaining cleanliness and order in the commune Kotla valid during the term of the contract.

The detailed description of the subject of the order is contained in Annex 1 to the ToR.

Possession of competence or uprato the pursuit of a specific professional activity, if it results from separate regulations - the Ordering Party considers the condition referred to in Art. 22 par. 1 b point 1 of the Public Procurement Law, regarding the possession of entitlements to conduct a specific professional activity, if it results from separate regulations, if the contractor will have: - a current entry in the register of regulated activity, in accordance withArt. 9b (2) of the Act on Maintaining Cleanliness and Order in Communes (No. 2018, item 1454),

- current entry in the register referred to in art. 49 par. 1 of the Act of 14.12.2012 on waste (Journal of Laws of 2018, item 992, as amended). Economic or financial situation: - The Contractor must prove that he has funds or creditworthiness at least PLN 500, 000.00 (in words: five hundred thousandęcy PLN 00/100), issued not earlier than one month before the deadline for submitting bids.

The Contractor must be insured against civil liability in respect of conducted activities related to the subject of the order, for an amount not less than PLN 500, 000.00 (in words: five hundred thousand PLN 00/100)

1. Form and manner of preparing the offer

1.1. The offer should be submitted according to the offer form fromusing the template Annex No. 2 to the ToR.

1.2. The offer should be prepared in accordance with the requirements of the ToR.

1.3. Each Contractor may submit only one offer.

1.4. The offer is made under pain of nullity, in electronic form via the portal miniPortal and ePuap.

2. Documents making up the offer:

- Offer form, according to the formula specified in Annex 2 to the Terms of Reference,

- documents and quotesand confirmations that the Contractor meets the conditions for participation in the Proceedings and there are no grounds for exclusion (listed in chapter XII of the ToR),

- confirmation of payment of the bid security in the form specified in chapter XVIII of the ToR.

The content of the offer must correspond to the content of the relevant terms.

3. The offer with attachments should be signed using a qualified electronic onesignature by authorized / authorized or authorized representative / representatives of the Contractor, in accordance with the rules of representation specified in the relevant register (in particular, the National Court Register or the Central Register and Information on Economic Activity).

4. In the case when the offer is signed by the Contractor's representative, along with the offer, the plenipotentiary must be submittedand for that person defining its scope. The power of attorney should be signed by persons authorized to represent the Contractor.

5. Contractors acting jointly (eg in the form of a consortium, civil partnership or other agreement regulating their cooperation in order to obtain a contract) must appoint a representative to represent them in the procedure for the award of the contract or representedand in the procedure and conclusion of the public procurement contract. The document confirming the appointment of the proxy should be signed by all contractors applying jointly for a public order. Signatures must be submitted by persons authorized to make declarations of will on behalf of contractors. All correspondence and settlements will be made only with the entityem acting as a proxy. If the offer of contractors appearing jointly is selected, the contracting authority will demand prior to the conclusion of the public procurement contract, the contract governing the cooperation of these contractors. All power of attorney should be attached to the offer in the form of an original (qualified electronic signature) or a notarized certified copy of the power of attorney (electronice certificate confirming the conformity of the copy with the presented document, bearing a qualified electronic signature).

7. All costs related to the preparation and submission of the offer shall be borne by the Contractor, regardless of the outcome of the tendering procedure.

8. The offer and attachments should be submitted in the manner described in chapter XV of the SETC - 9. The Contractor may introduce changes, corrections, modifications and additions to zoffers provided that the Purchaser receives notification of changes, corrections, etc. before the deadline for submission of tenders to the ePUAP mailbox. Notification about the introduction of changes must be submitted in accordance with the same rules as the offer submitted, ie marked appropriately with the note "Change".

11 The contractor has the right to withdraw from the tender by the deadline before the deadline for submission of tenders.placing notifications on the ePUAP mailbox (according to the same rules as introducing changes and corrections) with the inscription on the "Recall" envelope.

12 The Contracting Authority informs that in accordance with Article 8 and Article 96 paragraph 3 of the Public Procurement Act, offers submitted in Proceedings for public procurement are public and subject to disclosure from the moment they are opened, with the exception of information constituting a trade secretiorstwa within the meaning of the provisions on combating unfair competition, if the Contractor, not later than the deadline for the submission of bids, stipulated that they can not be made available.
