The contract involves the supply of the products according to the requirements of the specifications no. 1056 / 12.6.2017 - for the Rovinari Power Plant Branch.

Cooling installations, injection stations, separating plant needed for: Rehabilitation and modernization of the energy block no. 5 of 330 MW per lignite of S.E. Rovinari according to Annex 1 of the tender no. 1056 / 12.6.2017.

Information and formalities for evaluating if requirements are met: Ofecontractors, third parties and subcontractors should not be found in the situations provided for in art. 73, 177, 178, 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. With the DUAE document, the bidder will load into SEAPand statement on non-compliance on art. 73 of Law no. 99/2016. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, at the request of the contracting entity, only by the bidder placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents may be:

1) certificates of l(2) the criminal record of the economic operator and of the members of the administrative, management or administrative body of the company, as well as the amount of the debts outstanding in respect of the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.); oversight of that economic operator or of those having the power of representation, decision-making or control-within it, as it results from the certifying certificate issued by the ONRC / constitutive document; 3) as the case may be, documents proving that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of Law 99/2016 on Public Procurement; 4) other editing documents, as the case may be.

Information and formalities for evaluating if requirements ment:

The economic operators submitting the tender must prove a form of registration under the law of the country of residence, it should appear that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the capacity professional activity to perform the activities covered by the contract. How it can beOnscreen fulfillment of the requirement: It will be completed by the economic operators participating in the award procedure with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively the certificate issued by the ONRC or in the case of the foreign bidders, equivalent documents issued in the country of residence, shall be preat the request of the contracting entity, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the offers.

(a) According to the provisions of art. 202 of Law 99/2016, the contracting authority will accept, in the framework of the DUAE (Single European Procurement Acquis), the tender documents instead of the documents required to demonstrate the qualification requirements, -as preliminary evidence. DUAE can be accessed (for completion and submission) at https://ec.europa.eu/growth/ tools-databases / espd / filter (DUAE completion instructions are available at www.e-licitatie.ro) . After completing it by the economic operator it will be signed with the electronic signature,

(b) Requests for clarifications of potential bidders will be addressed in mfrom SICAP exclusively to the "Questions" section of the award procedure by electronic means 13 days before the deadline for submitting bids and the answers to all the clarification requests / additional information will be published in the SICAP on the 10th day ahead by the deadline for submitting bids, to the "Documentation and Clarification" section of the announcementthe contracting entity will not respond to the requests addressed by another means of communication than the one established in accordance with the provisions of art. 78 par. (1) of the Law no. 99/2016 for post-submission submissions. The evaluation committee will send the clarification requests for the submitted offers to the SICAP in the "Questions" section.the nominees will submit the answers to the clarifications and any documents requested during the evaluation of the offers through the SICAP (section "Questions"), fully in the section corresponding to the respective request, in the form of one or more separate documents signed with electronic signature, ) The evaluation of the offers is made by comparing the prices presented iwithin the admissible tenders, in the ascending order of the respective prices, the placement based on which the winning bid is established. If the first ranked tenders are found to have equal prices, the contracting entity will ask for clarification through the SICAP, for the electronic loading by the economic operators of documents containing new prices (new-(d) Prior to the award of the Sector Contract, the Contracting Entity will require the tenderer ranked first to apply the award criterion to present updated supporting documents demonstrating the fulfillment of all the qualification criteria, in accordance with the information contained in DUAE. DUAE will be submitted, as appropriate, by the third partysupporting stalk. In the case of foreign economic operators, equivalent documents issued in accordance with the applicable legislation in the country of residence will be presented. Note: Tenders to be uploaded to SICAP without electronic signature will be considered as unacceptable offers, according to art. 143 par. (2) lit. j) from H.G. no. 394/2016
