For Romanian legal / natural persons:

-they fail to comply with the provisions of art. 177, 178, 179, 180 of Law 99/2016 of tenderers, associates, subcontractors, third-party supporters. Form III.2.1.a.1 - III.2.a.3, - the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those having the power of representation, byforeign control or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act; - To be able to open the SEAP documents, install the shellSAFE Verify application at: http://www.certsign.ro/certsign/resurse / download-award procedure fully deployed by meelectronic jokes, in accordance with art. 67 of the H.G. 394/2016, op. ec. has the obligation to submit in the SEAP the tender, the requested forms and the DUAE, Parts I, II and III, only in electronic format and only until the deadline and deadline for submitting the offers stipulated in the simplified participation notice. - The economic operators (bidders / associates / subcontractors / third parties) are informed of the obligation to file the first, second and third part of the DUAE with the offer, subject to the rejection of the latter as unacceptable according to art. 143 par. (2) lit. b) from H.G. no. 394/2016,

- The supporting documents proving the fulfillment of the assumed by the DUAE, will be presented at the request of the co-(the term shall not be less than 3 working days), only by the first ranked tenderer (including by associates / subcontractors / third parties) in the intermediate rankings completed at the evaluation of the tenders, after applying the award criterion to the admissible tenders, with reference to the part (s) of the contract they are actually to meet,

- Ethe contracting entity may require tenderers to submit all or some of the supporting documents as evidence of the information contained in the DUAE at any time during the conduct of an award procedure if this is necessary to ensure the proper conduct of the procedure - 205 para. (1) of the Law no. 99/2016,

- According to art. 22 par. (7)of H.G. 394/2016, if there are discrepancies between the information provided in the DUAE and those provided in the acquisition data sheet, the information in the data sheet prevails, the DUAE will be revised accordingly, - the Tenders uploaded in SEAP after the date and time limit the submission of the tenders mentioned in the simplified participation notice will be rejected, - Will be submitted, together with the DUAE and-the requested documents.
