Contractors who can apply for the contract:

1. are not excluded from the procurement procedureon the basis of art. 24 paragraph 1 point 12 point 23 of the Act of 29.1.2004 Public Procurement Law (consolidated text: Journal of Laws of 2019, item 1843, as amended), hereinafter referred to as the "Act".

2. The Awarding Entity will exclude the Contractor from the procurement procedure pursuant to Article 24 (5) (1), (2) and (8) of the Act.

The offer should be accompanied by a preliminary confirmation statement valid as at the date of submitting the offer, that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. This statement the Contractor is required to submit in the form of a single European order document, drawn up in accordance with the template of the standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 establishing the standard form of the single European dockof the order, hereinafter referred to as the "single document". The Employer indicates that within the scope of Part IV of the single document only the section α (alpha) must be completed. applies to each of the Contractors jointly applying for the award of these contractsconfirm that the conditions for participation in the procedure are met and that there are no grounds for exclusion to the extent that each of the Contractors demonstrates that they meet the conditions for participation in the procedure and that there are no grounds for exclusion. 22a of the Act, in order to prove that there are no grounds for excluding them from participation in the proceedingsand fulfillment, to the extent that the Contractor refers to their resources, conditions for participation in the procedure, submits uniform documents regarding these entities.

Documents confirming compliance with the abovementioned conditions that will be required on the basis of art. 26 section 1 of the Act:

1) Information from the National Criminal Record in the scope specified in art. 24 paragraph 1 item 13, items 14 and 21 of the Act, subject to Art.133 section 4 of the Act, issued not earlier than 6 months before the deadline for submission of tenders,

2) a certificate from the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submission of tenders, or other confirmation document, that the Contractor has concluded an agreement with the relevant tax authority inin the event of repayment of these receivables, together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or distribution in installments of overdue payments or withholding in full the decision of the competent authority,

3) certificate of the appropriate organizational unit of the Social Insurance Institution or Kasa Rolniczego Ubezpieczenia Społecznego or another dockment confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids, or another document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these receivables with any interest or fines, in particular, obtained legal exemptionsEstablishment, deferment or installment of overdue payments or suspension of the entire implementation of the decision of the competent authority,

4) an excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or register, to confirm the absence of grounds exclusions based on art. 24 paragraph 5 point 1 of the Act.

Contractors who can apply for the Contract:

1. will confirm possession of financial resources or creditworthiness for an amount of not less than PLN 5, 000, 000.00 (in words: five million zlotys).

The condition described above may be met by a group of Contractors jointly applying forto award the order.

Documents confirming compliance with the abovementioned conditions that will be required on the basis of art. 26 section 1 of the Act:

1) information from a bank or cooperative savings and credit union confirming the amount of financial resources or creditworthiness of the Contractor for an amount of not less than PLN 5, 000, 000.00 (in words: five million zlotys), in a period not earlier than1 month before the deadline for submission of bids.

Note:

If the Contractor demonstrating compliance with the condition referred to above, relies on the financial capacity of other entities on the principles set out in Art. 22a paragraph 1 of the Act, the Employer requires the Contractor to submit the document referred to in item 1 above regarding these entities.

1. Note to section IV.2.6 of the notice: The contractor is related toassociated with the offer for a period of 60 days.

2. Continuation of the content of section III.1.1 of the announcement:

5) the Contractor's statement that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions, or in the case of such a judgment or decision, documents confirming payments youreceivables together with any interest or fines or conclusion of a binding agreement on the repayment of these receivables,

6) the Contractor's statement that no decision has been issued against him as a preventive measure of the prohibition to apply for public contracts,

7) the Contractor's statement of no arrears in payment of taxes and fees local, referred to in the Act of 12.1.1991 on taxes andlocal fees (Journal of Laws of 2017, item 1785, as amended),

8) if the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to above in paragraph 2:

a) point 1 submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in whichThe contractor has its registered office or place of residence or place of residence has a person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act, subject to Art. 133 section 4 of the Act,

b) item 2 item 4 submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming accordingly that:

- is not in arrears with oppaying taxes, fees, social security or health insurance contributions, or that he has entered into an agreement with the competent authority regarding the repayment of such receivables together with any interest or fines, in particular he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision competent authority,

- it was not opened to liquidateand no bankruptcy,

9) documents referred to in item 8 lit. a and lit. b, second indent, should be issued not earlier than

6 months before the closing date for submission of tenders. The document referred to in item 8 lit. b, first indent,

should be issued not earlier than 3 months before the expiry of that period.,

10) if in the country in which the Contractor has its registered office or place of residenceand the person to whom the document relates is domiciled, the documents referred to in item 8 above do not appear, they are replaced with a document containing the Contractor's statement, indicating the person or persons authorized to represent it, or the statement of the person whose document concern, submitted to a notary public or before a judicial, administrative or authority bodyprofessional or economic self-government competent for the seat or place of residence of the Contractor or the place of residence of that person. The provisions of item 9 above shall apply accordingly.
