1. Contractors may participate in the proceedings, for which there are no grounds for exclusion from the proceedings under Art. 24 sec. 1 point 12-23 of the PPL Act, subject to art. 133 ust. 4 of the Public Procurement Law, and are not subject to exclusion pursuant to art. 24 sec. 5 points 1-2 and 8 of the Public Procurement Law. The exclusion takes place in the cases specified in art. 24 sec.7 Public Procurement Laws

3. The Contractor is obliged to attach to the offer a statement valid as of the day of submitting bids constituting preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. The declaration referred to in point 3 shall be submitted by the Contractor in the form of a document drawn up in accordance with the specimen of the standard form set out in the Regulationimplementing order of the European Commission issued on the basis of Article 59 (2) of Directive 2014/24 / EU, hereinafter referred to as "EAT".

5 The contracting authority, before awarding the contract, will call the contractor whose offer has been assessed the highest, to submit in the designated, not shorter than 10 days of the date, valid as at the day of submitting statements or documents confirming, among others, no grounds for excluding the contractor fromdepartment in the proceedings including: 5.1 information from the National Criminal Register in the scope specified in art. 24 section 1 items 13-14 of the PPL Act, subject to art. 133 ust. 4 of the Public Procurement Law (applies to: natural persons, board members, members of supervisory boards, proxies, partners of public and partnership companies, general partners in the limited partnership or limited joint-stock partnership) valid as at the date of submission (ofsubmitted no earlier than 6 months before the deadline for submission of tenders),

5.2 information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 21 of the Public Procurement Law (information should refer to collective entities) issued not earlier than 6 months before the deadline for submitting offers;

5.3 a certificate from the competent head of the tax office confirming that the contractoris not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponing or spreading overdue payments into installmentsor a full suspension of the decision of the competent authority;

5.4 a certificate from the relevant organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions issued not earlier than 3 months before expiry of the deadlinesubmission of bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, including any interest or fines, in particular obtained legally permissible, postponement or payment of overdue installments or suspension of the full implementation of the decision of the competent authority.

5.5 a copy from the relevant register or from Ceof the National Registry and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to art. 24 sec. 5 point 1 Pzp;

5.6 Contractor`s statement about the lack of issuing a final court judgment or final administrative decision against him with the payment of taxes, fees or insurance premiums to himsocial security or health or - in the event of such a verdict or decision - documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement regarding repayment of such debts;

5.7 declaration of the Contractor about the lack of a ruling against him as a preventive measure for public orders.

Ordersshall consider that the Contractor meets the condition of participating in the proceeding in the economic or financial situation, if the Contractor shows that he has a current and paid liability policy for an amount not lower than PLN 1, 000, 000.00 (in words: one million zlotys), confirming that the Contractor is insured against civil liability in respect of the conducted activityrelated to the subject of the order for the guarantee sum determined by the Ordering Party above.

1. The proceeding is conducted in an unlimited tender on the basis of art. 39 in conjunction from art. 134 sec. 1 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2017, item 1579, as amended), hereinafter referred to as "Pzp." - 2 PGE Energia Ciepła SA Branch No. 2 CUW in Rybnik, is an authorized bodyto prepare and carry out the proceedings for granting the Order on behalf of and for the Ordering Party.

3. The contracting authority provides for the use, in accordance with art. 24aa Pzp, so-called reversed procedure (ie in the first place will evaluate the offers, and then will examine whether the Contractor, whose offer was evaluated as the most advantageous is not subject to exclusion and meets the conditions for participation in Postępowaniu.)

5. The Contracting Authority allows the possibility of amending the Agreement on public procurement on the terms specified in the Contract template in the ToR.

6. The Contracting Authority informs that in a situation where the Contractor is established or resides outside the territory of the Republic ofof the Republic of Poland, instead of the documents referred to in: - 1) Section III.1.1, point 5.1. submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned by the information or document, in theesie referred to in Article 24 sec. 1 items 13, 14 and 21 and par. 5 points 5 and 6 of the PPL Act,

2) section III.1.1 point 5.2.-5.4. submits a document or documents issued in the country in which the contractor has a registered office or place of residence, confirming that: a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority inhe / she is willing to repay these receivables with possible interest or fines, in particular to obtain the exemption, deferral or installment repayment of the overdue payments or to suspend the execution of the decision of the competent authority in full, b) liquidation has not been opened or bankruptcy has been declared; Documents referred to in point (a) above. b), should be issued no earlier than 6 monthsbefore the deadline for submission of tenders, and the document referred to in a), should be issued not earlier than 3 months before the deadline expires.

8. In the scope not specified in point 6 above and in the scope of documents (and their form) confirming the fulfillment of the conditions for participation in the proceedings, the provisions of the Regulation of the Minister of Development of 26.7.2016 inalmost the kind of documents that the contracting authority may request from the contractor in the procurement procedure (Journal of Laws item 1126).

9. For the values indicated by the Contractor in a currency other than the Polish zloty (PLN), the Employer will accept the conversion rate according to the average exchange rate of the National Bank of Poland on the day of publication of the Contract Notice in the Official Journal of the European Union.
