The subject of the order is Transport of children and students living in the city of Ruda Śląska to school and educational placement in the school year 2018/2019

Transport of disabled children (with exclusionm children from pre-school departments) from the area of Ruda Śląska to Primary School No. 12 of the Special for them. St. Łukasz in Ruda Śląska, Junior High School No. 17 special classes run at the Primary School No. 12 St. Łukasza in Ruda Śląska and back to the nearest place of residence of the child, organized in the days of didactic and educational activities in the school year 2018 / 2019.

The Contractor must have the right to carry out the activity of road transport to the area of transport of persons of the Republic of Poland. The contractor whose offer will be rated the highest (assessed as the most advantageous) in order to demonstrate compliance with the condition of participation in the proceedings as above, will be requested to submit the following declarations and documents (actas of the date of submitting statements or documents): - licenses for the provision of road transport, the area of transport of people in the Republic of Poland.

Failure to specify a condition in this respect.

1. Grounds for exclusion: 1.1. Zamaw. exclude from progress. Contractor / in the footnotes referred to in art. 24 sec. 1 point 12-23 of the Act (obligatory conditions). 2. The contractor whose offer will be onassessed in order to demonstrate the absence of grounds for exclusion from the procurement procedure will be requested to submit the following declarations and documents (valid as at the date of submitting statements or documents): 2.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act, issued not earlier than 6 months before the expiry of the term compositionoffers: 2.2. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on late payment of taxes, fees or social security or health insurance premiums, or in the event of such a verdict or decision confirming the payment of such receivables, including any interest or fines, orthe effect of a binding agreement on the repayment of these debts; 2.3. the Contractor's statement about the lack of a ruling against him as a preventive measure of the prohibition against applying for public orders. In the case of Contractors jointly submitting the offer, documents referred to in points 2.1 to 2.3. Each of the Contractors jointly submitting the offer is obliged to submit. 3. Documents submitted by the Contractorthe holder of the registered office or place of residence outside the territory of the Republic of Poland is defined in - 7 and - 8 of the Regulation of the Minister of Development of 26.7.2016 on the types of documents that may be requested by the Order. from Contractors in progress. for ordering 4. Contractor whose offer will be the highest rated (assessed as the most advantageous) in order to demonstrate fulfillment of the conditions of participation inproceedings referred to in section III.1.3), will be requested to submit the following declarations and documents (valid as at the date of submission of statements or documents): 4.1. list of services performed, and in the case of periodic or continuous services also performed, in the last 3 years before the deadline for submission of tenders, and if the period of business is shorter in tduring the period, together with their value, subject, dates of completion and entities for which the services were performed and the inclusion of evidence determining whether these services were performed or are performed properly; Note: The proofs referred to are references or other documents issued by the entity for which the services were performed, and in the case of periodic or continuous servicesch are performed, and if for a justified reason of objective nature the Contractor is unable to obtain these documents, the Contractor's statement; in the case of periodic or continuous services, references or other documents confirming their proper performance should be issued not earlier than 3 months before the deadline for submission of tenders. 4.2. list of persons, skimanaged by the Contractor to perform public order, in particular those responsible for provision of services, quality control or management of construction works, along with information on their professional qualifications, authorizations necessary to perform the order public, as well as the scope of their activities and information about the basis for disposing of these persons; INif the offer is made for more than one part, the list referred to above should be submitted separately for each part of the order. 4.3. a list of tools, plant equipment and technical equipment available to the Contractor to complete the order together with information on the basis of the disposal of these resources. In the case of submitting an offer for more than one part, the list referred to above should be a depositlive separately for each part of the order.

1. The Contracting Authority informs that it provided for the application of the procedure referred to in art. 24aa paragraph 1 of the Act. 2. In order to demonstrate the lack of grounds for exclusion from the procedure for awarding the order and fulfillment of the conditions for participation in the proceedings specified by the Order. it is necessary to submit a statement valid as at the day of submitting bids, in the form of: - a Single Formabout the European Order Document (hereinafter: EAT) constituting Annex 4 to the ToR. The information contained in the EJF Form is a preliminary confirmation that the Contractor is not subject to exclusion from the proceedings and meets the conditions for participation in the proceedings. 4. In order to confirm the lack of grounds for exclusion of the Contractor from the proceedings referred to in art. 24 sec. 1 point 23 of the Act, the Contractor shall provide, pursuant to art. 24 sec. 11 of the Act (within 3 days from the date of placing by the Employer on the website information on the opening of bids, i.e. information referred to in Article 86 (5) of the Act), a declaration of affiliation or non-affiliation to the same Group; in the case of affiliation to the same capital group, evidence that linksia with another Contractor do not lead to distortion of competition in the proceedings. 3. The offer must be accompanied by a document (eg obligation) of another entity to place the Contractor at the disposal of the necessary resources for the needs of implementation, if the Contractor uses the capacity of other entities under the terms of art. 22a of the Act, filed in the form of an original or a copy certified for compliance with the originalm by the entity providing resources. 4. The contractor whose offer will be selected before signing the contract is obliged to provide a performance bond of 5% of the offer price. 5. Note regarding all declarations and documents: If the content of information provided by the Contractor in the EJF corresponds to the scope of information, which the Purchaser requires by requestingnot documents, in particular referred to in section III.1.2.), items from 4.1. to 4.3., the Employer may refrain from requesting these documents from the Contractor. In this case, the evidence of the Contractor's compliance with the conditions of participation in the proceedings and the lack of grounds for exclusion are the relevant information provided by the Contractor or by the entities on whose capacities the Contractor relies onasadach referred to in Article 22a of the Act, in EAT. 6. The Awarding Entity, when calculating the deadline for submitting bids, used the standard contained in Article 43 paragraph 2b of the Public Procurement Law. The basis for shortening the deadline for submitting bids is the fact that one of the Contractors has failed to sign the contract in the previously conducted proceedings. Due to the need to secure the current needs of the Employer, i.e. transporthere, children to schools and educational establishments, the Ordering Party has awarded a single-source order until a competitive procedure for selecting the Contractor has been carried out. Bearing in mind the urgent need to order and the above circumstances, shortening the deadline for submitting bids is fully justified
