Requirement 1: candidates, third-party supporters and subcontractors must not be found in the situations provided for in articles 177, 178, 180 of Law no. 99/2016. the DUAE will be completed and declaration on its own responsibility by the economic operators participating in the award procedure (candidate / candidateassociate / subcontractor / third party supporter) with the information related to their situation. The declarations will be filed with the DUAE. The supporting documents proving the fulfillment of those assumed in the DUAE. These supporting documents can be:

1) certificates regarding the lack of debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (local budget, state budget etc..) valid at the time of their presentation;

2) the criminal record of the economic operator and of the members of the administration, management or supervision body of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document, valid at the time of presentationthem;

3) as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 178 para. (3), 179 para. (2), art. 180 paragraph (2), according to art. 184 of Law 99/2016 on sectoral procurement.

Details:

1) In case of submitting a joint application, the requirement must be fulfilled by all the members of the association, as well as by the third party / third parties.nators, subcontractor / subcontractors, if any;

2) In the case of the country of origin or in the country where the candidate is established, no documents of the criminal record are issued, the contracting entity has the obligation to accept a declaration on its own responsibility or, if in the respective country there are no legal provisions regarding the declaration on its own responsibility, an authentic statementticates the date before a notary, an administrative or judicial authority or a form regarding the organization of the liberal professions that has competence in this regard. Note: in the case of candidates who are foreign legal persons, equivalent certificates will be presented attesting that they do not register outstanding fiscal obligations under the conditions of the law incident in the country of residence.of no. 2: presentation of a declaration regarding the non-classification in the situations provided in art. 72-73 of Law no. 99/2016. The DUAE will be completed and presented according to the template from the Forms section, it will be drawn up by each candidate / associate candidate, including by the third party supporter / subcontractor, as the case may be, and will be presented by all participants once the DUAE and the application are submitted., with infothe brothers related to their situation. The persons holding decision-making functions within the contracting entity are the following: Eric Stab, Anne-Marie Gestin, Laurentiu Musat, Ioana Bratan, Razvan Draghia, Ciprian Ion, Marius Pavelescu.

Economic operators must prove a form of registration under the law of the country of residence from which it can be seen that the economic operator is legally constitutedt, that it is not in any of the situations of cancellation of the constitution as well as the fact that it has professional capacity to carry out the activities that are the subject of the contract. The candidate will prove that the company has in its object of activity and carries out authorized the main activity (s) (services) subjected to / subject to the present procedure. The DUAE will be completed initially of cathree economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of foreign candidates, equivalent documents issued in the country of residence and will be presented, in order to qualify.
