The contracting authority intends to acquire 320 portable computers (laptops) in order to support the traffic control and financial accounting activity

Main Site: Bulevardul Dinicu Golescu nr. . 38, sector 1, locality: Bucuresti, postal code: 010873, Romania(a) Tenderers, third parties and subcontractors must not find themselves in the situations provided for in art. 164, 165, 167 of Law no. 98/2016. In this respect, the DUAE form will be completed by the economic operators participating in the award procedure• The supporting documents proving the fulfillment of the assumed by the DUAE are to be submitted in original, at the request of the contracting authority, only by the bidder ranked first after applying the award criterion (including by the associate tenderer of the winner or third party, subcontractor, as applicable) until date ithe conclusion of the award procedure report, according to art. 196 par. (2) of the Law no. 98/2016 on public procurement.

These documents may be:

1) The criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or of those having the power to represent, control within it, so c• 2) Tax certificate issued by the Public Finance Administration for the payment obligations to the consolidated general budget, showing that the tenderer has no overdue debts at the date of its presentation, higher than the established amount, in accordance with art. 165 and 166 para. (2) of the Law no. 98/2016;

3) The Local Taxes and Charges Certificate, issued by the Local Taxes and Fees Directorate, showing that the tenderer has no outstanding debts at the time of filing, based on the provisions of Art. 165 and 166 para. (2) of the Law no. 4) Where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par.(2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement.

In the case of foreign economic operators, equivalent documents, issued in accordance with the applicable legislation in the country of residence, shall be provided. 193 of Law no. 98/2016, the contracting authority will accept in the DUAE (Single European Procurement Acquis)the claims required to demonstrate qualification requirements, including exercise capacity, as preliminary evidence. (b) Non-compliance with the situations provided by art.-59 and 60 of Law no. 98 / 2016.

Statement of Non-compliance in Art. 59 and 60 of Law no. 98/2016 will be submitted by the tenderers / thirds supporters / subcontractors at the deadline for submission of tenders.

Documents supporting the declaration must be presented in original, at the request of the contracting authority, only by the tenderer on the firstplace after applying the award criterion (including by the affiliate tenderer of the winner or the supporting third party, subcontractor, as the case may be) until the conclusion of the award procedure report, according to art. 196 par. (2) of the Law no. 98/2016 on public procurement.

1) Awarding the same price list placed in the first place: in the situation where two or more bidders placed on the first place the same price, the contracting authority will request clarifications through SEAP and will request-bidders in this situation to submit in electronic format through SEAP a new financial proposal and the contract will be awarded to the bidder whose new financial proposal has the lowest price. If and after re-offerment the bid prices are equal, then the contracting authority will ask for a new price offer until the price can be made possiblea)

2) Without prejudice to the provisions of Law no. 182/2002 on the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted offer the information contained in the technical proposal and in the financial proposal considered to be confidential, classified, protected by an intellectual property right, insofar as, objectivelythe disclosure of such information would be prejudicial to the legitimate interests of the economic operator, in particular as regards commercial secrecy and intellectual property, 3) the filing of valid scanned documents, signed with electronic signature, according to the law, is required; 4) For the purpose of applying the provisions art. 63 par. (2) of Law 98/2016 to facilitate access to identity dataof the participants in the procedure, the Application for participation in the procedure will be submitted - Form no. 1. The form shall also be filled in by the proposed subcontractor or the supporting third party, if applicable; 5) Economic operators are obliged to submit the UAEE with the offer, subject to the rejection of the latter as unacceptable, according to art. 137 par.
