Framework agreement for the supply of automotive fuel (diesel and gasoline) required for the automotive fuel supplythe dwellings of D.G.R.F.P. Craiova, diesel for the generating sets from the premises belonging to the institution, supply of bulk diesel (delivery in tanks) for the supply of diesel fuel plants at S.F.O. Orsova, S.F.O. Strehaia, S.F.O. Corabia and S.F.O. Gura Lotrului, supply of liquefied petroleum gas (LPG) to Mehedinti customs office, supply of liquefied petroleum gas (GPL) at S.F.O. Horezu, according to the necessity report and the technical specifications of the tender specifications

Personal situation of the candidate or tenderer:

(a) Exclusion reasons: Tenderers, third parties and subcontractors should not find themselves in situations covered by the provisionsart. 164, art. 165, corroborated with 166, art. 167 of Law no. 98 / 2016.

The manner in which the requirement can be demonstrated:

Economic operators are required to complete and initially present the DUAE (including associates / subcontractors / third-party supporters) as the first proof of non-compliance in exclusion situations and in meeting capacity requirements (refer to Guide-use DUAE developed by ANAP available at www.anap.gov.ro) with information related to their situation. DUAE shall be electronically signed in SICAP in accordance with Art. 60 par. (4) of H.G. no. 395/2016, respectively the documents will be signed with an extended electronic signature, based on a qualified certificate, issued by a certification service provider accredited according to the lawand uploaded to the SICAP in the specific sections available in the IT system and only by registered economic operators.

The tenderer ranked first after application of the award criterion on admissible tenders proves non-compliance in exclusion situations by submitting, at the request of the contracting authority, rule of the following information and documents:

- ce(local budget, state budget) at the time of presentation, - the criminal record of the economic operator and of the economic operator, and the amount of the tax payable in respect of taxes, duties or contributions to the general consolidated budget; to the members of the management, management or supervisory body of that operatoreconomic or those who have power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / constituent act, - where appropriate, documents demonstrating that the economic operator can benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement;• For foreign tenderers: Any editorial documents issued by the competent authorities of the country where they are resident will be presented, proving the fulfillment of the outstanding obligations to pay the taxes to the state budget and the local budget, in accordance with the legislation of the country of residence.

They will be deposited with the next DUAEdocuments: - the firm commitment of the supporting third party to show the actual manner in which its support, subcontracting agreement and / or association agreement will materialize, as the case may be.

The failure to submit them together with the DUAE is the basis for the request for clarifications for possible inaccuracy of form of the information contained in the DUAE sections, both of the bidder■ The justification of the qualification criterion: The Contracting Authority has the right to require the economic operators participating in the procedure to prove that they are not in the mandatory grounds for exclusion from the award procedure in accordance with Legal requirements.

Legal basis: Articles 164, 165 and 167 of Leg98/2016,

(b) Avoidance of conflict of interest:

The bidders must not be in the situations provided by the provisions of art. 60 of Law no. 98/2016

Means for demonstrating the fulfillment of the requirement: Declaration of non-compliance in situations potentially generating conflicts of interest with the mention of persons holding decision-making positions within the contracting authorityas well as those involved in the elaboration of the awarding documentation and the conduct of the procedure will be presented by the bidders, third parties and subcontractors, together with [...] details on www.e-licitatie.ro

The bidder (economic operator or members association of economic operators) will provide information on the average annual turnover for the last three available financial years2015, 2016, 2017, depending on the date when the bidder's activity is set up or started.

1) The framework agreement will be concluded with an economic operator; 2) Ranking of the same price placed in the first place: or more bidders placed in the first place have the same price, the contracting authority will request clarification through SEAP and will ask the biddersin this situation, to submit in electronic format through SEAP a new financial proposal, and the contract will be awarded to the tenderer whose new financial proposal has the lowest price; 3) Without prejudice to the provisions of Law no. 182/2002 on the protection of classified information, with subsequent modifications and completions, the economic operator shall specify in the submitted applicationthe information contained in the technical proposal and financial proposal considered to be confidential, classified, protected by an intellectual property right to the extent objectively disclosure of such information would prejudice the legitimate interests of the economic operator, in particular as regards commercial secret and intellectual property; 4) Outcome communicationof the procedure: According to the provisions of Law no. 98 / 2016.

The item that is the subject of the re-listing is the price. For the first place: if it is found that the first ranked offers have equal prices, the contracting authority will request the re-offer, in order to divide the bids. The lowest bidder will be designated the winner. If and after re-listingthe bidding prices are equal, then the contracting authority will ask for a new price offer until the grading is possible.

The DUAE document is available electronically through the dedicated online service, available free of charge by the European Commission, available at Internet https://ec.europa.eu/growth/tools-databases/espd/filter.To viewof the awarding documentation uploaded to SEAP, economic operators must have a necessary program to view the electronically signed files.

The tenderers are obliged to confirm electronically the receipt of the communication on the outcome of the procedure.

The contract form will be submitted with any proposals to modify the specific contractual clauses, proposals that will only be acceptedto the extent that they will not obviously be disadvantageous to the contracting authority. In case of non-submission, the bidder is deemed to accept the terms stated in the awarding documentation.

For submitting requests for clarifications regarding the awarding documentation, the economic operators will register in SEAP (www.e-licitatie.ro) as an economic operator according to pre-Art. 5 par. (1) of H.G. no. 395/2016 and will transmit the requests having regard to the contracting authorities' terms of reference provided for in art. 160 161 of Law no. 98/2016
