Acquisition of "Axial Expansion Lens Compensators DN900 for the Primary Circuit Dn900" in accordance with the Technical Specifications of the Tender Specifications. in the cases provided for in Articles 164, 165, 167 of Law No 98 / 2016.

The manner of accomplishment:

Will be filled in DUAE in accordance with art. 193 par. (1) of the Law no. 98 / 2016.

The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the contracting authority only to the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders are the following: - - certificates certifying the lack of overdue debts, (local budget, state budget, etc.) at the time of submission, - the criminal record of the economic operator and the members of the administrative, management or supervisory body of the economic operator or those who have power of representation, decision or control within it, as wellresults from the certifying certificate issued by the ONRC / constitutive document, - if necessary, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as appropriate.

If in the country of origin or the country in which the offer is establishedthe supporter / the subcontractor does not issue documents of the nature mentioned above or the documents do not cover all the situations stipulated in art. 164, 165 and 167, an authority has the obligation to accept a declaration on its own responsibility or, if in that country there are no legal provisions on the declaration on its own responsibility, an authentic declaration given to unot a notary, of an administrative or judicial authority or of a professional association with powers in this respect. 2:

Mode of accomplishment:

CA is required to complete the integrity form according to art. 5 of Law no. 184/2016 regarding the establishment of a mechanism for prevention of the conflict of interests in the procedure of awarding the public procurement contracts. 1:

Economic operators submitting a tender must prove a form of registration under the law of the resident country, from which it is clear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities covered by the public procurement contract. The requirement also applies to subcontractors and / or third party supporters who supplement their first-level informationDUAE distinct.

Mode of accomplishment:

1) If 2 or more bids get the same score after applying the calculation algorithm, the ranking will also be setin the decreasing order of the recalculated ranking by taking into account the scores obtained by the respective bids for the evaluation criteria of the technical proposal having the highest weights (from high to low, following the order in which they are specified in the awarding documentation). In the event that this system will result in 2 or more bidsthe contracting authority will re-establish the ranking taking into account the other valuation factors with equal weight (following the order of their specification in the awarding documentation). This system is to be applied whenever necessary to achieve the distribution of bids on distinct positions in the ranking, taking into account the score obtained onthe subsequent assessment factor (the next assessment factor of the technical proposal as outlined above). The winning bid will be declared as the winner in the 1st ranked position according to these rules. If the application of this system leads to the exhaustion of the evaluation factors of the technical proposal without having obtained athe contracting authority will determine the final ranking according to the decreasing order of the score obtained for the "bid price" factor. In the event that no application of this system will result in a ranking of the bids in positions distinct in the ranking, the contracting authority will resort to the trans requestthe bribery by economic operators of documents containing new prices (price re-pricing). Subsequently, if the situations mentioned above continue to subsist, the system explained in this note will be re-enforced, ensuring that all the established steps are reached, until the time when a distinction will be made between the bids in distinct positions in the class2) Transmission of any requests for clarification by economic operators will be made in accordance with the NAPA Notification no. 247 / 6.9.2016 available at:

3) Documentation the award is attached in its entirety to SEAP. Documents are signed electronicallyin accordance with the provisions of art. 22 par. (2) of the Annex to Government Decision 395/2016. In order to view the SEAP awarding documentation, economic operators must have a program required to view electronically signed files (the program is available free of charge on the websites of electronic signatures providers)
