The subject of the order is the collection and management of municipal waste from owners of real estate inhabited by the Wałcz Commune and property equipment in containers and sacks to collect waste. Detailed descriptionthe subject of the orders is included in Annex No. 6 to SWIZ.

The subject of the order is the collection and management of municipal waste from owners of real estate inhabited by the Wałcz Commune and the furnishing of real estate with containers and sacks to collect waste. A detailed description of the subject of the order is included in attachment No. 6 to SWIZ.

The detailed subject of the order oit includes, among others:

1) equipping the real estate with waste containers mixed in and bags for selective waste collection and containers for mixed and segregated waste,

2) receiving from property owners all collected waste;

3) receiving municipal waste from municipal cemeteries (in Chwiram, Dębołęka, Dobino, Dzikowo, Gol-w, Gostomia, Karsibor, Kłębowiec, Lubno, Nakielno, Rudki, Rutwica, Rożewo, Strączno, Witankowo, Zdbice) and dayrooms (in Golce, Świętosław, Rudki, Karsibor, Kłębowiec, Dzikowo, Chwiram, Przybkowo, Sweden, Nakielno and Dobino) from the area of the commune;

4) reporting in accordance with applicable regulations;

5) development of selectively collected municipal waste collected from the owners of the propertyrecovery and neutralization of waste, in accordance with the waste management hierarchy, referred to in Article 7 of the Act of 14.12.2012 on waste,

6) management of waste with maintenance of recovery or disposal indicators of municipal waste collected, in accordance with the Waste Act and the Act on Maintaining Cleanliness and Order in Municipalities in Receiving Municipal Waste from the Owner7) transfer to management of mixed waste, green waste and residues from the sorting of municipal waste for storage, to the Regional Municipal Waste Treatment Plant (RIPOK) designated for the Wałcz Commune, in accordance with the Annex to Resolution No. XVI / 218/12 of the Provincial Parliament Zachodniopomorskie from 29.6.2012 Waste Management Plan forWest Pomeranian Voivodeship for the years 2012-2017 including the perspective for 2018-2023 for the Szczecinek Region (RIPOK Mirosławiec);

8) in the event of a RIPOK failure or in other cases referred to in art. 38 par. 2 point 2 of the Act of 14.12.2012 on waste, making it impossible to receive mixed municipal waste or green waste, this waste should berefer to installations intended for substitute service for the Region, indicated in the resolution on the implementation of the voivodship waste management plan.

1. A contractor who can not be excluded from the proceedings in the circumstances referred to in: - 1) art. 24 sec. 1 point 12) 23) of the Act,

2) art. 24 sec. 5 points 1), 2), 4) of the Act; exclusion on this basisega contractor:

a) in relation to which the liquidation has been opened, in the system approved by the court in the restructuring proceedings, the creditors are expected to satisfy their creditors or the court ordered the liquidation of its assets pursuant to art. 332 par. 1 of the Act of 15.5.2015. Restructuring law (Journal of Laws of 2017, item 1508) or whose bankruptcy was announced, except forthe offender who, after the bankruptcy, has concluded an agreement approved by a final court order, if the arrangement does not provide for satisfying creditors by liquidating the assets of the bankrupt, unless the court ordered the liquidation of his property pursuant to art. 366 para. 1 of the Act of 28.2.2003 Bankruptcy Law (Journal of Laws from 2016, item 2171 with amendments),

b) who in a manner of culpability seriously violated professional dutiese, which undermines its integrity, in particular when the contractor failed to perform or improperly performed the order as a result of intentional action or gross negligence, which the contracting authority is able to demonstrate by means of appropriate evidence, c) who, for reasons attributable to him, do not performed or improperly performed a prior public procurement contractor a concession contract, concluded with the ordering party referred to in art. 3 par. 1 point 1 4 of the Act, which led to the termination of the contract or award damages;

The contracting authority requires the Contractor to be insured against civil liability in respect of the business related to the subject of the contract for the minimum amountPLN 1 000 000.00. The Contractor may, in order to confirm the fulfillment of the condition of participation in the proceedings in relevant situations and in relation to the subject order, rely on technical or professional abilities or financial or economic situation of other entities, regardless of the legal nature of the legal relations that it has with him. it depends on abilities or syother entities is obliged to prove to the awarding entity that while fulfilling the order, it will have the necessary resources of these entities, in particular by presenting the obligation of these entities to put at the disposal of the necessary resources to fulfill the order.

