The subject of the order is the Contractor's implementation for the Ordering Party of services consisting of unloading coal and feeding coal for production, adequately to the current needs of the Employer, and carrying out work related to maintaining cleanliness in the Area Wsparks, ie areas Carburizing and ash removal, in the Siekierki Heat and Power Plant, in accordance with the estimated maximum demand for works, constituting Annex 1 to contract 19DOZZ089-1, based on orders submitted in monthly settlement periods, confirming the scope of current needs of the Employer. item description 1 parts order placedin the contract template 19DOZZ089-1 with annexes constituting Annex 4 to the Instructions for Contractors - the Contractor will submit to the Ordering Party a copy of the relevant register or central records and business information, if separate regulations require an entry in the register or records in order to confirmation of the lack of grounds for exclusion pursuant to art. 24 sec. 5 point 1 usVltava.

1. Contractors excluded from the proceedings: - did not show compliance with the conditions for participation in the proceedings, or did not show no grounds for exclusion, - a contractor who is a natural person who has been convicted of a crime: - a) referred to in art. 165a, art. 181 188, art. 189a, art. 218 221, art. 228 230a, art. 250a, art. 258 or art. 270, 309 of the Act of June 6, 1997. Kodeks kar (Journal of Laws item 553, as amended) or art. 46 or art. 48 of the Act of 25.6.2010 on sport (Journal of Laws of 2016, item 176),

b) of a terrorist character, referred to in art. 115 - 20 of the Act of June 6, 1997. Penal Code, - c) treasury, - if a member of its management or supervisory body, a partner of a company in a registered or partner society or a general partner in thea mandate or limited joint-stock partnership or a commercial proxy was convicted for an offense referred to in art. 24 sec. 1 point 13 (excluding the conviction of this person for the offense listed in Article 24 (1) (13) d of the Act Article 133 (4) of the Act), - for which a final court judgment or final administrative decision was issued regarding payment default taxes, fees or insurance premiumssocial security or health care, unless the Contractor has made payments of taxes, fees or social security or health insurance contributions, including interest or fines, or has entered into a binding agreement regarding the repayment of such claims, - which - as a result of intentional or gross negligence - introduced the Employer in an error in providing information that is not subject to exclusioneniu, fulfills the conditions for participation in the proceedings or objective and non-discriminatory criteria, hereinafter referred to as "selection criteria", or who has concealed this information or is unable to produce the required documents, - who as a result of recklessness or negligence provided misleading information to the Ordering Party, have a significant impact on the decisions made by the Ordering Party in the proceedingsfor ordering,

- who illegally influenced or tried to influence the actions of the Ordering Party or obtain confidential information that could give him an advantage in the procurement procedure,

who participated in the preparation of the procurement procedure or whose employee, as well as the person executing the order work on the basis of a contract of mandate, task, agency or other contract for witnessservices, he participated in the preparation of such proceedings, unless the resulting distortion of competition can be eliminated in a different way than by excluding the Contractor from participation in the proceedings, - who - with other Contractors has concluded an agreement to distort competition between Contractors in the proceedings for granting orders, which the Purchaser is able to demonstrate withappropriate evidence medium, - being a collective entity, for which the court has ruled that it is forbidding to apply for public orders, - for which a preventive measure was banned from applying for public orders, - Contractors who, in the same capital group, submitted separate offers, offers, unless they show that existing links between them do not lead to a betcompetition - in which the bankruptcy was declared, with the exception of the Contractor who, after the declaration of bankruptcy, concluded an arrangement approved by a valid court order.

Contractors who are in a situation may apply for the award of the contract. economic or financial, i.e. they show average annual income inat least:

1) PLN 2, 000, 000 for the last 3 financial years, and if the period of activity is shorter, this is the average annual income for this period. The condition concerns 1 part of the order:

2) PLN 1, 000, 000 for the last 3 financial years, and if the period of activity is shorter, this is the average annual income for this period. The condition applies to 2 parts of the order:

3) 1 000 000 PLN for the last 3 financial years, and if the period of activity is shorter, this is the average annual income for this period. The condition concerns 3 parts of the order:

Average annual income The Contractor will show on the basis of the "Profit and Loss Account" part of the financial report (item "Net income from the sale of products, goods and materials" or "Net revenue from sales and matched with"annual income is the sum of revenues from the last 3 financial years divided by 3, and if the period of conducting business is shorter, the average annual income is the sum of revenues from the above-mentioned documents, other documents defining turnover and liabilities. period divided by the number of years corresponding to that period. If the income is given in foreign currencies, the Employer will recalculate them according to the average NBP rate of Table A announced on the day the invitation to publish was sent for publication in the Official Journal of the European Union. If the exchange rate of this currency by the National Bank of Poland is not published on the day referred to above, the Employer shall apply the average exchange rate of that currency lastannulled by the National Bank of Poland before the abovementioned date.

The Employer pursuant to art. 24aa paragraph 1 of the Public Procurement Law, may first evaluate the offers and then examine whether the contractor, whose tender was rated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings. The offer under pain of nullity should be made in electronic form and submittedand using the Bidding Platform at https://termika.eb2b.com.pl/. The offer, together with all attachments, is submitted in an electronic form with a qualified electronic signature or a copy certified for compliance with the original by submitting a qualified electronic signature by the Contractor. All documents prepared in a foreign language must be submitted togetherwith translations into Polish.

Offer and attachments must be signed (by electronic signature) by the person / s authorized to represent the Contractor. Authorization (power of attorney) to sign the offer should be attached to the offer, unless it is clear from other documents attached by the Contractor.

By submitting your tender, the Contractor accepts in its entirety and without reservationsorders are defined in the Terms of Reference (hereinafter referred to as "SIWZ") together with all attachments constituting its integral part.

For the preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings, the Contractor shall attach to the offer valid on submit a statement in the form of a single document availablein an editable form posted on the Employer's website. Contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment to them, to the extent that he relies on their resources, the condition of participation in the proceedings, original in electronic form also uniform documents concerning these entities, signed pby the subject, whose documents relate.

In the event of joint application for contractors, a single document shall be submitted in electronic form to each of the contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the contractors demonstrates compliance with the conditionsin the proceedings and no grounds for exclusion.

The ordering party in accordance with art. 29 para. 3a of the PPL Act requires employment by the Contractor under contract of employment, persons performing executive supervision over the implementation of the subject of the order. The Contractor shall submit the Declaration included in Annex 1 to the Instructions for Contractors.
