The contracting entity shall exclude from the awarding procedure the tenderers who are in one of the situations stipulated in art. 177 (1) of Law 99/2016 on Sector Acquisitions; 178 (1) and (2) of Law 99/2016 on Sector Acquisitions; 180 (1) of Act 99/2016 on Procurementsectoral issues; 72 and 73 of Law 99/2016 • The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in by the economic operators participating in the award procedure with the information related to their situation • With the DUAE document, the bidder will upload to SICAP statement on non-compliance on art. 73 of Law no.99 / 2016.

The economic operators submitting the tendermust prove a form of registration in accordance with the law of the country of residence, that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment and that he has the professional capacity to carry out the activities covered of the contract.

Way by which the fulfillment of the requirement can be demonstrated: it will be completeof the DUAE by the economic operators participating in the award procedure with the information related to their situation

The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively the certifying certificate issued by the ONRC, or in the case of the foreign tenderers, equivalent documents issued in the country of residence, will be submitted at the request of the contracting entityonly by the bidders placed on the first 4 places in the intermediate rankings drawn up to complete the evaluation of the tenders.

Following the award procedure, a framework agreement will be concluded with a maximum of 4 economic operators, provided that they exist. in which two or more bids are ranked first, the tie will be made by requesting new proposalsanesthesia and the winning bid will be designated as the lowest bidder.

a) Any economic operator registered with SEAP has the right to submit the offer. Economic operators have the obligation to submit the offer in electronic form and only by the deadline for submission of bids. Documents transmitted by electronic means are legally applicable(b) Requests for clarification of potential bidders will be addressed exclusively in the SEAP in the "Questions" section of the award procedure conducted by electronic means and the answers all clarification requests / additional information will be published in the SEAP at Section"Documentation and Clarification" of the tender notice, the contracting entity not to comply with the requests addressed by means of communication other than that established in accordance with the provisions of art. 78 par. (1) of the Law no. 99/2016 for post-submission submissions. The evaluation committee will forward the requests for clarification of the tenders submitted, in SEAP at the "Questions" section. The economic operators will send the answers to the clarifications and any requested documents during the evaluation of the offers through SEAP (Section "Questions"), fully in the section corresponding to the respective request, in the form of one or more separate documents signed with electronic signature.
