The subject of the contract is to provide the service delivery and collection of postal parcels and courier parcels in the cities of Bydgoszcz, Toruń, Włocławek, Człuchoin, Ostroda, Brodnica (service B) as described in the subject of the order (OPZ) constituting Annex 5 to the ToR and model agreement constituting Annex 3 to the ToR.

Main Site: Provision of services for the delivery and collection of postal parcels and courier parcels in the city Włocławek district 3 according to OPZ.

Maximum number of services during the contract period 57 510 pcs

1. For the award of the contract may ucontractors who are not subject to exclusion pursuant to art. 24 paragraph 1 and art. 24 paragraph 5 point 1 of the PPL Act. In order to demonstrate the lack of grounds for exclusion, the contractor will be required to submit the following statements and documents:

a) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13) lit. a) -c), art. 24 paragraph 1 point 14) in connection from paragraph 1 point 13) lit. a) -c) and art. 24 paragraph 1 item 21) of the Public Procurement Law, issued not earlier than 6 months before the deadline for submission of bids;

b) an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate provisions require an entry in the register or a register to confirm the lack of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Public Procurement Law;

c) statementsand the contractor about the lack of a final court verdict or final administrative decision on late payment of taxes, fees or social security or health insurance contributions, or in the case of such verdict or documentary evidence confirming the payment of these debts together with any interest or fines or conclusion binding agreementsand on the repayment of these claims;

d) the contractor`s statement that he has not been subjected to a preventive measure against him from applying for public contracts;

e) within 3 days from the date of posting on the platform the information referred to in art. 86 section 5 of the Public Procurement Law, will submit to the ordering party via the platform a declaration of belonging or not belonging to the same groupcapital referred to in art. 24 paragraph 1 point 23 of the Public Procurement Law (prepared using the template constituting Annex 3 to the ToR). Together with the submission of the declaration, the contractor may provide evidence that the links with another contractor do not lead to a distortion of competition in the procurement procedure. In the case of joint application for the contract by the contractors, abovementioned statement regardingit is ordered by each of the contractors;

f) a statement valid as at the date of submission of offers, constituting a preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure. The contractor submits this declaration in the form of a single European order document (EAT) to the extent specified by the contracting authority in the Terms of Reference in electronic form and provides qualifiedm with electronic signature.

2. Contractors who meet the conditions for participation in the procedure may apply for awarding the contract: the contracting authority does not specify the terms of competence or authority to conduct a given professional activity, economic or financial situation as well as technical or professional capacity.

3. In the procedure for awarding the sectoral contract, the contractor does notis subject to exclusion in the case referred to in art. 24 paragraph 1 point 13 lit. d) of the Public Procurement Law, and in the case referred to in art. 24 paragraph 1 point 14 of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense listed in art. 24 paragraph 1 point 13 lit. d) of the Public Procurement Law

1. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of todocuments referred to in chapter III.1.1) of this notice:

1) lit. a) ToR - submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or domicile has the person to whom the information or document relates, rangeie specified in art. 24 paragraph 1 point 13 lit. a-c), art. 24 paragraph 1 point 14) in connection from paragraph 1 point 13) lit. a) -c) and art. 24 paragraph 1 item 21) of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2) lit. b) submits a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming accordingly that its liquidation has not been openedor bankruptcy.

2. The documents referred to in item 1 point 1 and 2 of this chapter should be issued not earlier than 6 months before the deadline for submission of tenders.

3. If in the country in which the contractor has its registered office or place of residence or place of residence there is a person to whom the document relates, the documents referred to in item 1 of this chapter shall not be issued.The decision is replaced by a document containing a statement of the contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to relate, submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the contractor or place of residenceplace of residence of that person. The provisions of item 2 shall apply.

4. The document referred to in point III.1.1) lit. f) this announcement shall be submitted in electronic form and provided with a qualified electronic signature.

5. The document referred to in point III.1.1) lit. e) of this announcement, shall be submitted within 3 days from the date of posting on the platform the information referred to in art. 86 section 5 Pzp.

6. Before awarding the contract, the contracting authority will call the contractor whose offer has been rated the highest to submit it within a designated period, not shorter than 10 days, valid as at the date of submitting the statements or documents referred to in point III.1.1) lit. a) - III.1.1) lit. d) of this announcement.

Note: the contractor may limit himself to completing only section α of Part IV of the EAT form (ogeneral statement on compliance with the conditions for participation in the proceedings). Appropriate (evidentiary) verification of compliance with specific conditions for participation in the procedure (selection criteria) will be made by the contracting authority only in relation to the contractor whose tender was rated the highest (in accordance with point II.2.5) of this announcement).
