1. The subject of the order is the provision of office services and helpline services within the current needs of the KRRiT Office.

Main Site: Warsaw

1. The present-the order is to provide office services and helpline services as part of the current needs of the KRRiT Office.

2. A detailed description of the subject of the order and the conditions and manner of its implementation are contained in the IPU constituting Annex No. 1 to the ToR.

3. The Contractor will carry out the order as the Ordering Party needs, on the terms set out in the IPU. The contracting party estimates the demanddaily at the level of not less than 15 people and not more than 25 persons delegated by the Contractor to provide services daily, excluding Saturdays and public holidays.

4. In cases of urgent need on the part of the Ordering Party, the contractor will be obliged to provide additional persons to perform services in the number of not less than 1 person. The contractor provides information on the offerpeople will be able to delegate to the implementation of urgent services in the course of the implementation of the order, i.e. in the manner specified in - 5 para. 7 IPU. In addition, the Contractor is obliged to specify in the offer, on working days, a time delay which the Employer must take into account when requesting the Contractor to refer additional persons to the services. The orderer requires that the above the deadline for filing was nie longer than 5 (five) business days. The number of additional persons that the contractor will be delegated to provide services for the Employer's notification specified in - 5 para. 7 IPU, as well as the completion of the deadline for the time advance required for such a notification, are subject to evaluation of offers on the terms set out in clause 15 of the ToR.

5. The ordering party acting pursuant to art. 29 para. 3a of the PPL Act, requires employmentia by the Contractor or Subcontractor under a contract of employment of all persons performing the activities described in - 1 para. 3 IPUs. The employment of the persons referred to above must last for the whole period of the Contract, subject to - 1 para. 5 IPU. Principles of control of the manner of implementation and documentation of the above the obligations and sanctions for its non-compliance are specified in the IPU, in particular in - 3 para. 10-12 oonce - 10 para. 2 points 4-5. Specific requirements in the above scope include IPU.

9. List of statements and documents confirming compliance with the conditions of participation in the proceedings and no grounds for exclusion

9.1. In order to confirm compliance with the condition of participation in the proceedings, as set out in point 7.1.2. SIWZ and indications of no grounds for exclusion, Contractor:

9.1.1. before the deadline for submittingt he must submit a statement in the form of a Single European Order Document valid as of the day of submitting offers (hereinafter referred to as "EAT"). The information contained in the EED will constitute a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the proceedings. In the case of part IV EED (eligibility criteria), the Contractor only fills in the section a, i.e. general statementse regarding all eligibility criteria. EAT must be in an electronic form with a qualified electronic signature by persons authorized to represent the Contractor (form of an electronic document).

Note:

- In the case of joint application by the Contractors of the EAT, referred to in point 9.1.1 above, each of the Contractors jointly applying for the order . This statement confirms the lack of grounds for exclusion and fulfillment of the conditions for participation in the proceedings in the scope in whicheach of the Contractors demonstrates compliance with the conditions of participation in the proceedings and no grounds for exclusion. EAT each of the Contractors jointly applying for the order must have an electronic form with a qualified electronic signature by the persons authorized to represent each of these Contractors, - Contractor who confirms the fulfillment of the conditions for participation in the proceedings, -depends on the resources of other entities, on the principles set out in art. 22a of the Act, in order to demonstrate the absence of grounds for exclusion against them and fulfillment of conditions for participation in the proceedings - to the extent they refer to their resources - also submits to the Ordering Party the EAT of these entities. EAT OTHER entities must have an electronic form with a qualified electronic signature by othey are entitled to represent each of these entities, - In the case of the Contractor who applies for the order, the EO must confirm the lack of grounds for exclusion and confirm the fulfillment of the conditions for participation in the proceedings and must be in electronic form with a qualified electronic signature by the persons authorized to represent the Contractor ( form of the document elektronicznego).

9.1.2. Together with the offer, the third party will be obliged if the Contractor relies on the resources or situation of the third party.

9.2. The ordering party shall call the Contractor whose bid has been the highest rated, to submit within the prescribed, not shorter than 10 days, the valid day as of the day of submission of declarations or documents confirming: fulfillment inparticipation in the proceedings; no grounds for exclusion. no grounds for exclusion. Section III.1.2) of this notice - Cd section III.1.1)

9.3. To confirm compliance by the Contractor with the conditions for participation in the proceedings specified in clause 7.1.2 of the Terms of Reference, the Employer requests the following documents:

9.3 .1. list of services performed, and in the case of periodic or continuous services also performed, in-the last 3 years before the deadline for submitting bids, and if the period of business is shorter in this period, including their value, subject, dates of completion and entities for which services have been performed, and attaching evidence determining whether these services have been performed or are duly performed, the evidence referred to being references orother documents issued by the entity for which the services were performed, and in the case of periodic or continuous services are performed, and if for a justified reason of objective nature the Contractor is unable to obtain these documents, the Contractor's statement; in the case of periodic or continuous benefits, references or other documents confirming their validity continue to be madethe effective execution should be issued no earlier than 3 months before the deadline for submission of tenders.

