C.N.T.E.E. "Transelectrica" SA owns 322 vehicles and 97 Diesel groups, which use as a source of energy, liquid fuels.

Requirement 1: The bidders, the third parties and the subcontractors must not find themselves in the situations stipulated in art. 177, 178, 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with informedrelated to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting entity, only by the tenderer placed on the 1st place.

These documents are:

1) certificates attesting to the lack of overdue debts related to the payment of taxes or contributions to the general government budget (budget-local, state budget, etc.) the values at the time of the presentation; 2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or those who have the power to represent, control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, dowhich demonstrates that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Public Procurement Act 99/2016; 4) other editorial documents, as the case may be.

Requirement 2: Statement regarding non-compliance with the provisions of art. 73 according to Law 99/2016. The appropriate requirement will be filled in the DUAE form in the docuawarding procedure. The decision-makers of the contracting entity involved in the public procurement procedure are:

Requirement 1: The economic operators submitting the tender must prove a registration formthe laws of the country in which they are established, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to perform the activities that are the subject of the contract. through which it can be demonstrated that the requirement is fulfilled: DUAE will be completed by econo operatorssmall participants in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively a certificate issued by the ONRC or, in the case of foreign tenderers, equivalent documents issued in the country in which they are established, shall be presented at the request of the contracting entity only by the tendererthe tutor is placed in the 1st place. For foreign legal / physical persons, the documents proving a registration / attestation form will be submitted in Romanian (authorization translation)

Requirement 2: The provider will hold an authorization issued by R.A.R. (according to Order 2135/2005 RNTR 4), for the types of fuels (petrol and diesel) required. 54 par. (3) of H.G. no. 394/2016, the economic operator has the obligation to include in the offer a list of affiliated enterprises, insofar they exist. Any potential bidder has the right to request clarifications in writing about the items contained in this documentation. Mandatory contractual clauses must be given as such by bidders and can not be modified. If for sthe contractors proposed in the offer are required to pay directly to them, the incident clauses in the contract model will be modified accordingly. Any change to the mandatory contractual clauses will result in the offer being declared as non-compliant. If bidders have objections, objections or suggestions on specific clauses (other than mandatory ones), the road will be transmitted during clarification. The objections or proposals on specific clauses will not distort or cancel the provisions of the mandatory clauses. It is at the discretion of the contracting authority to accept or not to accept the objections or proposals submitted by the tenderers to the specific clauses of the contract. The contracting authority has the obligation to make knownclarify or eventually modify the assignment documentation by creating a new electronic file in SEAP, which will provide direct and unrestricted access, similar to access to the original file. Where bidders are required to clarify during the bid evaluation, they are under an obligation to respond clearly and unambiguously.If the answers are found to be unclear or incomplete, the evaluation commission is not obliged to repeat the request for clarification and may apply the provisions of art. 140 para. (4) of H.G. no. 394 / 2016.

1) Any modification of the mandatory clauses in the contract will lead to the declaration of the offer as non-conforming according to art. 143 par. (3) lit. b) from H.G. no. 394/2016; 2) If two or myou have many bids ranked first, with equal scores, the tie will be made taking into account the score obtained with the rating factors in descending order of their weight. If equality is maintained, the contracting entity has the right to request new financial proposals and the winning bid will be the one with the lowest financial proposal;the winner of the contract will present, in full, without any waiver or omission, the subcontract agreement / agreement or the legalized association agreement, if applicable, 4) The electronic version of the DUAE (eDUAE) is made available as an online form by the Commission Europeana, dedicated website - https://ec.europa.eu/growth/tools-databases/espd/filter;
