Personnel recruitment services for the selection of members of the boards of directors (CAs) / supervisory boards (CSs) at the companywith the full or majority state capital, which is under the authority of the Ministry of Public Finance (MAF), as follows:

1) Completion of the DUAE and Form no. 1 whichconfirms that the economic operator is not in any of the exclusion situations referred to in art. 59 60 of the Law no. 98 / 2016. The way in which pthe fulfillment of the requirement will be demonstrated: it will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE will be requested by the contracting authority only to the first ranked bidder in the interim rankingthe award criterion, according to the provisions of art. 132 par. (2) of the rules.

These documents may be:

- Fiscal attestation certificates regarding the lack of outstanding debts, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of presentation, The criminal record of the economic operator and each member of the amanagement or supervision of the respective economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, - - Where appropriate, documents by which it is demonstrated that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016,

- Other editorial documents, as appropriate.

Foreign economic operators will submit documents in accordance with the provisions of art. 168 par. (3) of the Law no. 98 / 2016.

The contracting authority requires that economic operators submitting a tender to prove a registration in accordance with the law of the country of residence, showing that the economic operatoris legally constituted, is not in any of the situations of cancellation of establishment, and that it has the professional capacity to carry out the activities covered by the framework agreement.

The manner by which the fulfillment of the requirement can be demonstrated: the DUAE to the economic operators participating in the award procedure with information related to their situation. Dothe supporting documents proving the fulfillment of the obligations assumed by the DUAE, respectively the certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence shall be submitted at the request of the contracting authority only by the tenderer ranked first in the ranking drawn up following the application of the award criterion, according to the provisions of art. 132 par. (2) of the rules

The contracting authority requests the submission of the certificate issued by the National Trade Register Office stating that the object of the contract has a correspondent in the CAEN code - For foreign legal / physical persons: documents proving a form of registration / attestation or [...] details on www.e-licitatie.ro

1) If two or more offers rank first in the ranking (obtained the same score), the contracting authority will designate the winner with the lowest price; 2) How to make the contractual changes. The contracting authority will allow modification / adaptation of the contractual provisions in the event of the occurrence of some legislative changes having impact asthe agreement / framework contract / subsequent contract and if the changes / adaptations are minor and do not change the economic equilibrium of the framework agreement / subsequent contract in favor of the contractor.

The contracting parties are entitled, during the fulfillment of the subsequent contract, to agree modifying and / or completing its clauses, without organizing a new procedureassignment, with the agreement of the parties, without affecting the general character of the contract, within the limits provided by art. 221 and art. 222 of the Law no. 98/2016, corroborated with the provisions of art. 164 and art. 165 of the norms.

Non-material changes are the only changes to the subsequent contract that can be made without the organization of a new award procedure.u must in no way and in any way affect the outcome of the award procedure by canceling or diminishing the competitive advantage on the basis of which the service provider has been declared winner in the award procedure.
