Purchase and delivery of 18F-FDG radiopharmaceutical for PET-CT Laboratory at ul. Władysława Truchana 7 in Chorz-w

The subject of this order is the delivery of radiopharmaceutical 18F-FDG for the Municipal Hospital Complex in Chorz-w in the quantity and description specified in the assortment and price specification (hereinafter: SAC) constituting Annex 2 to the ninof this ToR with detailed parameters described in point 3.6 SIWZ and - 3 significant contractual provisions (Annex 6 to the SIWZ).

Main Site: SP ZOZ Municipal Hospital Complex PET warehouse of the Diagnostic Imaging and Isotope Laboratory, ul. Władysława Truchana 7, 41-500 Chorzow, POLAND

Delivery of radiopharmaceutical-18-FDG. 1 assortment item.

The contractor submitting the offer in this part of the order zis obliged to secure a tender deposit in the amount of PLN 54, 000.00. Forms of paying the bid bond are described in section 7 of the ToR. When selecting and evaluating the offer, the Employer will be guided only by the following criteria: price of the offer 100%

List of declarations or documents confirming compliance with the conditions for participation in the procedure (Article 25 (1) point 1 of the PPO):

a) valid as at the date of submission of the offera declaration of compliance with the conditions for participation in the procedure in the form of a single European order document (hereinafter: EAT) in the scope indicated in Annex 4 to the ToR attach to the offer in electronic form in accordance with point 9.6. SIWZ.

B) concession or permit to operate a pharmaceutical warehouse, which under the applicable law in the Republic of Poland entitle the Contractorto trade in medicinal products or a permit for the production of the offered product issued by the Chief Pharmaceutical Inspector valid on the day of submitting bids, if the contractor is the manufacturer, which entitles the contractor to trade in medicinal products in accordance with art. 42 section 1 point 1 a lit. b in connection from art. Z2 points 42 and 43 of the Act of 6 September 2001 - Farm Lawceutical (i.e. Journal of Laws of 2019, item 499, as amended), and in the case of Contractors having their place of residence or seat abroad, a document or documents authorizing the marketing of medicinal products issued in the country in which the Contractor has his place of residence or seat.

c ) permission to manufacture, turnover of the offered product issued by the President of the National Atomic Energy Agency in accordance with the Actof November 29, 2000, the Atomic Law (i.e. in which the contractor has his place of residence or registered office

d) marketing authorization of the offered productmedicinal product issued by the President of the Registration of Medicinal Products, Medical Devices and Biocidal Products, the offered medicinal product must be authorized on the territory of Poland in accordance with the provisions of the Pharmaceutical Law of September 6, 2001 in force in this regard.

Contractors who meet the conditions for participation in the progressconcerning:

a) competence or entitlements to conduct specific professional activities, provided that it results from separate provisions, i.e. the condition understood as:

- possession of a license or permission to operate a pharmaceutical warehouse, which under the applicable law in the Republic of Poland entitle the Contractor to trading in medicinal products or valid as at the date of submissionoffers having a permit for the production of the offered product issued by the Chief Pharmaceutical Inspector in the event that the contractor is the manufacturer, which entitles the contractor to trade in medicinal products in accordance with art. 42 section 1 point 1 a lit. b in connection from art. Z2 points 42 and 43 of the Act of 6 September 2001 - Pharmaceutical Law, and in the case of Contractors residingia or registered office abroad possession of a document or documents authorizing the marketing of medicinal products issued in the country in which the Contractor is domiciled or established,

- possession of a manufacturing permit, marketing of the offered product issued by the President of the National Atomic Energy Agency in accordance with the Act of November 29, 2000 r. Atomic Law, and in the case of Contractors havingplace of residence or registered office abroad possession of a document or documents authorizing to conduct activities related to manufacturing, trading 18-FDG issued in the country in which the Contractor has his place of residence or seat

- possession of a marketing authorization for the offered medicinal product issued by the President of the Registration of Medicinal Products, Medical Deviceand biocidal Products, the offered medicinal product must be authorized on the Polish territory in accordance with the provisions of the Pharmaceutical Law of September 6, 2001 applicable

the Purchaser does not require.

cd III 1.1:

b) economic or financial situation - Employer does not set a condition.

C) technical or professional capacity - Employer does not set a condition.

