1. Contractors who meet the following conditions for participation in proceedings related to the economic or financial situation can apply for the award of the contract, i.e .: -1.1. The contractor obtained average revenue for the last 3 financial years (based on "accounts from"net income from the sale of products, goods and materials" or "net sales revenues and matched with them") in the amount not less than:

For part 1: PLN 500, 000.00 (in words: five hundred thousand zlotys) )

For lot 2: 260, 000.00 PLN (say: two hundred sixty thousand zlotys)

For part 3: 400, 000.00 PLN (in words: four hundred thousand zlotys)

1.2. The contractor iscovered by civil liability in the scope of activities related to the subject of this order, for the guarantee sum at least:

For part 1: PLN 500, 000.00 (in words: five hundred thousand zlotys)

For part 2: PLN 130, 000.00 (in words: one hundred thirty thousand zlotys)

For part 3: 200, 000.00 PLN (in words: two hundred thousand zlotys)

2. The ordering party will call the Contractor to whomthe tender was rated at the highest, to be submitted within a specified period of not shorter than 10 days as at the day of submitting statements or documents confirming the circumstances of meeting the conditions for participation in the proceedings referred to above, i.e .: -2.1. part of the financial statements (profit and loss account), where the preparation of a report is required by the law of the country inthe contractor is established or residing, and if it is subject to auditing in accordance with the accounting regulations, also with the opinion about the part of the audited report, and in the case of contractors not required to prepare financial statements, other documents defining turnover and assets and liabilities for the last 3 turnover years, and if the period of conductingactivity is shorter for this period.

From the attached part of the financial report should be that the report meets the requirements of art. 52 par. 2 of the Accounting Act of 29.9.1994, ie that the financial report was signed - including the date of signature by the person entrusted with keeping the accounting books and the head of the unit, and if the unit is managed by the body inwholly by all members of this body. In the case of refusal of signature, a written justification attached to the financial statements is required. In the case of Contractors not obliged to prepare the financial statements, the Employer, for "other documents" will recognize, among others, the PIT tax return filed with the Tax Office for each part. confirmatorythat the Contractor is insured against civil liability in the scope of his business related to the subject of this order for the guarantee sum determined by the Employer (confirming payment of insurance) for each part.

1. The Awarding Entity does not provide for advance payments on account of remuneration for the execution of the order.

2. Description of how to prepare offersis included in point 8 of the Specification of Essential Terms of the Order, hereinafter referred to as "SIWZ" (Chapter I of the ToR), including: - 2.1. The offer should include the statement on the single European order form, prepared in accordance with the a standard form defined in the European Commission Implementing Regulation based onArt. 59 par. 2 of Directive 2014/24 / EU, hereinafter referred to as "EAT" in electronic form with a qualified electronic signature, and then together with the files constituting the offer to be compressed into one archive file (ZIP).

2.2. The offer must be accompanied by: completed price forms. 7, 7a, 7b to SIWZ in an electronic form with a qualified electronic signature, anThen, together with the files constituting the offer, to compress to a single file the archive (ZIP).

2.3. Required statement indicated in point 2.1. above (J.EDZ) should be submitted by each Contractor jointly applying for the order.

2.4. Contractor who refers to the resources of other entities, referred to in point 10 of the ToR, in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it refers to their resources, the condition of participation in the proceedings, also submits uniform documents (statement indicatedin point 2.1. above EAT) regarding these entities

3. The Employer will exclude from the proceedings the Contractor in case of meeting the conditions specified in art. 24 sec. 1 point 12 23 and art. 24 sec. 5 points 1, 2 and 4 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2018, item 1986, as amended).

4. The ordering party will call the Contractor, whose offer has been rated the highest, to be submitted to themarked, not shorter than 10 days, the current date as of the day of submitting declarations or documents specified in -5 point 1), 4) and 5) of the Minister of Development's regulation of 26.7.2016 on the types of documents that the contracting authority may request from the contractor in the proceedings for the award of the order, which confirm the circumstances of the lack of grounds for exclusion.

6. Principles of invoking subsurface resourcesthird indentures are set out in point 10 SIWZ.

7. The Contractor joining the tender is obliged, before the deadline for submission of tenders, to submit a bid bond for the entire period of being bound by the offer, in the amount of: - For part 1: 13, 000.00 PLN

For part 2: 6, 000.00 PLN

For lot 3: 9 PLN 000.00.

8. The ordering party in the present proceedings will first evaluate the offers and then examine whether the Contractor to whom theferta was rated as the most advantageous, not subject to exclusion and meets the conditions for participation in the proceedings. If the Contractor referred to in the first sentence avoids concluding the contract or fails to provide the required performance security, the Ordering Party may investigate whether it is not subject to exclusion and whether it meets the conditions for participation in the proceedings. The Contractor who submitted the offerhigher rated from the other offers.

9. The Contracting Authority does not provide for the possibility of ordering referred to in art. 67 sec. 1 point 6 of the Public Procurement Law

10. Information on the processing of personal data is included in point 21. SIWZ (Chapter I of the ToR)

11. The contracting authority requires that the order be completed: commencement: from the day the contract is concluded; termination: 4 months from the contract conclusion date
