Provision of rail transport service of steam coal from Lubelski Węgiel "Bogdanka" S.A. for Enea Wytwarzanie sp.z o.o.

The subject of the order is the provision of rail transport service of steam coal from Lubelski Węgiel "Bogdanka" S.A. for Enea Wytwarzanie sp.z o.o. in the period from June 16, 2020 to September 152021, in a total of 6, 000, 000 tons, divided into 3 (three) nw. parts:

Main Site: Enea Wytwarzanie sp. z o. o., Świerże Gorne, Aleja Jozefa Zielińskiego 1, 26-900 Kozienice, POLAND.

The subject of the order is the provision of a rail transport service of steam coal from Lubelski Węgiel "Bogdanka" SA for Enea Wytwarzanie sp. z o. o. in the period from June 16, 2020 toand on September 15, 2021, in the amount of 3, 000, 000 tonnes. The total amount of steam coal to be transported can be from 2, 400, 000 tonnes to 3, 000, 000 tonnes.

The above is due to:

- variability of explosion conditionsenergy devices and installations, which are influenced by factors independent of the Ordering Party, in particular related to the changing needs of electricity consumers, energy demand in the national power system, reducing the volume of energy production by the Ordering Party,

- discrepancies between real coal quality and quality Nominalother set out in the contract for the supply of steam coal, whereby the burned coal may have a higher calorific value than assumed,

- the need to reduce emissions by increasing the share of alternative fuels in combustion (e.g. biomass).

The subject of the contract will be carried out within 15 months of the commencement date performance of the contract or until the maximum quantity specified above has been exhausted, depending onof which of the above-mentioned circumstances occurs earlier. up to 60 days after June 16, 2020.

In the situations listed above, i.e. if the contract was concluded before or after the deadline of 16.6.2020, the deadline for the contract will be shifted accordingly.

If the contracted quantity of steam power for transport has not been exhausted within 15 months from the date of commencement of the contract, the parties may, by way of an annex to the contract, extend the period of the contract until the contracted amount of steam has been exhausted.

The Contractor will meet the condition if he demonstrates that he has aa physical copy of the license for rail freight issued by the President of the Office of Rail Transport or current licenses for rail freight issued by the competent authorities of other European Union Member States or European Free Trade Association (EFTA) Member States of the parties to the Agreement on the European Economic Area, in accordance with from art. 43Act on rail transport and a current copy of the safety certificate issued in accordance with art. 18b of the above-mentioned Act.
