The subject of the order is the purchase with delivery dfor the Ordering Party's headquarters of unleaded gasoline in the following quantities:

- task 1 delivery of unleaded Pb95 petrol in the amount of 1 650 m

- task 2 delivery of unleaded petrol Pb98 in the amount of 150 m

The detailed description of the order is included in Annex No. 1 to the Terms of Reference. delivery of the subject of the order:

Stacja Paliw Miejskiego Przedsiębiorstwa Oczyszczania Sp. z o.o., ul. Nowohucka 1, 31-580 Krakow, POLAND.

Deadline for ordering: successively within 12 months from the date of signing the contract, subject to the provisions set out in - 11 para. 3 attachment No. 4 to the ToR.

1. The Contractors who meet the conditions set out in Art. 22 ust. 1 b of the Public Procurement Law, i.e. they have a license to conduct business in the field of defensehere fuels.

- Contractor in accordance with art. 25a para. 2, as a preliminary confirmation that it is not subject to exclusion from the proceedings and meets the conditions for participation in the proceedings is submitted by the Single European Order Document (EAT). The Contractor shall complete the EIN in Part I, Part II, Part III, Part IV, Section A, Section B point 5, Section C, point 1b., Part VI Final Statement. - Contractor in Part IV, Section A, point1 EAT is obliged to show that it has a license referred to in point 6a) of the ToR.

Information on how to complete and send the EAT is provided in point. 8 SIWZ

- Employer, application to the content of art. 26 par. 1 of the Act on Public Procurement Law, will call the Contractor who submits the bid assessed the highest, to submit in the specified, not shorter than 10 days, the current date of submission of the declaratione documents or documents confirming the circumstances referred to in art. 25 ust. 1 ie, to confirm that the Contractor has the authorization to carry out the activity, he will be required to submit the license referred to in point 6 a) ToR, to conduct activities in the field of fuel trading.

2. Grounds for exclusion: The Procurer will exclude Contractors from the proceedings based on art. 24 sec.1 point 13-23 and Article 24 paragraph 5 points 1 and 8 of the Act on Public Procurement Law. - The assessment of the Contractor's failure to comply with the proceedings shall take place on the basis of submitted declarations and documents referred to in point 8 SIWZ.

- Employer, application to the content of art. 26 par. 1 of the Act on Public Procurement Law, will call the Contractor who submits the bid assessed the highest, to submit in the designated, not shorterthan 10 days of time, valid as of the day of submitting statements or documents confirming the circumstances referred to in art. 25 ust. 1 i.e. to confirm that the Contractor is not subject to exclusion pursuant to art. 24 sec. 1 point 13-23 and 24 sec. 5 points 1 and 8 of the Public Procurement Law, i.e. will be obliged to submit: - - a current copy from the relevant register or Central Register and IInformation about Economic Activity, if separate regulations require an entry in the register or records, in order to demonstrate the lack of grounds for exclusion under art. 24 sec. 5 points 1 of the Act, issued not earlier than 6 months before the deadline for submitting offers,

- current certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying the taxin, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or any other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the exemption, deferral or distribution provided for by law-on installments of overdue payments or suspension in full of the implementation of the decision of the competent authority - issued not earlier than 3 months before the deadline for submission of tenders. Continued in point III.1.2) Economic and financial situation

- Contractor in accordance with art. 25a para. 2, as a preliminary confirmation that it is not subject to exclusion from the proceedings and meets the conditions for participation in the proceedings, submits Unitsolits European Order Document (EAT). The Contractor shall complete the EIN in Part I, Part II, Part III, Part IV, Section A, Section B point 5, Section C, point 1b., Part VI Final Statement. - The Contractor in Part IV, Section B, point 5, EAT is obliged to prove that he is insured for the amount referred to in point 6 b) of the ToR.

