The scope of the order includes:

a. Receiving municipal waste generated in the area of Barlinek Commune from property owners, where residents live (single-family and multi-family buildings) as well as uninhabited real estate and their transport to development sites.

B. Development of received municipal waste from owners of inhabited properties-and uninhabited from the area of Barlinek commune.

c. Organization and operation of at least one stationary Point of Selective Collection of Municipal Waste (PSZOK), in the city of Barlinek.

D. Organization and running a Customer Service Office (BOK), which means a point located in the city of Barlinek, in which the employee trained by the Contractor by telephone, e-mail orBy direct contact with the client, he will provide information about the services provided by the Contractor. The amount of the bid bond. A) Each Contractor is obliged to secure his offer with a bid bond in the amount of: PLN 90, 000.00 in words: ninety thousand and PLN 00/100 - 2. Form of bid bond. A) The bid bond may be contributed in the following forms:

i. money,

ii. bank guarantees or suretiesan associative savings and credit union, however, the surety is always a cash guarantee,

iii. bank guarantees,

iv. insurance guarantees,

v. sureties granted by entities referred to in art. 6b par. 5 point 2 of the Act of 9.11.2000 on the establishment of the Polish Agency for Enterprise Development [i.e. of 29/02/2016 (Journal of Laws of 2016, item 359 with laterzm.)].

b) The bid bond may be lodged in one or several forms: c) In the event of the Contractor submitting a bid bond in the form of a bank or insurance guarantee, the guarantee shall at least be: unconditional, non-transferable, irrevocable and payable at first written demand of the Ordering Party. The guarantee is to be prepared in accordance with the applicable law and should contain the following elements: - and. name givingit is the order (Contractor), the beneficiary of the guarantee (Ordering Party), the guarantor (bank or insurance institution providing the guarantee) and the indication of their registered office,

ii. designation of conduct,

iii. determining the subject of the proceedings - iv. specification of the claim to be guaranteed,

v. the amount of the guarantee,

vi. the validity period of the guarantee,

vii. obligation on the guarantor to pay the amountsy guarantees for the first written request of the Ordering Party in situations described in art. 46 ust. 4a and para. 5 PPL.

Provisions of Chapter XII, point 2 lit. c) The ToR shall be applied accordingly to the bid security paid in the form of sureties.

3. Place and manner of payment of bid bond. A) Bid bond paid in cash should be paid to the following account of the Employer:

Commercial Social Bank, Account No .: 18 8355 0009 0000 0387 2000 0013 until 19.11.2018 by 10:00 am with the annotation: "Wadium Odpady 2019"

The offer must be accompanied by a copy of the transfer order. B) Bid bond paid in other forms accepted by the Contracting Party should be attached in the original to the offer placed at the Employer's office by November 19, 2018 at 10:00 am, the Office of Customer Service.

4. Deadline for payment of the bid bond.

a) The bid bond should be-submit before the deadline for the submission of bids, whereby the deposit in cash using a bank transfer Ordering will be considered effective only when the bank keeping the account of the Employer confirms that he received such a transfer before the deadline for submission of b b b). the offer of a copy of the transfer order issued by the Contractor is a warrantnecessary, but not sufficient to determine by the Employer timely payment of the bid bond by the Contractor.

5. Reimbursement of the bid bond.

A) The ordering party will return the bid bond to all contractors immediately after the selection of the most advantageous offer or cancellation of the proceedings, with the exception of the contractor whose tender has been selected as the most advantageous, subject to the circumstances indicated in art. 46-paragraph. 4a Public Procurement Laws. B) Contractors whose tender has been selected as the most advantageous, the contracting party returns the deposit immediately after concluding the public procurement contract and paying the performance bond, if the demand was made. C) The Customer immediately returns the bid bond at the request of the contractor, who withdrew the offer before the expiration of the deadlineia offers.

6. Loss of bid bond. A) the Ordering Party seizes the bid bond with interest, if the Contractor in response to the call referred to in art. 26 par. 3 and 3a PZP, for reasons attributable to him, did not submit declarations or documents confirming the circumstances referred to in art. 25 ust. 1 PPL, a statement referred to in art. 25a para. 1, powers of attorney or did not agree to correcte of the mistakes referred to in art. 87 par. 2 points 3 PPL, which resulted in the lack of possibility to choose the offer submitted by the contractor as the most advantageous. B) The Contracting Authority shall retain the bid bond with interest, if the Contractor whose offer has been selected:

i. refused to sign a public order contract on terms specified in the offer,

ii. did not make the required collateralperformance of the contract,

iii. conclusion of a public procurement contract was impossible due to reasons attributable to the Contractor.

7. In the event that the deposit has not been brought or has been filed incorrectly, the Ordering Party shall reject the offer in accordance with the provisions of art. 89 paragraph 1 point 7b PZP.

The Ordering Party will consider this condition fulfilled if the Contractor shows that: - and. has a certificate offrom the register of regulated activities (maintained by the Mayor of Barlinek) regarding the collection of municipal waste from property owners from the area of the Barlinek commune, including waste with codes: 20 03 01, 20 01 02, 15 01 07, 20 01 01, 15 01 01, 15 01 06, 15 01 02, 20 01 39, 20 01 40, 20 01 19, 20 01 27, 20 01 28, 20 02 01, 20 03 07, 20 01 23, 20 01 35 and 20 01 36, 20 01 32, 16 01 03, 2001 34, ex20 01 99;

ii. has a valid permit of the competent authority for the transport of waste including waste with codes: 20 03 01, 20 01 02, 15 01 07, 20 01 01, 15 01 01, 15 01 06, 15 01 02, 20 01 39, 20 01 40, 20 01 19, 20 01 27, 20 01 28, 20 02 01, 20 03 07, 20 01 23, 20 01 35 and 20 01 36, 20 01 32, 16 01 03, 20 01 34, ex 20 01 99; unless the Contractor demonstrates that he is exempt from the obligation to obtain frompermit to conduct this activity or demonstrate that the transport of waste classified under the abovementioned codes does not require the Contractor to have the above authorization;

iii. has a current entry in the register collecting used electrical and electronic equipment kept by the Chief Inspector of Environmental Protection