In the case of Contractors jointly applying for the award of the contract:

- Contractors must jointly meet the conditions set out in point 4 subject to the remark below,

- In the case of the condition specified in item a) above, it will be met if at least one of the Contractors jointly applying for the award of the contract has the abovementioned competences / powers. The performer who in rathe concluded consortium demonstrates the possession of relevant competencies / entitlements, it must carry out itself, the part of the contract involving the obligation to have the required qualifications,

- each of the Contractors is obliged to demonstrate the lack of grounds for exclusion in the circumstances referred to in art. 24 UPZP. 5.2. List of statements or documents confirming no grounds for exclusionia (Article 25 (1) point 3 of the Act):

a) a statement as to the date of submission of tenders about the lack of grounds for exclusion in the form of EAT in the scope indicated in Annex 4 to the ToR attach to the offer in electronic form in accordance with point 9.6. SIWZ.

B) information from the National Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 and art. 24 paragraph 5 points 5 and 6 of the Act, issued not earlierthan 6 months before the deadline for submission of bids,

c) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payment, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the Contractor has concluded an agreement with the competent authority tax on the repayment of these receivables together withinterest or fines, in particular, obtained the exemption, deferral or installment of overdue payments as provided for by law or withholding in full the decision of the competent authority - within the scope of Art. 24 paragraph 5 point 8 of PPO;

d) certificate of the appropriate organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fundor other document confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the Contractor has concluded an agreement with the competent authority regarding the repayment of these receivables together with possible interest or fines in particular obtainedexemption, deferral or installment of overdue payments provided for by law or withholding in full the execution of the decision of the competent authority - in the scope specified in art. 24 paragraph 5 point 8 of PPO;

e) an excerpt from the relevant register or from the central register and information on business activity, if separate provisions require an entry in the register or the register, in order to confirm the lack of groundsexclusions based on art. 24 paragraph 5 point 1 of the PPO,

f) the Contractor`s statement that he has not issued a final court judgment against him or a final administrative decision on late payment of taxes, fees or social security or health insurance contributions, or in the case of issuing such a judgment or decision of documents confirming the payment of these amounts along with anyinterest or fines or the conclusion of a binding agreement on the repayment of these claims within the scope of Art. 24 paragraph 1 point 15 of the Act on Public Procurement Law;

g) a statement of the Contractor about the lack of a decision against him as a preventive measure prohibiting him from applying for public contracts in the scope specified in art. 24 paragraph 1 point 22 of UPZP;

1.9. Information obligation arising from art. 13 GDPR for collectingto remove personal data directly from the natural person to whom the data relate, for the purpose related to the procedure for the award of a public contract. However, the information clause regarding the Contractor is included in point 13 of Annex 1 to the ToR, "Bid form".

GDPR - Regulationse of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) (Official Journal of the EU L 119 of 05/04/2016, p. 1). The contractor is obliged to familiarize all employees with the entrustment clausepersonal data, whose data will be provided to the Employer during and after the outcome of the proceedings.

Any information constituting a trade secret within the meaning of the Act of 16 April 1993 on combating unfair competition (i.e., Journal of Laws of 2019, item 1010, as amended). ), which the Contractor wants to reserve as a trade secret, should be submitted in a separate pfile together with the simultaneous selection of the command "Annex constituting the secret of the enterprise" and then once with files constituting the public part, compress into one archive file (ZIP). The files should be separately signed with a qualified electronic signature. According to the Act on combating unfair competition, i.e. 2019, item 1010, as amended) by the secret of the enterpriseundisclosed technical, technological, organizational enterprise information or other information of economic value on which the entrepreneur has taken necessary measures to maintain confidentiality shall be understood.

1.6. The maximum size of files sent via dedicated forms for: submitting, changing, withdrawing the offer and for the messageprice is 150 MB / 50 MB recommended /.

1.7. The date of submitting the offer, applications, notifications, electronic documents, statements or electronic copies of documents or statements and other information is the date of their submission to ePUAP.

1.8. The procedure identifier and public key for a given contract award procedure are available on the List of all procedures for a minimum ofiPortal and constitutes an attachment to this ToR.

10.2. The date and time of receipt of the Purchaser`s ePUAP account decides about the date of submission of the offer.

10.3. In order to change the offer, the Contractor will send a form with information about the change of the offer via a dedicated form to submit, change or withdraw the offer. The contractor will submit a new, amended, encrypted offer atby once again completing the form to submit, amend or withdraw the offer.

10.4. The Contractor may withdraw the offer before the deadline for submission of offers by using the form on the ePurchase miniPortal. In order to withdraw an offer, the Contractor shall send a form with information about the withdrawal of the offer via a dedicated form to submit, change or withdraw the offer. Provede all the user enters the ID of the offer, which he received to the email address when submitting the offer. The next step is entering the recipient`s details. Then the user adds a statement which confirms the contractor`s will to withdraw the offer together with a document confirming the authorization of the person signing the statement to change the offer on behalf of the contractor.
