Scope of the requirements: in accordance with Article 66 of the Law, the contracting authority must verify that the tender comes from a tenderer who is not excluded from market access on the basis of the articles 67 to 70 of the Act and which meets the criteria for qualitative selection.

In application of article 60 of the AR, the contracting authority may review the selection of a tenderer at any stage of the procurement procedure which if its situation in the light of the grounds for exclusion or compliance with the applicable selection criterion (s) no longer meets the conditions.

II.6.1.1) Mandatory exclusionary grounds

By the mere fact of submitting an offer, the tenderer certifies that he is not in any of the situations referred to in the exclusion clauses in Article 67 (1) and (2) of the the law of 17.6.2016 and article 61 of the Royal Decree of 18.4.2017 and not be concerned by the cases of incompatibility provided for by articles 6 and 52 of the law of 17.6.2016.

Mocompulsory exclusion:

1) participation in a criminal organization;

2) corruption;

3) fraud;

4) terrorist offenses, terrorist-related offenses or incitement to commit such an offense or complicity or attempt to such offense; (5) money laundering or financing of terrorism; (6) child labor and other forms of human trafficking;

7) Illegal residence of third-country nationals.

Exclusions from 1 to 6 apply for a period of 5 years from the date of judgment. Exclusion criterion 7 applies for a period of 5 years from the end of the offense.

The exclusion of the tenderer also applies when the person sentenced by final judgment is a member of the orgadministrative, management or supervisory authority of the tenderer, or has a power of representation, decision or control within it.

II.6.1.2) Grounds for exclusion with regard to fiscal and social debts

Excluded from present the tenderer who fails to meet his obligations to pay tax debts and social security contributions.

The contracting authorityThe verifier will verify that the tenderer meets his obligations to pay tax debts and social security contributions via the Telemarc platform. If this is not possible, the Contracting Authority will ask the tenderer to provide the following documents:

1) pursuant to Art. 68 of the law of 17.6.2016 and article 62 of the Royal Decree of 18.4.2017, theissuer shall attach to his tender a certificate issued by the competent authority confirming that he is in compliance with his obligations relating to the payment of social security contributions, up to and including the last calendar quarter echu with respect to the deadline for receipt offers, in accordance with the provisions of Belgian law or those of the country where the employees are established;application of art. 68 of the Law of 17.6.2016 and Article 63 of the Royal Decree of 18.4.2017, the candidate or tenderer attached to his application for participation or to his tender, as the case may be, a certificate from which he that it is in accordance with its professional tax obligations according to the legal provisions of the country where it is established. The certificate is about the last pFiscal period before the deadline for receipt of requests to participate or tenders, as the case may be.

The tenderer who does not meet his obligations to pay tax debts and social security contributions is excluded from this procedure. Nevertheless, the tenderer who is in the following conditions may participate:

a) if he does not have adebt greater than EUR 3 000 or (b) if he has obtained a payment period for this debt which he strictly observes.

For each lot, the tenderer provides proof of his economic and financial capacity by providing the following:

(1) proof of professional risk insurance covering at least the amount of his tender;

(2) proof of aturnover equivalent to at least 2 times the amount of the offer of the lot concerned.
