The bidders, the third parties and the subcontractors must not be foundin the situations provided for in art. 73, 177, 178, 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: The economic operators participating in the award procedure (including the associate / subcontractor / supporting party) will be filled in with the information related to their situation and will submit a declaration on their own responsibility regarding the non-compliance in situthe parties referred to in art. 73 of Law no. 99/2016, both signed with the extended electronic signature, valid.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented, at the request of the contracting entity, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the tender evaluation . These documents p(1) certified statements regarding the absence of overdue debts in respect of the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of the presentation, 2) documentary evidence from the Trade Registry

3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of Public Procurement Act 99/2016; 4) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision-making or control within the as it results from the certifying certificate issued by the ONRC / Act con behalf of the contracting entity:

By the deadline for submission of tenders, economic operators will only submit to the SEAP Form DUEA (filled in by link: https://ec.europa.eu/growth/tools-databases/espd/filter) of the awarding documentation and the declaration on its own responsibility for non-compliance with the situations referred to in art. 73 of Law no. 99/2016. The DUAE form will be submitted in SEAP signed with an extended, valid electronic signature.

Economic operators submitting a tender must prove a form of registrationin accordance with the law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities covered by the contract. Modality by which the fulfillment of the requirement can be demonstrated: DUAE will be completed by the economic operators partparticipants in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of the foreign tenderers, the equivalent documents issued in the country of residence shall be submitted at the request of the contracting entity only by the ranked tendererranked first in the mid-term ranking to complete the bid evaluation.

By the deadline for submitting bids, economic operators will only submit to the SEAP the DUAE form (completed by link: https://ec.europa.eu/growth/ tools-databases / espd / filter) from the [...] details on www.e-licitatie.ro.

(a) Any economic operator registered with SEAP has the right to-The economic operators have the obligation to submit the offer in electronic format and only by the deadline for submission of the offers. Documents to be transmitted by electronic means are subject to the legal provisions regarding electronic signature (Law 455/2001 on electronic signature),

(b) Requests for clarifications of potential bidders are-will exclusively address SEAP in the "Questions" section of the award procedure conducted by electronic means and the answers to all additional clarification requests / information will be published in SEAP in the "Documentation and Clarification" section of the tender notice, the contracting entity and will not respond to requests made by other meanscommunicated than that established in accordance with the provisions of art. 78 par. (1) of the Law no. 99/2016 for post-submission submissions. The evaluation committee will send the clarification requests on the submitted offers in the SEAP to the "Questions" section. The economic operators will submit the answers to the clarifications and any requested documents during the evaluationthe area of the tenders through SEAP (the "Questions" section), fully in the section corresponding to the respective request, in the form of one or more separate signed documents / files with an electronic signature.

If two or more bids are ranked first, with equal scores, the classification will be made taking into account the score obtained in the evaluation factors, in the orderit decreases their weights.- In the event that equality is maintained, the contracting entity will request through SEAP new financial proposals and the winning bid will be designated with the lowest financial proposal.
