- 130a, paragraph 8 SGB V allows the health insurance and pharmazeutiscompanies have to conclude framework discount agreements on the medicinal products to be provided to the public health insurances. In view of the pertinent statutory provisions on the awarding of public contracts, a regular process of active ingredient-based public procurement procedures takes place according to the regulations of the 4th part of the GWB by DAK-Gesundheit. For the from-Tenderer in Annex 2 to the contract for the designation of the active substance allergen extract of various origin (V01AA02, V01AA03, V01AA05) DAK-Gesundheit intends to conclude a drug discount agreement with all interested pharmaceutical companies until the entry into force of new drug rebates. A discount contract i. R. d. Approval model for the o. G, Active ingredient will enter into force on 1.11.2018 and will end on 31.10.2020. Irrespective of this, it automatically ends with the entry into force of the exclusive contract.

The DAK-G assumes that this procedure does not fall within the scope of antitrust law due to the lack of a selection decision and thus the non-discriminatory accessibility of all pharmaceutical companiesfalls. Irrespective of this, it automatically ends with the entry into force of the exclusive agreement on allergen extract of various origins (V01AA02, V01AA03, V01AA05) as a result of a public procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contractual partners.
