The subject of the order is preparation of the project (design documentation including the construction and executive design) together with the obtainedthe final decision of the permit for the construction of the water supply network with connections to the property and carrying out author`s supervision during the implementation phase of the works carried out on the basis of the documentation being the subject of the contract from the date of the contract with the Contractor of construction works to sign the final acceptance report of these works for investment task No. 3-05 -15-074-1 "Poznań - waterworks networkhead in ul. Starowiejska and ul. Zagonowa ".

in the phase of implementation of works performed onon the basis of the documentation being the subject of the order from the date of the contract with the Contractor of construction works to sign the final acceptance protocol of these works for investment task No. 3-05-15-074-1, Poznań - water supply network in ul. Starowiejska and ul. Zagonowa ". A detailed description of the subject of the contract is included in Part II of the ToR. Description of the subject of the contract (OPZ).

1.Contractor who is not subject to exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 point 12-23 Public Procurement Law, art. 24 paragraph 5 points 1, 3, 5, 6 and 8 of the PPL and who meet the conditions for participation in the proceedings regarding:

a) the competence or entitlement to conduct a specific professional activity, provided that it results from separate provisions - the Employer does not placespecific requirements regarding the description of compliance with this condition of participation in the procedure;

b) economic or financial situation - the Awarding Entity does not impose specific requirements regarding the description of compliance with this condition of participation in the procedure;

c) technical or professional capacity

2. In order to confirm the lack of grounds for exclusion from the procedure and to confirm compliance with the conditions for participation inthe Contractor shall be obliged to provide the Employer with the following statements and documents (within the time limits indicated in the ToR):

a) the Contractor`s statement constituting a preliminary confirmation of the fulfillment of the conditions for participation in the procedure specified in this ToR and the lack of grounds for exclusion, submitted on the form of the single European order document (hereinafter: "EAT"), whose model is Fr.draws up the Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing a standardized single European order document (Official Journal of the EU series L 2016 No. 3, p. 16).

b) an excerpt from the relevant register or from central records and information on economic activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds excludedand pursuant to art. 24 paragraph 5 item 1 of the PZP;

c) a certificate from the competent head of the tax office confirming that the contractor is not in arrears with tax payments, issued not earlier than 3 months before the deadline for submitting bids or another document confirming that the contractor has entered into an agreement with the competent tax authority on repayments these receivables together with possible interest lor in fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision of the competent authority;

d) a certificate of the competent organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the contractor did not arrears with paymentcontributions for social or health insurance, issued not earlier than 3 months before the deadline for submission of bids or other document confirming that the contractor has entered into an agreement with the competent authority on the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue paymentsor withholding in full the decision of the competent authority;

e) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Act and regarding conviction for an offense to imprisonment, to the extent specified in art. 24 paragraph 5 points 5 and 6 of the Act, issued not earlier than 6 months before the deadline for submission of bids;

f) contractor`s statement regardingat the grounds for exclusion referred to in Article 24 paragraph 1 point 15 and 22 of the PPL and in art. 24 paragraph 5 points 5-6 of the Public Procurement Law and the contractor`s declaration of not being in arrears with the payment of local taxes and fees, referred to in the Act of 12.1.1991 on local taxes and fees (Journal of Laws of 2016, item 716).

3. Documents regarding foreign Contractors are described in detail in items 7.4-7.6 of the ToR.

1. In order toconfirmation of the lack of grounds for exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 point 23 of the PPL, the Contractor will be obliged to submit a declaration of belonging or not belonging to the same capital group. The Contractor should submit a statement within 3 days from the date on which the contracting authority posted on the website information aboutreferred to in art. 86 section 5 Pzp.

2. The information to be provided in EAT has been described in detail in section 7.1.a) of the SETC.

3. In the procurement procedure, communication between the Employer and the Contractors takes place via the e-Contracting Party`s platform https://aquanet.ezamawiacy.pl or via e-mail to the e-mail address provided above, provided that the submission of the offer together with EATtakes place only through the e-Purchaser platform (https://aquanet.ezamawiacy.pl).

4. The details of the functioning of the e-Employer platform have been described in the instructions for the Contractor, constituting Annex 8 to the ToR.

5. The offer must be made in electronic form under pain of nullity. The contractor submits the offer on the e-Ordering Party platform. The offer must be written inPolish language should be prepared legibly and provided with a qualified electronic signature by an authorized person.

6. The complete offer must contain:

a) a completed form with a qualified electronic signature, 1 separate file is recommended;

b) filled in EAT in electronic form with a qualified electronic signature, 1 separate file is recommended;

c) in the case ofsigning the offer by a proxy and in the case of contractors jointly applying for the order, a power of attorney bearing a qualified electronic signature is recommended to have 1 separate file for each power of attorney;

d) in the case of relying on the capacity of another entity, the undertaking`s obligation to provide the Contractor with the necessary resources for the implementation orders, fuelwith a qualified electronic signature, 1 separate file is recommended for each commitment.

7. Details regarding the submission of the offer are described in the ToR and the Instructions for the Contractor, constituting Annex 8 to the ToR.

8. The offer validity period is 60 days. In accordance with art. 85 Public Procurement Law, the period begins with the deadline for submitting bids.
