The detailed description of the subject of the order is contained in Annex 2b to the ToR.

The ordering party requires the implementation of the order subject to the terms specified in the contracts, which form attachments to the ToR.

Description of the criteria that the ordering party will follow when choosing the offer, with the weighting of these criteriain and in the way of offer evaluation. - Price criterion weight: 60%

Criterion deadline for partial order execution weight: 40%

5.1 Contract award may be applied by contractors who:

1) are not subject to exclusion;

2) meet the conditions for participation in the procedure, if they have been specified by the ordering party in the contract notice or in the invitation to confirm interest.

5.1.1. Performers are applyingapplying for the subject matter of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 item 13 and 14 and 16-20 of the PPL, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that it was taken by the snowo the means are sufficient to prove its reliability, in particular to prove the remedy for damage caused by crime or fiscal offense, financial compensation for damage suffered or rectified, comprehensive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources, which are answernot to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the ban has not expired. None of the Contractors jointly appliesfor the order, referred to in Article 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 of the Public Procurement Law.

The Contracting Authority will examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 para. 1b Pzp. The Employer defines the following conditions for participation in the proceedings:

1) the condition of competences or entitlements to conduct a specific professional activity, if it results from separate regulations, i.e.: In relation to all Tasks, the Awarding Entity does not specify the condition of participation in the proceedings in scope - Contractors jointly applying for granting orders, referred to in art.23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 1 of the PPL,

6. A list of statements or documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion, and documents or declarations confirming that the offered deliveries meet the requirements specified by the ordering party

6.1. Each contractor is obliged to attach to the offer:

1 Currentas at the day of submitting bids, the Contractor's statement (Single European Order Document) - - prepared in accordance with the template attached to the ToR, - - submitted in electronic form, with a qualified electronic signature.

The information contained in the declaration will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the proceedings. - Statementsentities submitting the offer jointly and entities making the potential available on the JEDZ form in the form of an electronic document should be signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. An equivalent requirement applies to EAT submitted by the subcontractor, based on-Art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of the contract, this document is submitted by each of the Contractors jointly applying for the contract or on behalf of the contractor

5.1 The contractor may apply for awarding the contract, who:

1) are not subject to exclusion,

2) meet the conditions for participation in the proceedings, if they have been specifiedby the contracting authority in the contract notice or in the invitation to confirm interest.

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1-points 13 and 14 and 16-20 Pzp, art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or remedied, a comprehensive explanation of the facts and-cooperating with law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying forand the period of validity of the prohibition specified in that judgment has not expired. - None of the Contractors jointly applying for granting orders referred to in art. 23 Pzp, may not be subject to exclusion pursuant to art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 of the Pzp and art. 24 sec. 5 point 8 PzP.

The Ordering Party will investigate whether the Contractor whose offer has been evaluated as the most advantageous, not-subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Employer defines the following conditions for participation in the proceedings:

2) condition of the economic or financial situation, i.e .: Ordering Party does not specify the condition of participation in the proceedings in this respect. Contractors jointly applying for the order, for whomreferred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 2 of the Pzp.

According to art. 24aa paragraph 1 Pzp. The Ordering Party will first evaluate the offers and then examine whether the contractor, whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.this was the highest rated, to submit within the prescribed period, not shorter than 10 days, valid as at the day of submitting the following statements or documents:

List of statements or documents confirming no grounds for exclusion of the Contractor from participation in the proceedings

1 Current extract from the relevant register or from central records and information about business activities, if separate provisionssy require an entry in the register or register in order to demonstrate the absence of grounds for exclusion based on art. 24 sec. 5 point 1 of the Act,

2 Current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submitting offers,

3 Current certificate of the competent head of the tax office confirmsthat the contractor is not in arrears with paying taxes, or a certificate that he obtained the exemption, deferral or installment payment of overdue payments, or suspension in full of the decision of the competent authority issued not earlier than 3 months before the deadline for submission of tenders; certificate of the relevant branch of the Social Insurance Institution or Kaof Agricultural Social Insurance confirming that the contractor is not in arrears with payment of social and health insurance premiums, or confirming that he obtained the exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority issued not earlier than 3 months before the deadline for submitting the offerrt;

List of statements or documents confirming fulfillment of the conditions for participation in the procedure set out in Art. 22 ust. 1b Pzp

List of declarations or documents confirming that offered deliveries meet the requirements specified by the ordering party.

5 Item description orders prepared according to the template constituting Annex 4 to the ToR with respect to task No. 1

In the case of Contractors jointly applying for the award of the contract, referred to in Article 23 PPL, these documents are submitted by the plenipotentiary of these Contractors, - In the case of Contractors jointly applying for the award of the contract, these documents are submitted by each of these Contractors, in the form of the original or a copy certified for compliance with the original- Contractor who refers to the resources of other entities, in order to demonstrate fulfillment in the scope in which he relies on their resources, the conditions for participation in the proceedings also submit the document referred to in this point of the specification, concerning those Subject - if the Contractor submits an offer for more than one Task, the Ordering Party will consider that this document, filed in-In order to confirm that the Contractor is not subject to exclusion from the procurement procedure, it is part of the offer referring to these Tasks; - The Employer does not plan to award similar contracts referred to in art. 67 sec. 1 point 6 of the Public Procurement Law - the Employer does not provide for additional orders for supplies referred to in art. 67 sec. 1 point 7 PzP.