- Zamusing, applying to the content of art. 26 par. 1 of the Act on Public Procurement Law, will call the Contractor who submits the highest bid, to submit, within the designated period, not shorter than 10 days, valid as of the date of submitting declarations or documents confirming the circumstances referred to in Art. 25 ust. 1 ie: to confirm that the Contractor is insured against civil liability-in the scope of conducted activities related to the subject of the order, he will be required to submit a document confirming that the Contractor is insured against civil liability in the scope of activities related to the subject of the order for the guarantee sum specified in point 6 b). c.d. from point III.1.1) Ability to conduct a professional activity, including requirements related to entry do professional or trade register: - current certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission offers or interiorioskow for admission to participate in the proceedings, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally permissible, postponement or installment payment of overdue payments or withholding in full implementation of the decision of the competent authority - issuedno more than 3 months before the deadline for submitting offers,

- current information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the act issued not earlier than 6 months before the deadline for submission of tenders,

- Contractor's statement about the lack of issuing a final court decision or final administrative decision on resignation from ittaxes, fees or social or health insurance premiums or - in the event of issuing such a verdict or decision - documents confirming payment of such receivables with possible interest or fines or conclusion of a binding agreement on repayment of such receivables, - Contractor's statement on the lack of a decision to him as a preventive measurea ban on applying for public orders, - a declaration by the Contractor about non-payment of taxes and local fees, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2016, item 716).

According to art. 25a para. 3 point 1 The Contractor who refers to the resources of other entities in order to demonstrate the lack of grounds for exclusion and fulfillment of, to the extent that they refer to their resources, the conditions for participation in the proceedings are also submitted by EED regarding these entities in the scope of art. 24 sec. 1 point 13-22 and para. 5 points 1 of the Act on Public Procurement Law. Detailed information is provided in p. 8 SIWZ.

1. The Contractor is obliged to attach to the offer: a) completed offer form - in accordance with Annex 2 to the Terms of Reference; - b) completed Calculation Formthe price of the offer in accordance with Attachment 3 to the ToR,

c) the Contractor's statement containing all information necessary for the Ordering Party to open the file with EAT, and in particular the password for access to the above-mentioned EAT;

d) proof of payment of the bid bond. E) a declaration regarding the fulfillment of the information obligations provided for in art. 13 or art. 14 GROSS (as per Appendix No. 7 to the ToR) if applicable.

2. Orderingdemands that the bid bond be paid in accordance with the rules set out in point 10 of the ToR.

3. Documents related to belonging to a capital group: the Contractor, within 3 days from the day of submitting the information referred to in art. 51 par. 1a, art. 57 par. 1 or art. 60d para. 1 of the Public Procurement Law or from posting information on the website referred to in art. 86 par. 5 of the Public Procurement Lawshall provide the Employer with a declaration of belonging or non-affiliation to the same capital group as referred to in paragraph 1 point 23 above Act. With the submission of a statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure. Ww. the statement will not be required if you submit1 offer in the proceedings.

4. Information on the method of providing the Ordering Party to the EAT is provided in item 8 of the ToR.

5. If it is necessary to ensure the proper conduct of the procurement procedure, the Ordering Party may at any stage of the procedure call for the Contractors to submit all or some declarations or documents confirming that they are not subject to-exclusion, meet the conditions for participation in the procedure or selection criteria, and if there are reasonable grounds to consider that the previously submitted statements or documents are no longer valid, to submit valid declarations or documents. If the Contractor did not submit a statement referred to in art. 25 a para. 1, statements or documents confirming the circumstances referred to in-Art. 25 ust. 1, or other documents necessary to conduct the proceedings, statements or documents are incomplete, contain errors or raise doubts indicated by the Ordering Party, the Employer calls for their submission, supplement or correction or to provide explanations on the date indicated by them, unless despite submitting them, supplement or correct or explainThe Contractor's offer is subject to rejection or it would be necessary to annul the proceedings.

7. If the Contractor did not submit the required powers of attorney or submitted defective power of attorney, the Employer calls for submitting them on the date indicated by them, unless despite submitting them the Contractor's offer is subject to rejection or it would be necessary to annul the proceedings.First, it will evaluate the offers and then examine whether the Contractor whose tender has been evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. - 9.
