The service object of this contract contemplates the execution of all those interventions of ordinary maintenance of the green areas of the Municipality of Rho, to be carried out periodically and systematically, aimed at the care of the municipal heritage and essential to ensure the user an appropriate standard of enjoyment, hygiene and safety (CPV 77311000-3 Maintenance services of ornamental or recreational gardens).

Provisional security

Documentation attesting the successful constitution in favor of CUC Rho of the provisional guaranteein support of the offer, made pursuant to and in accordance with art. 93 of Legislative Decree 50/2016, as amended by Legislative Decree 19.4.2017 n. 56, with validity of 180 days from the date of submission of the bid for an amount calculated as follows:

- center and west lot: 9 833, 82 EUR,

- north lot: 9 004, 86 EUR,

- east lot: 8 EUR 805.48,

- South Lot: EUR 6 195.84.

2% of the total amount of the servicesof each lot. If you participate in several lots, a single guarantee will be sufficient containing all the lots for which it is competing and with the highest amount in relation to the lot in which you participate. Alternatively, a deposit must be produced for each lot.

Final deposit

The successful tenderer before the contract is concluded or before any urgent delivery of the service-the successful tenderer must make a definitive deposit to the extent and in the manner provided for by art. 103 of Legislative Decree 50 / 2016.

Failure to provide the guarantee determines the forfeiture of the assignment and the acquisition of the provisional deposit by the contracting entity that awards the contract to the competitor that follows in the ranking. the charges for failure or incorrect fulfillmentof the contract and ceases to have effect only on the date of issue of the certificate of regular execution or provisional acceptance. The bank guarantee or insurance policy must expressly provide for the waiver of the benefit of the prior enforcement of the principal debtor, the waiver of the exception under Article. 1957, paragraph 2, of the Italian Civil Code and its operations within 15 dayssimple written request from the contracting authority.

In the field of security, the contractor must present the Single Document for the Assessment of Interference Risks (DUVRI).

The intervention is financed by ordinary budgetary means. art. 31 of the contract documents, the contractor will be entitled to payments on account every 6 (six) monthsto be paid to the contractor will be calculated by adding to the quota of the fee (equal to 50% of the annual fee) the amount related to any interventions to measure carried out during the semester, the costs of safety from interference, if due, deducting the amounts of penalties sprayed in the period from the quota due.

The certificate for the payment of the last installment of the correspondentsno matter what the amount, will be released after the completion of the service.

Pursuant to Law 136/2010, payments will be made via the bank or postal transfer instrument, in favor of a bank or post office account that the contractor dedicates, even not exclusively, to public contracts. In this regard, the winner will have to give, at the time of stipulation of the constretch of contract or, if not yet lit, within 7 days of its power on, communication of the identifying details of the dedicated current account and generalities and the tax code of the persons delegated to operate on it and of any changes related to the data transmitted. In the absence of an indication of the dedicated account, the contracting authority will not be able to make any payment, -without prejudice to the termination of the right to the contract.

Entities referred to in Article 45 of Legislative Decree 18.4.2016 no. 50, as amended by Legislative Decree 19.4.2017 n. 56, which meet the following requirements.

Pursuant to art. 48 of Legislative Decree 50/2016, and the participation in temporary grouping of companies or ordinary consortium of concurrents.

Individuals established in other EU Member States are allowed to participate in the conditions and with the modalities provided for by art. 45 of Legislative Decree 50/2016 and art. 62 of Presidential Decree 207/2010, through the production of equivalent documentation according to the regulations in force in the respective countries.

In the case of Temporary Grouping of Companies (RTI), of an ordinary consortium of concothe requisite economic / financial and technical / professional requisites must be owned by the single companies grouped / consortiumed in the measure prescribed in the following paragraphs.

The consortia as per art. 45, paragraph 2, letter b) and c) of Legislative Decree no. 50/2016, are required to indicate for which consortium members the consortium competes; to the latter and forbidden to participate in the tender-in any other form (individual or associated) under penalty of exclusion of both the consortium and the consortium members. For the participation of permanent consortia, the provisions of article 45 of Legislative Decree no. 50 / 2016.

It is forbidden for competitors to participate in more than one group or consortium or to participate also individually if they participate in a group or consortium.-it is also forbidden to participate in competitors who are, in relation to another participant in the same procedure of assignment, in a situation of control pursuant to art. 2359 of the Italian Civil Code or in any report, even de facto, if the control situation or the report implies that the offers are attributable to a single decision-making center.they will be in possession, under penalty of exclusion, of the following requisites:

General requirements

- not be in any of the situations that preclude participation in tenders as per art. 80 of Legislative Decree 50/2016,

- be in compliance with the regulation pursuant to Law 12.3.1999 n. 68 and s.m.i. (mandatory recruitment of disabled persons),

- non-existence of the prohibition to contract according to art. 53, paragraph 16 ter, of Legislative Decree 165/2001, as required by law 190/2012,

- Professional Qualification Requirementals envisaged by art. 83, paragraph 3, of the legislative decree 18.4.2016, n. 50 (registration in the Chamber of Commerce, Industry, Crafts and Agriculture register or similar state or regional professional register belonging to the EU, for the activity covered by this service contract)

Economic and financial capacity

- to have achieved in the last 3 closed periods (2015, 2016 and 2017) to dthe annual call for tenders for each year of the three-year period is not less than:

- north lot: 300 162.00 EUR,

- east lot: 293 516.00 EUR,

- center and west lot : EUR 327 794.00,

- south lot: EUR 206 528.00.

The economic and financial capacity requirements can be met cumulatively by the economic operators participating in the procedure, in the form ofingola or associated.

The turnover requirement must be held by the parent company / mandator at a minimum of 40% and the remaining part cumulatively by / by the principals. In any case, the agent must possess the requisites to a greater extent.

In the case of a consortium as per art. 45, paragraph 2, letters b) and c), of Legislative Decree no. 50/2016, this requirement must be possessed by consorzio or by the consortium members for which the consortium itself participates. Consequently the declaration of possession of the requirement must be produced by the consortium or by the consortium.

Technical-professional capacity

- Having performed in the last three years (2015, 2016 and 2017) at least green maintenance services such determine a specific minimum annual turnover for each year of the triennio, not less than:

- north lot: 150 081, 00 EUR,

- east lot: 146 758, 00 EUR,

- central and west lot: 163 897, 00 EUR,

- south lot: 103 264, 00 EUR.

In the case of RTI or consortium of competitors, this documentation relating to the technical-professional capacity requirements must be produced by the agent.

In the case of a consortium as per art. 45, paragraph 2, letters b) and c), of Legislative Decree no. 50/2016, tathe requirement should be possessed by the consortium or by the consortium for which the same consortium takes part. Consequently the declaration of possession of the requirement must be produced by the consortium or by the consortium members. The competitor must demonstrate this turnover by presenting the list of the main specific services provided in the last 3 years with the indication of the amounts, -dates and recipients of the service itself (see model annex A of the specification).

Motivation of the adoption of the requirement

The contracting authority considers that the minimum turnover is a timely, reliable and reliable indicator with which the economic and financial capacity can be verified economic operators, given the limited consistency of the only bank statementsand insurance coverage.
