Specialized consulting services in the field of acquisitions, necessary for the purchase of maintenance servicesante subway rolling stock and specialized consultancy services for the teaching / take-over of the underground rolling stock maintenance activity. 1 - Declaration on non-compliance with the provisions of art. 177, art. 178 par. (1) and (2) and art. 180 of Law no. 99/2016. The way to prove the fulfillment of the requirement: To complete the DUAE by the economic operatorsparticipants in the award procedure, with information related to their situation. This document will be completed by each of the proposed tenderers / tenderers / third party / proposed subcontractors.

At the request of the contracting entity, the supporting documents proving the fulfillment of the assumed by completing the DUAE will be mandatory submitted by the tenderer ranked first after the applicationthe area of the award criterion as follows: - - certificates of absence of debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation, - the criminal record of the operator the economic operator and the members of the management, management or supervisory body of that operatoreconomic or those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, - as the case may be, documents proving that the economic operator can benefit from the derogations provided in art. 178 par. (3), Art. 179 par. (2), art. 180 par. (2) of Law 99/2016 on Public Procurement,

- Other editing documents, as appropriate.

Note:

(a) The failure of the DUAE with the offer (including the associate / third party supporter) entails rejecting it as unacceptable, b) The offer will include the firm commitment of the third supporter results in the actual manner in which it will materialize its support or, as the case may be, the subcontracting agreement and / or the association agreement.-foreign documents, documents proving the fact that the bidder does not fall into one of the situations mentioned in the mentioned Articles may be any documents considered as edifying in the country of origin or in the country where the tenderer is established, such as certificates, criminal records or other documents equivalents issued by the competent authorities in that country-in the country of origin or in the country where the tenderer is established, no documents of the kind referred to in the previous paragraph are issued, or such documents do not cover all the situations provided for in art. 177, 178, 180, a declaration shall be accepted on the sole responsibility of the tenderer or, if there is no legal provision in the country on the declaration on his / her own responsibility, -an authenticated statement before a notary, an administrative or judicial authority or a professional association with competence in this respect.

In the case of foreign legal persons, the documents will be accompanied by a certified translation in Romanian.

The tenderers may issue the certificates and can obtain tax and tax information to the consolidated state budget / blocal consumption from the National Agency for Fiscal Administration - General Directorate of Public Finances and respectively from the mayor's offices.

Requirement no. 2 - In order to carry out the verifications provided under art. 71, 72 and 73 of Law no. 99/2016 will submit a declaration on his / her own responsibility regarding the non-compliance with the situations provided under art. 73 lit. d) of Law no. 99/2016. howby which it can be demonstrated the fulfillment of the requirement: the DUAE is filled in by the economic operators participating in the award procedure, with the information related to it

The declaration will be completed by each of the tenderers / the associated tenderer / subcontractor / third party supporter. the Metrorex SA level, corresponding to the organization of the present procedure, are the following:

1) Minimum Requirement: The average turnover for the last 3 years (2015, 2016), 2017) must be at least 1 500 000 RON. To demonstrate that the minimum requirement is met, bidders will present any enforceable documents confirming total annual turnover through the presentationas the case may be, of one or more of the following documents: bank statements or statements, presentation of financial statements or statements of financial statements, statement of turnover for the last 3 available financial years (2015, 2016, 2017) or other documents relevant. Non - resident bidders in Romania will present authorized / certified translations of dothe quotes presented in support of meeting the minimum requirement. In the case of an association, each associate is required to submit these documents and the minimum requirement will be met cumulatively.

The economic and financial situation of a tenderer or a group of bidders may be supported by a third person, either physical or legal, irrespective of the legal relationship existing between them-and bidder. In this case, the tenderer has the obligation to prove that he has taken all the necessary measures in order to have access to the necessary resources at any moment, thus presenting a firm commitment of the third / third supporter / supporters, within the meaning of art. 196 par. (3) of the Law no. 99/2016 and art. 55 of H.G. no. 394/2016. The firm commitment presented by the bidder must specify how it iseffective way by which the third party / supporter / supporters will / will ensure the support; it is a legal instrument that ensures the right of the contracting entity to legitimately claim the fulfillment of certain obligations by the sponsor, the contracting entity having the possibility of direct action against the suspect in case of damagenon-compliance with the obligations set out in the undertaking. At the request of the contracting entity, the tenderer ranked first after application of the award criterion has the obligation to present documents provided by the supporting third party / supporter to show the effective way by which the third party / third party / supporters will ensure the fulfillment of their own commitmentsupporting documents that will be annexed to that engagement. In accordance with Art. 198 of Law no. 99/2016, the economic operator and the third party / third party / supporters will be jointly liable for the execution of the contract. The person providing the support should not be in the situations provided by art. 73 par. (d), art. 177, 178 and 180 of Law no. 99/2016

1)Details of the award criterion used, the assessment factors and the application of the calculation algorithm are presented in the Annex to the data sheet - Valuation Factors and Methodology of Calculation; 2) The bidder submits the tender prepared in accordance with the information and requirements stipulated in the procurement documents, accompanied by the guarantee of participation in the procedure and the unique acquisition document european. The contracting entity accepts the "Unique European Acquisition Document" (DUAE), which consists of an up-to-date liability statement, as a preliminary proof in place of certificates issued by public authorities or by third parties confirming that the economic operator in the cause fulfills the following conditions:

(a) it is not in any of the-the exclusion situations referred to in art. 177, 178 and 180 of Law no. 99/2016,

(b) meets the capacity criteria as requested by the contracting entity.

If the economic operator demonstrates the fulfillment of the economic and financial criteria and the technical and professional capacity invoking the support of a third party, the DUAE includes and-the requested information regarding the third party. In case the economic operator intends to subcontract a part / parts of the contract, the DUAE also includes the requested information regarding the subcontractors. The contracting entity may require tenderers to submit all or some of the supporting documents as evidence of the information contained in the DUAE at any time on-the duration of the award procedure, if this is necessary to ensure the proper conduct of the procedure. Prior to awarding the contract, the contracting entity shall request the tenderer ranked first after applying the award criterion to submit without delay updated supporting documents demonstrating that all the criteriaaccording to the information contained in the DUAE; 3) If, after determining the ranking according to the award criterion, the evaluation commission finds that there are two or more bids with the same price, the contracting entity will ask for clarification by through SEAP, for the electronic loading by the respective economic operators of documents-4) Requests for clarification regarding this tender documentation will be addressed exclusively in the SEAP in the "Questions" section of the award procedure conducted by electronic means and the answers to them will be published in SEAP in the section "Documentation and Clarification" of the participation announcement, the contracting entity following the snot responding to requests addressed by means of communication other than that established in the awarding documentation. Therefore, in order to submit requests for clarification regarding the awarding documentation, economic operators must register in the SEAP.
