Framework agreement for the supply of electricity / natural gas, including transport and distribution to the place of consumption

Supply, transport and distribution of electricity and natural gas for a single point of consumption (BCU "Carol I", Central Unit):

Main Site: 1, Boteanu Street, Sector 1, Bucharest.has natural gas; the maximum quantity per frame agreement (20 months) is 3 718 MWh. 1: The economic operator (individual bidder, member of an association, subcontractor, sponsor) or any person who is a member of the management, management or supervisory body of that economic operator or who has the power to represent, decide or control in cit is not in any of the situations provided in art. 164 par. of Law 98/2016 on public procurement. Economic operators (individual bidder, member of an association, subcontractor, third party supporter-part) have the obligation to file the UAAE with the offer, subject to the rejection of the latter as unacceptable, according to art. 137 par. (2) lit. b) from H.G. 395 / 2016.

The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the bidder ranked first in the intermediate rankings-prepared to complete bid evaluation. These documents are:

1) Certificate of fiscal statements regarding the payment of the obligations to the general consolidated state budget, issued by the General Directorate of Public Finances, from which the overdue debts to the General Consolidated Budget occurred at the moment of its presentation (the certificate must be valid at the date of submission); 2) Certificateshow the tax certification regarding the payment of taxes and fees to the local budgets (including for the secondary offices), which revealed the lack of overdue debts at the moment of its presentation, including for the points of work inscribed in the O.NR.C. The bidder will demonstrate the achievement of a global turnover average over the last three years (2015, 2016, 2017), worth minimum:

- Lot 1 - 563 001, 12 RON,

- Lot 2 - 641 625, 60 RON.

If the turnover is expressed in a currency other than RON, the equivalent will be made taking into accountthe average annual rate announced by the National Bank of Romania for each year. In the case of an offer submitted by economic operators participating jointly in the awarding procedure, each of them must demonstrate that the level of the global average turnover requirement for the last 3 years is proportional to the share of the engagement in execution the future contract, according to art. 54 par. (3) of the Law no. 98/2016 on Public Procurement and Art. 31 par. (3) of H.G. no. 395/2016. If the tenderer demonstrates the economic and financial situation, namely the technical and professional capacity invoking the support of a third party / third party, according to the law, then he / she has the obligation to prove his / her support by presenting an employeet firm of that person, confirming that he will make available to the bidder the resources invoked. Subcontractors whose capabilities are based on the tenderer to demonstrate compliance with certain qualification and selection criteria are also considered as third-party supporters, in which case the subcontracting agreement is also a firm commitment. (1) of Law 98/2016, with amendments and completions, where several economic operators participate in the award procedure jointly, the fulfillment of the technical and professional capacity criteria as well as the economic and financial situation are demonstrated by taking considering the resources of all the members of the group, and the authority contracted- As regards the subsequent contracts for the year 2018:

- the electricity supply will actually start 21 days from the date of signing the subsequent contract, time necessary for the contracting authorities to terminate the contract current with the electricity supplier, - gas supply will be inafter the termination of the current contract with the natural gas supplier, as follows: Required period of unilateral denunciation 30 calendar days, but no later than the date: 1 of the month following the termination.

Ranking of first place prizes with equal prices: If, after analyzing the bids received and applying the award criterion, two (two) or more bidders will rank first, the authority the contracting entity will ask them to clarify, through the SEAP, the electronic loading by the economic operators of the documentswhich contain new prices. • Before awarding the framework agreement, the contracting authority shall ask the tenderer ranked first to apply the award criterion to present up-dated supporting documents demonstrating that all the qualification and selection criteria have been met, in coinformation with the information contained in the DUAE
