Supply of radiopharmaceuticals according to the specification. Note: The Contracting Authority will respond clearly and completely to all clarification requests / additional information on the 10th day before the deadline for submitting bids. Number of days until whichClarifications can be requested before the closing date for submission of tenders / applications: 20 days.

Cerinţa nr. 4 - Compliance with the obligations to pay to the consolidated state budget. The economic operator (leader, associate, third party) will fill in the appropriate requirement in the DUAE form in the awarding documentation. In order to confirm the declared in the DUAE, only bidders will be required(including by the affiliate bidder of the auction winner or the supporting third party, as the case may be) submitting until the date of conclusion of the report of the award procedure of the following documents: - a certificate of tax attestation for legal persons concerning the payment obligations to the consolidated state budget in original or a certain copyon his own responsibility for compliance with the original, document showing that the tenderer has no overdue debts at the time of submitting this certificate. As the contracting authority will sign the framework agreement only with the ecomomic operators placed in the 1st, 2nd, 3rd, as the case, the way of the distribution of bids with equal prices will be as follows:

1) If the commission finds that more than 2 admissible tenders have been submitted / entered in SEAPwith equal prices to the 1st rank bidders, the authority considers that the contracting authority will sign the framework agreement only with the ecomomic operators placed in the 1st, 2nd and 3rd place, as the case may be, the way of bidding equal prices will be as follows:

1) If the commission finds that more than 2 admissible tenders with equal prices to the tenderers have been submitted / introduced in SEAPthe contracting authority will send through SEAP a request for clarification regarding the submission of new improved financial proposals (with 2 decimal places) and the economic operators will send their answer using the facilities offered by SEAP, in which case the contract will be awarded the first 3 bidders with the lowest price. In the case of equality and after s(2) If the commission finds that more than two admissible tenders have been submitted with equal prices by the tenderers on the list, the bidding procedure for the respective lot is canceled; the second place, the way of their classification will be made by requesting, in SEAP, a new proposal(2 decimal places) and the economic operators will send their response using the facilities offered by SEAP so that the bidder ranked first will not be affected, ie the new financial proposal will not be equal to or lower than the ranked I If the new improved financial proposal submitted to the SEAP as a result of the conthe tractants received through will influence the rankings of the higher places, this will not be taken into account, keeping the initial offer submitted to the SEAP, to the procedure; 3) If the commission finds that more than 2 admissible offers have been submitted with prices equal by the third-placed bidders, the way they will be awarded will be by requesting in SEAP, a new proposal(2 decimal places) and the economic operators will send their answer using the facilities offered by SEAP, so that the first and second-placed bidders will not be affected, respectively the new financial proposal will not be equal or lower than the ranked offer I and II respectively. If the new improved financial proposal submitted in the SEE as a followerthe request of the contracting authority will influence the rankings of the first and second place, this will not be taken into account, keeping the initial offer submitted to the SEAP, to the procedure. Deadlines / dates for submission of new financial proposals will be communicated in the request submitted by the contracting authority. Without prejudice to the provisions of Law no. 182/2002 on informed protectionthe economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right insofar as objectively the disclosure of this information would prejudice the legitimate interests of the operatoreconomic, especially in terms of commercial secrecy and intellectual property. The contracting authority will conclude subsequent contracts with the first ranked economic operator until it declares its inability to supply the products or terminates the framework agreement with it.