9.4. In order to demonstrate the absence of grounds for exclusion from the Contractor's conduct - In circumstances specified by the Awarding Entity in point 1.1 of Chapter VI of the ToR, the Employer requests submission of the following documents:

9.4.1. information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the act issued not earlier than 6 months before the deadline for submission of tenders;

9.4.2. the Contractor's statement that he has not been the subject of a final court judgment or final administrative decision on default of taxes, fees or social security or health insurance premiums, or - in the event of such a judgment or decision being issued - supporting documents-making the payment of these receivables, together with any interest or fines, or entering into a binding agreement regarding the repayment of such receivables. The declaration should be made in accordance with Attachment No. 5 to the ToR,

9.4.3. the Contractor's statement about the lack of a ruling against him as a preventive measure of the prohibition against applying for public orders. The statement should be made in accordance with the StatementNo. 6 to the ToR,

9.4.4. excerpt from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Public Procurement Law. Note: In the case of Contractors jointly applying for the order, the above-mentioned documents are submitted by each of thethe joints occurring jointly. In the case of Contractors based on the abilities or situation of other entities under the rules set out in Article 22a of the Act, the aforementioned documents are submitted by the Contractor in respect of each of these entities.

9.5. Contractor within 3 days from the date of posting on the website information referred to in art. 86 par. 5 of the Act, will provide the Ordering party with thedeclaration of belonging or non-affiliation to the same capital group as referred to in art. 24 sec. 1 point 23 of the Act. The declaration No. 7 to the ToR shall be used to prepare the declaration. With the submission of a statement, the Contractor may provide evidence or information confirming that connections with another Contractor do not lead to distortion of competition in the proceedings. the ordering party requiresa deposit of PLN 40, 000, as described in item 16 of the Terms of Reference

2. the orderer requires a security for due performance of the contract in the amount of 5% of the gross offer price.

3. the contracting authority provides for the possibility of awarding contracts referred to in art. 67 sec. 1 point 6 of the Public Procurement Law up to 50% of the value of the basic order, consisting in the repeated similar services consistent with the subjectbasic orders, e.g. in the scope of: - the order and basic agreement indicated in the subject description, subject to the possibility of increasing or reducing the number of people necessary to perform the Services, - preparing reports in accordance with the needs of the Employer, - conducting inventory of correspondence documentation in the possession of the Ordering Party in a broader scope than described W-Z cake

The order will be granted provided that the ordering party has the necessary financial resources, and the current contractor will ensure no worse standard of the new order than the basic one, as well as the negotiated parties will agree the remuneration, terms and time of order execution. Contractor whose offer will be selected as the bestshall be obliged prior to the conclusion of the Public Procurement Agreement: - submit, in the case of selecting the offer of Economic Operators jointly, a contract regulating their cooperation (consortium agreements). Such an agreement should specify the parties to the contract, the purpose of the action, the manner of cooperation, the scope of works to be performed for each of them, joint and several liability for the performance of the object of the contractdetermining the duration of the consortium (covering the duration of the subject of the order, guarantees and wishes), exclude the possibility of termination of the consortium agreement by any of its members until the order is completed,

- transfer all necessary information necessary to complete the Agreement and indicate the person (s) authorized to conclude the Contract along with the documentsto conclude the Agreement, unless it results from the documents submitted with the offer, - provide a security for due performance of the contract in the amount referred to in point 17 of the Terms of Reference. If you intend to provide a performance bond in one or more of the forms listed in point 17.2 (a) b) - e) ToR, the Contractor whose offer has been selected is obliged immediately after the selection-its offer, without a request, to submit to the Ordering Party a surety or guarantee project in order to check the contents of the Ordering Party. The Contractor should send the content of the surety or guarantee to the following e-mail address: przetagi @ krrit.gov.pl, - - The Contracting Party will inform the Contractor about the number of persons who are obliged to delegate to the contract no later than 5 days before the conclusion of the Agreementordering object. The ordering party estimates its demand

In the first month of the order, 22 people. This number may change depending on the actual needs of the Employer. Ww. the number of people will be entered in - 5 para. 4 contracts and it will be no less than 15 people and no more than 25 people; The Contractor shall provide the Ordering Party with a list of persons referred by the Contractorfor the performance of the Services referred to in - 3 para. 10 IPU at the latest on the day of conclusion of the Agreement.

8. In the present proceedings for the ordering of the declaration, applications, notices and information, the Employer and Contractors provide them via the postal operator within the meaning of the Act of November 23, 2012. Postal Law (Journal of Laws of 2012 item 1529 and 2015 item 1830), in person, indirectlythe order of the messenger or using means of electronic communication within the meaning of the Act of 18.7.2002 on the provision of electronic services.
