Contractor whose offer will be evaluated as the most advantageous, in order to demonstration of the lack of grounds for exclusion from the procurement procedure (XIII clause 3 of the Terms of Reference) will be summoned on the basis ofvol. 26 para. 1 Pzp to submit the following declarations and documents within the prescribed period: - authorization for running a pharmaceutical wholesaler, customs warehouse or consignment warehouse issued on the basis of art. 72 and art. 74 of the Pharmaceutical Law of November 6, 2001 (i.e., dated 30/10/2017, Journal of Laws of 2017, item 2211, as amended), permission to trade in medicinal products in the Republic of Poland or othera document authorizing the Contractor to trade in and sale of medicinal products, including equivalent documents valid in the EU Member States (applies to medicinal products). In the case of offering medicinal products that contain psychotropic substances and / or precursors, permit marketing of psychotropic substances, - information from the National Criminal Register in the scope ofNot specified in art. 24 sec. 1 point 13, 14 and 21 of the PPL, issued not earlier than 6 months before the deadline for submitting bids,

- Contractor's statement on the lack of a ruling against him as a preventive measure to prohibit applying for public orders,

- excerpt from the relevant register or central records and information about business activities, if separate regulations requiresu to the register or register, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act.

If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, he files documents in accordance with the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the proceedings for grantingmowienie (Journal of Laws 2016 item 1126)

The Contractor whose tender will be evaluated as the most advantageous in order to demonstrate the absence of grounds for exclusion from the procurement procedure (XIII clause 3 of the Terms of Reference) will be called upon based on art. 26 par. 1 PPL to submit the following declarations and documents within the prescribed period:

- wiethe receipt of the competent head of the tax office confirming that the Contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained prthe right to dismiss, postpone or spread installments of overdue payments or suspend in full the execution of the decision of the competent authority, - a relevant certificate of the organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security contributions luhealth bills, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or distribution to installments of arrears or suspension in fullexecution of the decision of the competent authority, - statement of the Contractor about the lack of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or in the event of issuing such a verdict or decision - documents confirming the payment of these receivables with possible interest lfines or conclusion of a binding agreement regarding repayment of such receivables, - declaration of the contractor on non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (ie on 15.9.2017 OJ, 2017, item 1785, as amended.)

If the Contractor is established or resides outside the territory of the Republic of Poland, places documents in accordance with the Regulation of the Minister of Development of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the procurement procedure (Journal of Laws of 2016, item 1126 )

III. Initial confirmation of compliance with the conditions of participation in the proceedings and no grounds for exclusion: The Contractor sends in an electronic form with a qualified electronic signature valid as of the day of submitting offers a declaration in the form of a Single European Order Document in the scope indicatedm in the SIWZ to the email address: jedz@spsk2.pl. The contracting authority will call the contractor, whose offer will be the highest rated for submitting documents (based on the content of -5 of the Minister of Development Ordinance of 26/7/2016 on the types of documents that the contracting authority may request from the contractor in the contract award procedure (Journal of Laws of 27.7 .2016, item 1126).

IV. The ordering party does not anticipate orders withpersons referred to in art. 67 sec. 1 point 6 and 7 of the Public Procurement Law. The contract will be concluded for the period: - a) Package No. 2.2A, 11, 12, 17 from 1.1.2019 to 31/12/2019 in the case of signing the contract after 1.1.2019. The contract will be concluded for a period of 12 months from the date of its signature. b) Package No. 7, 8, 10, 14 from January 1, 2019 to September 31, 20 in the case of signing the contract after 1.2.2019, wa will be concluded for a period of 12 months from the date of its signature. c) Package No. 4, 5, 6, 9, 13, 27, 28 from January 1, 2019 to February 28, 2020 in the case of signing the contract after 1.3.2019, the contract will be concluded for a period of 12 months from the date of its signature. d) Package No. 21, 22, 23, 24, 25, 26 from 15.3.2019 to 14.3.2020. in the case of signing the contract after 15.3.2019, the contract will be concluded fors 12 months from the date of its signing. e) Package No. 1.20 from 1.4.2019 to 31.3.2020 in the case of signing the contract after 1.4.2019. The contract will be concluded for a period of 12 months from the date of its signing. f) Package No. 15.16 from 1.5.2019 to 30.4.2020 in the case of signing the contract after 1.5.2019. The contract will be concluded for a period of 12 months from the date of its signature.
