The manner in which the fulfillment of the requirements regarding the personal situation can be demonstrated: the DUAE will be completed by the bidders, subcontractors, third parties, as the case may be, with the information related to their situation. We mention that the declaration according to art. 60 of Law 98/2016 (from the "Forms" section) will be completed and filed by all participants in the procedurehatred with the DUAE deposit. The supporting documents proving the fulfillment of the ones assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked on the 1st place in the intermediate ranking prepared at the end of the evaluation of the offers. regarding himto pay taxes, taxes or contributions to the general budget consolidated at the time of presentation;

The DUAE will be completed by the economic operators directly in SICAP, after authentication, taking into account the quality in which they participate in the award procedure, respectively by the single tenderer / association (leader / associate bidder / subcontractor / third party supporter (according to DUAE user guide bidder published by Agentsa for the Digital Agenda of Romania).

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked in the 1st place in the intermediate ranking prepared at the end of the evaluation of the offers.

In case 2 or more bidders located on the first place have the same price, the contracting authority will request a re-offer through SEAP and will request a bidderto those who are in this situation to send in electronic format in SEAP a new financial proposal. The bidder with the lowest price will be designated the winner, and the framework agreement will be assigned to him, according to art. 138 paragraph (2) of H.G. 395/2016.
