1. The subject of the order jest "Purchase and delivery of printers, scanners and audiovisual equipment to the practical training workshop at AP in Słupsk" as part of the project "Development of a practical education system within the Słupsk Academic Center (SOA)".

1. The Contractor joining the tender is obliged to pay a bid bond in the amount of:

2. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 sec. 1 point 12-23 of the P actof public procurement. In addition, the Employer will exclude from the participation in the proceedings the Contractor who meets the optional exclusion conditions of the proceedings, indicated in art. 24 sec. 5 points 1 and 8 Public Procurement Law.

3. The Contractor shall attach to the offer a valid statement valid as at the date of the submission of bids confirming that the contractor is not subject to exclusion. The declaration should be submitted inthe form of a single ESPD document (EAT). A single document pre-prepared by the Employer for the subject proceedings (Annex 3 to the Terms of Reference), was made available on the Employer's website at the place where the SIWZ was placed. EAT should be submitted in the form of an electronic document signed with a qualified electronic signature.

4. The contracting party foresees the possibilityuse the provisions of paragraph 24aa of the Public Procurement Law and conduct proceedings in the reversed procedure.

5. According to art. 26 par. 1 of the Public Procurement Law, before ordering, it will call the Contractor whose offer has been rated the most, to submit within the prescribed period, not shorter than 10 days, valid as of the day of submitting statements and documents confirming no grounds for exclusiona and fulfillment of the requirements specified by the Ordering Party, as indicated in points 10.3. to 10.4. SIWZ, subject to point 10.6 .-. 10.8. the Terms of Reference (list of documents and statements contained in Section VII.2) rectification - "Other additional information."

6. Within three days from the date enlisted by the Purchaser on the website about the opening of the tenders referred to in Art. 86 paragraph. 5 of the Public Procurement Law, the Contractor is obliged to provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 item 23 of Public Procurement Law

7. The ordering party in accordance with art. 144 of the Public Procurement Law, provided for the possibility of introducing significant changes to the content of the concluded contract to the extent specified in point 23.4. Terms of Reference.

8. The offer consists of the followingDocuments:

8.1. The offer form prepared in accordance with the model constituting Annex No. 1 to the ToR,

8.2. The price form prepared in accordance with the formula constituting Annexes 2.1., 2.2., (...) or 2.7. to SIWZ, depending on the part number, for the implementation of which the Contractor submits his offer;

8.3. a single document statement (EAT) prepared in accordance with point 10.1 SIWZ;

8.4. in caseto act on behalf of the Contractor by proxy, attach to the offer a power of attorney in electronic form signed with an electronic qualified signature;

8.5. power of attorney to represent Contractors jointly applying for the implementation of the order, in accordance with 11.2. Terms of Reference;

8.6. proof of payment of a bid bond.

9. The Contractor submits the offer via the Form to submit and withdraw the offeravailable on the PUAP and also available on the miniPortal.

10. In point 2A of the ToR contains information regarding the processing of personal data, in accordance with art. 13 para. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of the Directive95/46 / WE (RODO). The content of the statement required from the contractor to fulfill the information obligations provided for in Article 13 or art. 14 RODO was introduced to the Offer Form (attachment 1 to the ToR).

11. The ordering party, before granting the order, will call the Contractor, whose offer was the highest rated to submit in the day, valid for a day not shorter than 10 days, valid for the dayconfirm statements and documents confirming that there are no grounds for exclusion:

11.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids or requests to participate in the proceedings;

11.2. certificate of the competent head of the tax office confirmingthat the contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding the repayment of these receivables with possible - interest or fines, in particular obtained predictionsthe right to release, defer or split into installments of overdue payments or suspend in full the implementation of the decision of the competent authority;

11.3. a certificate of the relevant local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the contractor is not in arrears with payment of social security contributions orhealth, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or other document confirming that the contractor has concluded an agreement with the competent authority regarding the repayment of these receivables with any interest or fines, in particular obtained the exemption, deferral or distribution provided for by lawe in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

11.4. excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the PPL;

11.5. Contractor's statement about the lack of editionsa final court decision or a final administrative decision on default of taxes, fees or social or health insurance premiums, or - in the event of such a verdict or decision - documents confirming the payment of such claims together with any interest or fines or the conclusion of a binding agreement regarding the repayment of thesereceivables (the template is Annex 6 to the ToR);

11.6. the Contractor's statement about the lack of a decision against him as a preventive measure of the prohibition against applying for public orders (the template is attached as Appendix 7 to the Terms of Reference);

11.7. the contractor's statements about not paying taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and fees (exemplary statusthese Annex 8 to the ToR).

12. In order to confirm that the equipment offered meets the requirements of the Ordering Party specified in the SIWZ and Annex No. 5.1 to 5.7 to the Terms of Reference, the contractor, whose offer will be the highest rated in a given part, will be summoned, in no shorter than 10 days, to submit a technical description offered product.

The description should be prepared with fineness andaccording to the scope of information specified in Annex No. 5.1 to 5.7 to the ToR (it will be sufficient to submit the completed and signed Annex 5.1.-5.7 to the ToR).
