A participant in a procurement procedure may be any Bulgarian-or a foreign natural or legal person or their groupings, as well as any other entity entitled to perform supplies and / or services under the laws of the State in which it is established

If the participant participates as a grouping which is not registered as an independent legal entity, then the participants in the grouping make an agreement. The Agreementthe creation of a consortium for participation in the present procurement should be accompanied by a notarized signature of the signatures and the text must contain a reference to the assignor and the procedure for which they are united

The agreement must be submitted by the participant in the original or notarized copy - The agreement must contain clauses that ensure that: - all members-the group is jointly and severally responsible for the performance of the contract, - is appointed a leading member of the grouping which is authorized to oblige, receive instructions for and on behalf of each member of the grouping, - performance of the contract, including payments are the responsibility of the leading member of the grouping, - all members of the grouping are obliged to remain in it forthe entire duration of the contract execution

The members of the grouping must appoint one person to represent the grouping for the purpose of the contract

Changes in the composition of the grouping are not possible after submitting the tender

When no association agreement or there are no clauses in the attached agreement guaranteeing the fulfillment of the above conditions, orthe formation of the grouping has changed following the submission of the tender - the participant may be removed from participation in the tendering procedure of the present procurement

If the participant participates as a grouping, the requirements listed below apply to the group as a whole. Pursuant to Art. 65, para. 1 of the PPA, the participant may refer to the capacity of third parties in relation tothe criteria relating to technical capabilities and professional competence. According to Art. 65, para. (4) of the PPAs, third parties must meet the above selection criteria, for which the tenderer refers to their capacity, and for them there should be no grounds for removal from the procedure. Compliance with the selection criteria is evidenced by the submission of a departmentenEEDOP for the third party (Article 67 (2) of the PPA). If the participant uses the capacity of third parties, he / she must prove that he / she will have their resources by presenting documents about the obligations assumed by third parties. Pursuant to Art. 66, para. 1 of the PPL, the participant may use a subcontractor, and he / she should certify this in his / her bid as well as the share of the order he / she willm assign. In this case, he must provide evidence of the obligations assumed by the subcontractor. According to Art. 66, para. (2) of the PPA, the subcontractor (s) must meet the relevant selection criteria according to the type and the share of the contract they will perform and for them there are no grounds for removal from the procedure. Compliance with the selection criteria shall be demonstrated by presenting the-separate EDEPOP for the subcontractor (Article 67 (2) of the PPA). Notwithstanding the possibility of using subcontractors, the contractor is responsible for the performance of the public procurement contract. The Contracting Authority does not provide for direct payments to subcontractors if the contractor is using it.