1) range of available contractors of other resourcesego entity,

2) manner of using the resources of another entity, by the contractor, while executing the order,

3) scope and period of participation of another entity when executing the order,

4) whether the entity, on the capacities of which the contractor relies with respect to the conditions of participation in the proceedings concerning education, professional qualifications or experience, will carry out construction works or services whichthe abovementioned abilities apply.

This written undertaking should be attached to the offer. The Contracting Authority will assess whether the technical or professional capacity or economic or financial situation made available to the contractors by other entities, allow the contractor to demonstrate compliance with the conditions for participation in the procedure and will examine whether the entity is subject to the exclusion grounds referred toin art 24 mouths 1 point 13-23 and para. 5.

If the technical or professional capacity or economic or financial situation of another entity does not confirm that the contractor meets the conditions for participation in the proceedings or is subject to exclusion, the ordering party requests that the contractor, on the date specified by the contracting authority: - - replace the entity with another entity or entities, lub

- committed to the personal implementation of the relevant part of the order, if it shows technical or professional capacity or financial or economic situation to confirm compliance with the conditions for participation in the proceedings and no grounds for exclusion.

The contracting authority may, at any stage of the proceedings, consider that the contractor has the required capabilities if the involvement of technical resourcesor contractors in other economic ventures of the contractor may have a negative impact on the implementation of the order.

In the case of contractors jointly applying for the award of orders:

a) no contractor may be subject to exclusion from the proceedings under Art. 24 of the Public Procurement Law, b) the conditions set out in point 2 sub-items 1-3 must meet at least one of the contractors or everyone will performinclusive.

Conditions for the participation of foreign contractors are specified in point V of the Terms of Reference. 1. The Contractor submits the offer via the Form to submit, change, withdraw the offer or application available on ePUAP and also made available on the miniPortal. The public key necessary to encode the offer by the Contractor is available to contractors on the miniPortal. In the offer / application form, the Contractoris obliged to provide the ePUAP mailbox address, on which correspondence related to the proceedings will be kept. 2. The Contractor intending to take part in the public procurement procedure must have an ePUAP account. The contractor holding an account on ePUAP has access to the following forms: submission, modification, withdrawal of the offer or application and to the form for communication.3. The offer should be froma secured bond in the amount of PLN 50, 000.00 (in words: fifty thousand zlotys) information about the bid bond was included in point IX of the SIWZ4. In order to confirm the lack of grounds for exclusion due to non-fulfillment of the conditions referred to in art. 24 sec. 1 of the Public Procurement Law, the contracting authority requires submission of a n. documents:

a) Information from the National Criminal Record in the scope specified in art. 24 ust. 1 points 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids,

b) Certificates of the competent head of the tax office confirming that the contractor is not in arrears with tax payment, issued not earlier than 3 months before the expiry of the deadline for the submission of bids or other document confirming that the contractor has concluded an agreement with the competenta tax authority regarding the repayment of such receivables together with any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension in full of the decision of the competent authority, c) Certificates of the relevant organizational unit of the Social Insurance Institution or the Funds Agricultural Insurance Spor a document confirming that the contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of these receivables together with possible interest or fines, in particularand obtained legally required exemption, postponement or installment payment of overdue payments or suspension in full of the decision of the competent authority, d) Write-off from the relevant register or central records and business information, if separate regulations require entry in the register or records in order to confirmation of the lack of grounds for exclusion pursuant to art. 24 sec. 5 pkt 1 of the Public Procurement Law,

e) Statements about the affiliation or lack of belonging to the same capital group, referred to in art. 24 sec. 1 point 23 of the Public Procurement Law Act in accordance with Attachment No. 4 to the ToR.

Contractor within 3 days from the date of posting on the internet website information referred to in art. 86 par. 3 of the Public Procurement Law, will provide the orderer with a declaration of belonging or non-membership in thisthe capital group itself, referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. With the submission of a statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure. The Contracting Authority informs that according to art. 24aa of the PZP Act, will first evaluate the offers and then examine whether the contractor, whose offer has been assessed as the most advantageous, it is not subject to exclusion and whether the contractor meets the conditions for participation in the proceedings. If the contractor referred to in the first sentence avoids concluding the contract or fails to provide the required performance bond, the contractor will investigate whether the contractor who has placed the highest rated of the other offers is not excludediu and whether it meets the conditions for participation in post.
