The subject of the order is the delivery of spare parts for SA108 busbars, SA132, SA134 and electric traction vehicles EN76, EN57 within 12 months from the date of signing the contract tonktow Maintenance of the Employer's Rolling Stock, the type, description and delivery conditions are set out in Annex 2 (2.1 2.7) (Price form) and in Annex 4 (Contract template) to the Terms of Reference ("SIWZ").

Main Site : Poznań, Leszno, Zbąszynek.

Spare parts offered for tender must:

- strictly meet the requirements specified in Annex 2.1 to the ToR,

- byoriginal, brand new, free of defects, unencumbered by third-party rights,

- meet the relevant quality requirements and requirements of European standards or Polish standards transferring European standards,

- upon delivery, have a quality control document 2.1 (the requirement for a quality control document has been specified in for each assortment item and indicated in the Price FormAnnex 2.1 to the Terms of Reference) issued on the basis of PN EN 10204: 2006 or equivalent norm, which should be recalled and according to which the Goods should be ensured with the issued certificate / document. The ordering party does not set a specific condition in this respect.

2. Contractors, who are not subject to exclusion in the circumstances of which they can apply, may apply for the award of the contractreferred to in art. 24 sec. 1 point 12-23 of the Public Procurement Law, with the reservation that in the proceedings for a sectoral order the Contractor may not be excluded in the case referred to in art. 24 sec. 1 point 13 lit. d of the PPL Act, and in the case referred to in art. 24 sec. 1 point 14 of the PZP Act, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 point 13 liVol. d of Public Procurement Act

3. The Ordering Party in order to confirm the absence of grounds for exclusion of the Contractor from participation in the contract prior to the contract shall be called by the Contractor whose tender was best assessed to submit in the prescribed, not shorter than 10 days, the current date as of the date of filing the following documents and statements confirming the circumstances referred to in art. 25 para. 1 of the PPL Act:

1) information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the PPL Act (subject to Article 133 (4) of the Public Procurement Law), issued not earlier than 6 months before the deadline for submitting bids;

2) the contractor's statement on the lack of issuing a final court judgment or final decision against it administrative overpayment, fees lor social security or health insurance premiums or, in the event of issuing such a verdict or decision, documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement regarding repayments with the use of the template appendix 6 to the ToR;

3) statements by the contractor about the lack of a title against hima preventive measure to prohibit applying for public orders using the template attachment No. 6 to the ToR.

4. According to art. 24 sec. 11 of the PZP Act, the contractor, within 3 days from posting on the Platform information on the amount that the Employer intends to spend to finance the order, companies and addresses of contractors who submitted bids on time, price, deadlineand orders, warranty period and payment terms included in the offers, shall be provided to the ordering party by posting on the Platform in the "Questions / Information" tab a declaration on belonging to or lack of belonging to the same capital group referred to in Article 24 paragraph 1 point 23 of the Act Pzp. With the submission of a statement, the contractor may provide evidence that links to another will be madethey do not lead to distortion of competition in the procurement procedure. In the case of contractors jointly applying for the order, each contractor submits a declaration. Model of declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Public Procurement Law Act constitutes Annex No. 5 to the ToR.

The Ordering Party does not specify a specific onecondition in this respect.

1. The Contracting Authority uses the right enshrined in art. 24aa of the Public Procurement Law, ie it will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. Foreign contractors. If the contractor has its registered office or place of residence outside the territory of the Republic of Polandj Polish, instead of the documents referred to in Chapter 6 par. 6 point 1) The ToR shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person who is the information or document concerned, in the range specifiedin Article 24 sec. 1 items 13, 14 and 21 of the PPL Act (subject to Article 133 (4) of the PPL Act).

3. Documents referred to in Chapter 6 par. 8 of the SIWZ, should be issued not earlier than 6 months before the deadline for submission of tenders. If in the country in which the contractor has its registered office or place of residence or the place of residence has the person concerned, documents are not issued, mentioned in 6 par. 8 of the SIWZ, it is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was related, filed before a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for headquarters or placese of the contractor's residence or place of residence. Recipe ch. 6 par. 9 of the ToR apply.

5. In case of any doubts as to the content of the document submitted by the contractor, the Contracting Authority may apply to the competent authorities of the country in which the contractor has his registered office or place of residence or the person concerned, to provide the necessary informationand regarding this document.

6. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in Chapter 6, paragraph 6 point 1 of the SIWZ, submits the document referred to in Chapter 6 par. 8 SIWZ, to the extent specified in art. 24 sec. 1 point 14 and 21 of the PPL Act (subject to Article 133paragraph. 4 of the PPL Act). If the country in which the person has a document to reside is located, no such documents are issued, it is replaced by a document containing a statement made by the person before a notary or before a judicial, administrative or professional self-regulatory or economic authority. residence of that person. 7. In case of any doubts as to the content of the document submitted by the contractor, the Contracting Authority may contact the competent authorities of the country in which the person concerned is residing, for providing the necessary information regarding this document.
