Promotion services for the Radio Romania Actualitati 2018 campaign:

Lot II - (bus shelter city lights, backlit backlit lights, unipolls and extra billboards on national roads).the fulfillment of the assumed by completing the DUAE is to be presented, at the request of the contracting authority, only by the first ranked bidder for each lot in the intermediate rankings drawn up at the completion of the tender evaluation, as follows:

(a) outstanding payments in respect of taxes, taxes or contributions tothe general consolidated budget (local budget, state budget, etc.) at the moment of presentation; (b) the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / Cons(c) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement, (d) Submission of the declaration of avoidance of conflict of interest to the tenderer / candidate / associated tenderer / subcontractor / third party-failure to comply with the provisions of art. 60 of Law no. 98/2016) - Form 1.

The bidders, the supporting third parties and the subcontractors must not be present in the situations stipulated in art. 59 60, 164, 165, 167, from Legea nr. 98/2016. The way in which the fulfillment of the requirement can be demonstrated: The economic operators participating in the award procedure will be filled in with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE shall be submitted, at the request of the contracting authority, only by the ranked tendereron the first place for each batch in the intermediate rankings completed at the end of the bid evaluation.

The failure of the DUAE with the offer (including the affiliate / third party supporter) entails rejecting it as unacceptable. the way in which its support or, as the case may be, the agreement will materialize-subcontracting and / or association agreement is the basis for requesting clarification of any inaccurate form of information contained in the DUAE sections of both the bidder and the subcontractor / third party, which is necessary to ensure proper deployment of the award procedure.

DUAE Completion bythe economic operators participating in the award procedure with the information related to their situation.

The supporting documents proving the fulfillment of the assumed ones by filling in the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of the foreign tenderers, the equivalent documents issued in the country of residence,, at the request of the contracting authority, onlyto the tenderer placed on the first place for each lot in the intermediate rankings drawn up at the completion of the evaluation of the tenders.

The subject of the contract must have correspondence in the CAEN code of the certificate issued by the ONRC.

The economic operators submitting the tender must prove a registration form according to the law in the country of residence, that the [...] details on www.e-licitatie.ro.

The minimum annual turnover of the bidder in the last 3 years (2015, 2016, 2017) must be at least:

- 1 128 000 RON, excluding VAT, for Lot I,

- 564 000 RON, excluding VAT, for Lot II,

100 000 RON, excluding VAT, for Lot III.

The way in which DUAE can be accessed by interested economic operators is https://ec.europa.eu/tools/ ESPD.

ReFailing to clarify:

Requests for clarification will be addressed in Romanian by means of SICAP, the "Questions" section of the award procedure conducted by electronic means and the answers to them will be published in Romanian, in SICAP in the "Documentation, clarifications and decisions "in the tender notice.

To send the requests clearlythe economic operators must register in the SICAP (www.e-licitatie.ro):

- as an economic operator and as a participant in the award procedure.

The evaluation committee will send the clarification requests regarding the offer, in Romanian, by using the technical facilities available in the SICAP ("Questions" section). Economic operators will send the answers to clarifyand any documents requested during the evaluation of the offers, through SEAP (the "Questions" section), fully in the section corresponding to the respective request, in electronic format, in the form of one or more separate documents signed with the electronic signature according to the provisions of Law no. 455/2001 on Electronic Signature.

All documents / documents(bid, requests for clarifications, answers to the clarification requests) will be drafted in Romanian or accompanied by a translation in Romanian. All requirements are mandatory.

Deadline for transmitting the answer to the clarifications: according to the provisions of art. 160 and 161 of Law no. 98/2016.

The way of bidding with equal prices and ranked first for each lot will be made by presenting new financial offers with new prices, which will be analyzed by the evaluation committee.

In the case of tenderers of a different nationality than the one Romanian, the documents will be transmitted in the language of origin, accompanied by a certified translation in Romanian.
