CPV Description: Delivery of 1 (one) number of equipment for a transplant / planting of large-size trees for the needs of the WSDDP - Delivery of 1 (one) number of equipment for a transplant / planting of large-size trees for the needs of SOUAP DS.

Main Site: Delivery will take place at the Pernik District, Kladnitsa village, the administrative building of TP "Vitosha-Stud StationsSupply of 1 (one) number of equipment for a transplant / planting stock of large-size trees for the needs of the WPDD.

The equipment subject of the contract is a transplant / planting facility for large-sized trees and must be fully compatible with a combined Terex, TLB 990 PS forklift, The coupling gear must comply with the-Technical Specifications Work and Operations

For this contract, the Contracting Authority has published a notice of preliminary information with No 868541 / 19.9.2018

2.1. The Contracting Authority shall withdraw from participation in a public procurement procedure where:

2.1.1. has been convicted of having entered into force, the judge, unless rehabilitated, for a crime under Art. 108a, Art. 159a-159d, Art. 172, Art. 192a, Art. 194-217, Art. 219-252, Art. 253-260, Art. 301-307, Art. 321, 321a and Art. 352-353e of the Penal Code; has been convicted by a judgment which has the force of res judicata unless he is rehabilitated for an offense similar to paragraph 2.1.1 in another Member State or third country; have tax and duty obligationsinsurance contributions within the meaning of Art. 162, para. 2, item 1 of the Tax Insurance Procedure Code and the interest thereon to the state or the municipality at the headquarters of the contracting authority and the participant, or analogous obligations established by an act of a competent authority under the legislation of the country where the participant is established, unless a rescheduling, deferral or collateral is allowedbut the obligation or obligation is by virtue of an act which has not yet entered into force

2.1.4. there is inequality in the cases under Art. 44, para. 5 of the PPL;

2.1.5. has been found to have: (a) submitted a false document related to the verification of the absence of grounds for removal or the fulfillment of the selection criteria;

(b) has not provided the required information relating to the verification of the absence of oremoval or compliance with the selection criteria;

2.1.6. has been found by a punitive decree or a court decision enacted, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 118, Art. 128, Art. 228, para. 3, Art. 245 and Art. 301-305 of the Labor Code or Art. 13 para. 1 of the Labor Migration and Labor Mobility Act or similar obligations, mouthby an act of a competent authority, under the law of the State in which the applicant or participant is established;

2.1.7. there is a conflict of interest that can not be eliminated

2.2. The grounds under 2.1.1 and 2.1.2 and 2.1.7 refer to the persons representing the participant, the members of the management and supervisory bodies and others who have the power to exercise control over-decision-making by these bodies

2.3. The justification under paragraph 2.1.3 does not apply when: - there is a need to protect particularly important state or public interests, - the amount of unpaid taxes or social security contributions is not more than 1 in 100 of the total annual turnover for the last completed financial year

2.4. The assignor shall withdraw from participation in an award procedurenot a public procurement participant for whom one of the following circumstances occurs:

2.4.1. has been declared insolvent or is in bankruptcy proceedings or is in liquidation or has concluded an out-of-court settlement with its creditors in the sense of Art. 740 of the Commerce Act, or has ceased its activity, and if the participant is a foreign person - is in a similar postarising out of a similar procedure under the law of the State in which it is established,

2.4.2. has entered into an agreement with other persons for the purpose of distortion of competition where the infringement has been established by an act of a competent authority; has been proved to be guilty of non-performance of a public contract or a works concession or service contract leading to a pre-termtermination, payment of benefits or other similar sanctions, except where the non-compliance concerns less than 50 per 100 of the value or volume of the contract,

2.4.4. attempted to: (a) influence the decision by the assignor relating to removal, selection or award, including by providing false or misleading information; or (b) receivedand information which may give him an unjustified advantage in the procurement procedure
