The tenderers, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98/2016 priv■ The method by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in by the economic operators, with the information related to their situation.

At the request of the contracting authority, the candidate / tenderer ranked 1st in the intermediate rankings prepared at the completion of the evaluation of the tenders, will present the following documentsjustifying statements proving the fulfillment of the assumed obligations by completing the DUAE: - a certificate of absence of overdue debts, regarding the payment of taxes, duties or contributions to the consolidated general budget at the moment of presentation, - the criminal record of the economic operator and the members of the body administration, management or supervision of that person-economic operator or those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / instrument of incorporation, - documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, - other deditorial statements, as appropriate.

For non-resident tenderers, in accordance with the provisions of art. 168 par. (3) of Law 98/2016 on Public Procurement, if in the country of origin or in the country in which the tenderer / candidate is established, no documents of the kind provided in paragraph (1) or the respective documents do not cover all the situations stipulated in art. 164, 165 and 167, the contracting authority has the obligation to accept a declaration on its own responsibility or, if in that country there are no legal provisions regarding the declaration under its own responsibility, an authentic declaration made before a notary, an administrative or judicial authority or an association professional who has competence in this respect.

The bidders, third parties and subcontractorsreviewers must comply with the Rules for avoiding conflicts of interest, as set out in Art. 58, 60, 61, 62, 63 of Law no. 98/2016 regarding the public procurement.

In order to verify the information contained in the DUAE, according to art. 196 of the Law no. 98/2016, the contracting authority has the right to request and the tenderer has the obligation to present the supporting documents proving indepthe assumption of those undertaken by completing the DUAE, such as: - - for the Romanian economic operator: certificate issued by the Trade Register Office of the competent territorial court. The certificate of incorporation / extract from the register must show:

(a) the tenderer's object of activity; the subject of the contract must have a correspondent in the CAEN of the certificate(b) the status of the bidder, (c) the persons who represent the bidder in relation to third parties.
