Purchase of wheel sets complete for a 22WE vehicle type (EN76)

The subject of the order is the supply of wheelsets complete for the vehicle type 22WE (EN76), of which type, description and delivery conditions are set out in Annex No. 2 (Price form) and in Annex 4 (Contract template) to the Specification of Essential Conditionsw Zamowienia (hereinafter referred to as "SIWZ").

Wheel kits offered for tender must:

- strictly meet the requirements specified in Annex 2 to the ToR,

- be free of defects, unencumbered by persons third,

- meet the relevant quality requirements and requirements of European standards or Polish standards transferring European standards,

- all ordersThe elements on the wheel sets can not be older than 12 months (from the day of delivery),

- parameters of the monobloc wheel and brake discs should correspond to the construction values given in the technical and operational documentation,

- upon delivery, have a quality control document 3.1 based on PN EN 10204: 2006 or equivalent norm, which should be referred to and according to which it should beensure compliance of the Goods with the issued certificate / document.

1. The ordering party does not set a specific condition in this respect.

2. Contractors, who:

1) can not apply for the order, can not be excluded in the circumstances referred to in art. 24 sec. 1 point 12-23 of the PZP Act, with the proviso that in the proceedings for a sectoral order the Contractor is not subject to exclusionin the case referred to in art. 24 sec. 1 point 13 lit. d of the PPL Act, and in the case referred to 24 sec. 1 point 14 of the PZP Act, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 point 13 lit. d of the Public Procurement Act

2) meet the conditions for participation in the proceedings specified by the Employer in the Notice of Order and SIWZ.

3. Ordering in orderconfirmation of the absence of grounds for exclusion of the Contractor from participation in the proceedings prior to the contract being called by the Contractor whose tender was rated at the latest, not shorter than 10 days, valid as at the date of filing the following documents and statements confirming the circumstances referred to in Art. 25 para. 1 of the Public Procurement Law Act:

1) information from the National Registry of Kain the range specified in art. 24 sec. 1 point 13, 14 and 21 of the PPL Act (subject to Article 133 (4) of the Public Procurement Law), issued not earlier than 6 months before the deadline for submitting bids;

2) the contractor's statement on the lack of issuing a final court judgment or final decision against it on tax arrears, fees or social security contributionshealth insurance or in the event of issuing such a verdict or decision documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement regarding repayment of such receivables - using the template attachment 6 to the ToR;

3) the contractor's statement about the lack of a decision regarding him as a preventive measure to prohibit the applicationfor public orders - using the template attachment no. 6 to the ToR.

4. According to art. 24 sec. 11 of the PZP Act, the contractor, within 3 days from posting on the Platform information on the amount that the Employer intends to use to finance the order, companies and addresses of contractors who submitted bids on time, price, order completion date, warranty period and conditionsow of payments included in offers, submits to the ordering party by posting on the Platform in the "Questions / Information" tab a statement about the affiliation or absence of belonging to the same capital group referred to in Article 24 paragraph 1 item 23 of the Public Procurement Law. the contractor may provide evidence that links with another contractor do not lead to distortion of competitionin the procurement procedure. In the case of contractors jointly applying for the order, each contractor submits a declaration. Model of declaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the PZP Act - it constitutes Annex No. 5 to the ToR.

5. Ordering party to confirm the Contractor's compliance with the condition of participationu in the proceedings prior to the order being called by the Contractor, whose offer was rated highest to submit in the prescribed, not shorter than 10 days, the current date as of the date of filing the following documents and statements confirming the circumstances referred to in Article. 25 para. 1 of the Public Procurement Law Act:

1) List of deliveries accompanied by evidence showing whether these deliveries have been made or are madeduly referred to (see below in section III.1.3 Technical capacity and professional qualifications).

The contracting authority does not set a specific condition in this respect.

1. The Contracting Authority uses the right enshrined in art. 24aa of the Public Procurement Law, ie it will first evaluate the offers and then examine whether the contractor whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditionsdepartment in the proceedings.

2. Foreign contractors. If the contractor has a registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in Chapter 6 par. 6 point 1) The ToR shall submit information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractorand the person who is the subject of information or a document is located or residing in the area specified in art. 24 sec. 1 items 13, 14 and 21 of the PPL Act (subject to Article 133 (4) of the PPL Act).

3. Documents referred to in Chapter 6 par. 8 of the SIWZ, should be issued not earlier than 6 months before the deadline for submission of tenders. If in the country in whichthe contractor has a registered office or place of residence or a place of residence has the person concerned, no documents referred to in no. 6 par. 8 SIWZ, it is replaced by a document containing the statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to be submitted, submitted to the notary or przed a judicial or administrative body or a body of professional or economic self-government appropriate for the seat or place of residence of the contractor or place of residence of that person. Recipe ch. 6 par. 9 of the ToR apply.

5. In case of doubts as to the content of the document submitted by the contractor, the Contracting Party may contact the competent authorities of the country in which the contractorand the person, whose document concerns, has the seat or place of residence or place of residence to provide the necessary information about this document.

6. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in Chapter 6, paragraph 6 point 1 of the SIWZ, submits document referred to in Chapter 6 par. 8 SIWZ, to the extent specified in art. 24 sec. 1 point 14 and 21 of the PPL Act (subject to Article 133 paragraph 4 of the PPL Act). If the country in which the person has a document to reside is located, no such documents are issued, it is replaced by a document containing a statement of that person made before a notary or before a judicial authority, administratoror the authority of the professional or economic self-government competent for the place of residence of that person. Recipe ch. 6 par. 9 of the SIWZ, apply.

7. In case of any doubts as to the content of the document submitted by the contractor, the Contracting Authority may contact the competent authorities of the country in which the person concerned is residing, for the necessary information aboutof this document.
